To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

important issues.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

treat gay &amp; lesbian families equal!

                   
Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Airline Bailout Settlement Fund


The Airline bailout bill was not passed by Congress to provide for the
families of the victims.  It was created to protect the airlines from
litigation.  The fund that will award damages to families of victims was
included as an incentive to accept a settlement and not sue the airlines.
If the airlines are found to be negligent in protecting their passengers,
they will not face punitive damages.  The US Congress has limited the
liability of these airlines to the extent of their insurance coverage.  In
doing so, they have removed the possibility of punitive damages. It
actually states that the families cannot sue anybody if they accept the
settlement.

The dollar figures that have been cited as an "average" are grossly
misrepresented.  It is sensationalism to come about with an "average"
without knowing what types of money will be counted against the settlement.
If the deceased victim made any sort of plans for his or her family, they
will not receive much at all from this fund.  If someone paid life
insurance premiums for their entire life, they are essentially being
penalized for planning.  If, instead, someone decided to invest this money
rather than buy life insurance, this will not be subtracted from any
settlement award.  The fund discriminates on the basis of their investment
choices.

If life insurance and pension benefits were not counted against the
settlement, then the fund would actually provide an incentive to avoid the
courtroom.  The rules should be changed and changed quickly.  Right now,
those less fortunate may be forced into signing because of financial need.
Protecting the airlines may be necessary, but not at the expense of the
families of the victims.  If this tragedy involved three people instead of
3500, then each family would be looking at settlements from the airlines'
insurance companies.  Just because this event was of such a large scope,
that does not make the loss of a loved one any easier.

If the rules are not changed, then many people will be encouraged to take
this matter to court.  If we are trying to avoid lengthy court battles,
then make the settlement more equitable.  CHANGE THE RULES REGARDING
COLLATERAL SOURCES.

without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

Equal Access

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Victim Compensation

I don't want to sound unsympathetic, but I don't
understand why taxpayer money is paying off the
victims of Sept 11. We don't owe fellow Americans
anything for an untimely death. When did we become
responsible for the financial well being of any
victim? Where do we draw the line? Do we pay for
regular murder victims? Do we pay for traffic victims?
I think not. Each person is responsible for their own
financial planning to take care of their loved ones,
as it should be. What happened to all the money that
was raised for the victims? Why isn't it being used?  

I was taken aback when I heard one of the victim's
relatives indicate that they didn't think the payout
was fair.  This relative thought they were getting
less than they deserved.  How greedy can a person
be!!!  

I also expect the victims of the USS Cole, embassies,
and Oklahoma to now come forth wanting their
compensation package.

The bottom line is no amount of money can replace a
loved one.  Use the money that has been raised to pay
the victim's families.  Don't use my tax money!!!

I am writing concerning benefits for the lost partners of same sex unions
caused by the World Trade Center, Pentagon and Pennsylvania disasters on
September 11, 2001.

This is a horrible tragedy that these events took place and gay and
lesbian lives were lost as well as heterosexual lives. It is unfair that
heterosexual surviving partners are being compensated for the loss of
their love ones but homosexual partners are not. Please compensate all
surviving partners regardless of sexual preference.

Treat everyone alike!! That is the American way to do things.

Dear Mr. Zwick:
Please do everything you can to see that the Department administers the 
September 11 Victim Compensation Fund fairly.  Gay people were killed in the 
9-11 attacks and leave partners and children in need of funds.  Gay people 
DONATED to the fund.  It is only fair that these people be treated the same 
as other survivors.  Respect ALL families.  To me, that is American Family 
Values.

I implore you not to compound the grief of this tragedy with prejudice and 
discrimination.

I can't believe that I am a citizen of a country where we are still so 
homophobic that we would rather give compensation to illegal aliens, who 
were effected by the terrorist attacks on 9/11, than to homosexual domestice 
partners of those effected.  I am not against illegal or legal aliens of 
this country being compensated for their losses.  I am however very against 
the fact that our country will not help compensate the life partners of 
those who died because they are homosexual.  Even though there isn't gay 
marriage in the United States doesn't mean that the loved one of the 
homosexuals shouldn't be helped in some way.
Will we ever learn that this country was based on freedom for all.  Freedom 
for all means equal rights for all.  We still aren't there, and it saddens 
me.

