Why didn't our heroes receive adequate workers' compensation benefits in the first place? It is both unjust and demeaning for our heroes to again be victimized by an inadequate workers' compensation program that requires their families to have to rely upon the goodness of the American people's "cookie sales" and a haphazard charitable distribution program. Adding insult to injury are the flawed regulations that fill in the details to the Federal government's unbalanced program to insulate both the aviation and insurance industry from liability. The recent rally at the Park Avenue Armory in NYC supported the WTC United Family Group www.wtcunitedfamilygroup.org revealed the staggering amount of misinformation being disseminated concerning benefits available to our heroes of September 11th. &nbsp&nbsp&nbsp&nbsp , lost his brother in the terrorist attack of September 11th Speaker after speaker highlighted the failure of the system to adequately compensate the victims and their families. NY Attorney General Elliot Spitzer declared the Federal compensation program to be "wrong and unfair." "It is unfair to give up the right to sue without a hearing." He denounced the regulations that establish barriers to recovery based upon timely medical treatment and limitations allowing deduction of charitable benefits under the "collateral source". NY Governor Pataki, who received 7 standing ovations, as he denounced the Federal program as "terrible" and declared that "the regulations make no sense" and that they "do not do justice." As the world focuses upon the ruins of the collapsed buildings in NY, it also focuses upon the failure of the workers' compensation system to meet the needs of the victims. The massive spotlights on ground zero not only reveal the wreckage of September 11th but also the broken promise of adequate compensation to the heroes and their families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. This would be the final step, after determining economic amount, non-economic amount, and reduction for "collateral amounts". Obviously, distribution of the compensation should be subject to approval by the "Big Guy" so that the impact of the adjustment is justly directed. 1) Out of respect to the citizens of this country, there should be an automatic 50% reduction if the victim (deceased or injured) or any recipient of compensation was/is here illegally. 2) Out of respect to the (human) law enforcement/fire/rescue/etc. personnel who risked (and in some cases lost) their lives in reacting to this event, there should be an automatic 50% reduction if the victim (deceased or injured) or any recipient of compensation had/has ever been convicted of a felony, or if no convictions, has/had 5 or more significant charges of any type on their record. 3) Out of respect to the search-and-rescue dogs (some of who also lost their lives), there should be an automatic 50% reduction if the victim (deceased or injured) or any recipient of compensation had/has been convicted of "cruelty or abuse of an animal". I have emailed my senator in the past through websites designed to be proactive towards all types of injustices all over the world. But this morning I was sent an e-mail that I simply can't ignore. This morning I read an e-mail that explains that the compensation for the families of the victims of the terrorist attacks will not include partners of gay/lesbian victims. Why is this? Did these people not die like all the other victims? Do their loved ones not suffer just as much as the loved ones of the heterosexual victims? Is it not absurd to even have to write this to you?? When Americans donated their time to help with the tragedy, they didn't stop to ask who was gay and who was straight. The firemen that lost their lives trying to save people in the twin towers didn't stop to ask that question either. And when Americans from all walks of life reached in their pockets to give money to help with the devastation, no one specified that their donations should go to only heterosexual families. When America stood together to prove to the terrorists that we will not run and hide from these hanus crimes, we all held hands together. And no one, NO ONE, stopped to ask if the hand they held was that of a gay or straight American. Now, six months later, as we remember, and try to get on with our lives, why is this question suddenly a valid one to ask? Why is state law now the president for who "deserves" compensation? It is not a question of morality. It is not a matter for the state. You have a list of names of the people who died that day. Those people, all of them, were equal on that day. No one stopped to ask which chooses to recognize same sex marriages has no bearing here. It has no relevance. It doesn't bring back any of the lost. It doesn't change what happened, or the fact that some of those gay victims are probably responsible for saving our beautiful capital from even more devastation. And now, the ones left behind, who loved and lost these people are being violated again and again. It is in the most vile of taste to even ask the question of whether or not same sex partners who lost loved ones on set. 11 deserve compensation. Has no one in Washington dc any sense of decency? You are supposed to protect and serve us, the American people. All of the American people. Not just the ones who stand for what you stand, or believe in what you believe. You are supposed to rise above your own beliefs for the greater good. You are supposed to be the voice for all Americans...not just straight Americans. For the record, I am a heterosexual American citizen. And when I read that sexual orientation is going to dictate how the money, that Americans far and wide gave so generously, is divided I simply cannot sit and let it happen without at least trying to get through to you, our president of these united states, and ask you to do your job! Zwick Director Office of Management Programs Civil Division United States Department of Justice Main Building, Room 3140 950 Pennsylvania Avenue Washington, D.C. 20530 Dear Mr. Zwick: I write to comment on the Interim Final Rule governing the administration of the September 11th Victim Compensation Fund of 2001, Title IV of Public Law 107-42, the Air Transportation Safety and System Stabilization Act (the "Act"). It is my understanding, and indeed Special Master Kenneth Feinberg noted in his statement which accompanies the Interim Final Rule, that the purpose of the Act, "is not simply "to examine economic and noneconomic harm, but also to provide compensation that is just and appropriate in light of claimants' individual circumstances." (Emphasis added.) It is my further understanding that an additional purpose of the Act is to provide stability in the airline industry by encouraging victims' families to seek relief through the fund rather that in protracted litigation with the airlines and others. After reviewing the Interim Final Rule and considering numerous comments I have received from victims' families, it is my belief that the Interim Final Rule does not serve those purposes. Moreover, I believe that the "collateral source" provisions of the Act are inconsistent with these purposes, and should be re-examined by Congress before final rules for the distribution of funds are adopted. As Borough President of Staten Island, I represent the borough of New York City that was hardest hit by the September 11th attacks. Chief among the complaints I have heard from my constituents is that life insurance proceeds and pension benefits should not be counted as collateral sources to be deducted from awards from the fund. Clearly, deducting such benefits from fund awards is not "just and appropriate in light of claimants' individual circumstances." If taking "individual circumstances" into account is to mean anything, it must mean that victims who provided for the welfare of their families should not have their plans frustrated by the Act. Penalizing the survivors of responsible individuals who have sacrificed financially to provide for their retirements and their families in the event of their untimely deaths is unjust and inappropriate, and will ultimately achieve the perverse effect of discouraging settlements. Another area of great dissatisfaction is the amount of the awards that are to be made under the Interim Final Rule for presumed non-economic loss. Based upon the many comments I have received, the general consensus among victims' families is that the presumed non- economic loss is far too low. Indeed, it has been widely noted that settlements of less grievous personal injury claims frequently exceed the amount of the award fixed by the Interim Final Rule, In view of the fact that the number of victims has fallen significantly since the Act became law, funding for increased awards should be readily available. To promote the purposes of the Act of providing "just and appropriate" relief and encouraging settlement, the Special Master should increase significantly the presumed non-economic loss award. I believe that the very small number of claimants who have filed for compensation from the fund is clear evidence that the issues outlined in this letter are in fact impeding the purposes of the Act. The lives of many of my constituents will be affected dramatically by rules that are ultimately adopted by the Special Master, and on their behalf I urge Mr. Feinberg to give serious consideration to the issues raised herein. Friday, January 25, 2002 10:03 PM I think that $250,000 life insurance policy compensation for this disaster is appropriate. If a natural disaster came in and wiped out an entire block or city, they aren't given this kind of compensation. Yes, it is sad and unfortunate of the circumstances of September 11 but every day people die for no reason and not be compensated. You can't bring them back so the victims of September 11 will go on with their life as many other countless people have to after a love one dies, without huge monetary compensation. It is not the nations or our government's fault but the cruelty of a select few. While this has affected numerous people besides the loved ones and families of the tragedy, it has also caused massive layoffs and slow growth to companies that are hurting and they are not getting help from the government. How can an unemployed person survive on less than $250 a week for a family of 4 in order to pay all expenses? Is the government helping these people? No, they are not, so $250,000 is at least a boost to help these people to survive for a few years where the unemployed will be bankrupted and lose everything until they find another job. $1.4 million for a death is unbelievable. I can't believe that a woman was complaining she wasn't getting anything considering she was fortunate enough to have life insurance, pension plans in place that still exceeded $250,000. Let's put things in prospective. Some of us don't have the money for life insurance or to provide for our kids and $250,000 would certainly allow for any person to get back on their feet either through training to get another job or to help with college funds for children. Let's spread the funds so everyone can eventually get back on their feet, not to profit for a loved ones death. They should be grateful that there is a fund that will give them that kind of money. Money shouldn't be used to measure a person's death because no matter what, nothing can bring them back so let's stop this excessive compensation to victims. Otherwise, how can companies survive or grow to keep our population employed. Some people can not afford higher prices or premiums so that the greedy can be compensated. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." I am writng to say that I am tired of fighting for everything. For funds from the various sources of donated relief and all the time consuming energy it has taken since day one.We are being called greedy because we want to be able to stay where we live ,where our support system is and survive while taking care of our children and dealing with the grief that this tragedy has brought. I am tired of seeing the visual reminders on a day to day basis of how my husband was murdered. We are reminded on a daily basis by what we lost, from pictures in the media and papers and what we are surrounded by in our own homes. There is no time or space for us to grieve for we are constantly filling out forms, talking to lawyers, and dealing with government issues that we would never have had to deal with if this had not happpened and for which we are inexperienced at. But since it did happen and that is our reality we have had to research and learn more than I could ever have imagined in such a short period of time while still having to deal with the what is left of our lives. There is no "unprecedented expression of compassion", just more beurocratic misinformation . My husbands life and all he worked for has come down to what the government deems he is worth according to a monetary formula that leaves no room for us to be treated fairly by our own country. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner."