SUBJECT:  11 SEP VICTIM COMPENSATION FUND

Sirs:

I'm writing under the assumption you are committed to respecting the concerns 
of every family.  I refer your to the encouraging material you published 
explaining the intent of this fund and ponder these extracts:  

"Unprecedented expression of compassion on the part of the American people"  
As one of the seriously wounded survivors of the terrorist-related attack on 
the Pentagon, I'm so sorry that this relief didn't start with the Oklahoma 
City victims, the victims of the flood in Houston in June, 2001 and others.   
It is misleading to the taxpayer that the average family will receive $1.6 
million dollars or be made rich from our taxpayer funds when most of the 
families in our areas will receive nothing!   I hope that the relief becomes 
retroactive to them and their representatives take that honorable lead.  I 
don't know one of those victims however I would like to share, and for now 
just help locally.   From 11 Sep 01, one wounded survivor received 
reimbursements, from personal items destroyed, and made initial repayments to 
caretakers, then quietly donated the remainder to a local widow that lost her 
husband suddenly to cancer and was left with no resources to bury him  Don't 
think the worst of the victims and start TRUSTING that they will "do unto 
others" with exponential acts of kindness, in the memory of the American 
people.  This is healing the communities as well. 

"objectives:  (to provide fair, predictable and consistent compensation to 
the victims of September 11 and their familiesâ?¦.."  As a seriously wounded 
survivor I have two simpler and obvious distinctions for any presumed award 
for non-economic loss; those that were in the crash site and those that sat 
safely on the bench.  The experience is imponderable yet you blindly penalize 
the survivors.  I invite you to ponder how to stay the course and respect the 
demonstrable risk of those survivors that crawled away from the plane's dead 
bodies that rested in the burning/ collapsing conference room, with the 
landing gear within sight.  You don't need the physical wound to stick 
fingers into (evidence), it is directly verifiable to the plane's destructive 
path though Wedge 1 of the Pentagon and surviving witnesses.   There may be 
comparable places at the World Trade Center.  Don't short change those few 
surviving souls, trapped in a collapsing inferno building, from a presumed 
award that will help them discreetly find their own private resolutions for 
their families, sanity, support networks and jobs to  "provide them with a 
strong economic foundation from which to rebuild their lives".   Being the 
head of household and sole provider for my family, it is a challenge to do my 
part for my family.  Some of the seriously wounded believe it would have been 
easier it they didn't come out injured and had just died.  I respect that the 
OK City victims are still going through counseling and the government 
continues to help buy-out their homes.  Personal experience has proven that 
Worker's Compensation and insurance will wear them down with "red tape" 
requiring them to constantly prove their need for labor rejected 
prescriptions and to relive the terrors of 11 Sep 01â?¦, while everyone else 
sleeps.

"Advance Benefits in the case of severely injured individuals who required 
hospitalization for one week or more."  Why did you segregate "severely 
injured individuals" under 7 days? Why weren't you consistent with severely 
injured individuals supported by certified contemporaneous medical records?  
Surely the hospitals weren't polled to single out the few severely injured 
individuals that escaped from the hospital/media setting before 7 days?

"In evaluating claims of disability, the Special Master willâ?¦. make a 
determination regarding whether the claimant is capable of performing his or 
her usual profession in light of injuries" 
With all due respect,  these individuals will never perform up to their 
"usual profession"  or "usual daily activities" they are forever changed, 
consider it "replacement services loss" for their families.   Bless you Mr. 
Feinberg and your staff, for admitting you don't understand military 
retirements and that the tragic experience is imponderable.  Stick to your 
resolution for fairness, as you ponder the imponderable.  Rest with the 
dignity that the presumed award for non-economic loss is also appropriate for 
survivors/victims witnessed in the destructive geographic path.  Don't 
fallback on a prejudiced, mortal, biased determination trying to quantify the 
imponderable.

with respect for the victim's dignity and privacy"  Please consider that your 
display of names  "List of Claimants" listed on your web site violates the 
victim's privacy.

Sept 11th

Although not a victim or a member of a victim's family, I do pay taxes and wonder at times who the recipients are.  In reference to the victim compensation plan in place for the Sept 11th tragedy, I firmly support the manner in which the plan is taking effect.  

I feel that the potential beneficiaries of the compensation are receiving in excess of a fair settlement.  I do not recall our government being this generous with victims of any mass tragedy.  It is hard to believe that our country could now be economically devastated had some terrorists infected hundreds of thousands of citizens with anthrax or smallpox or some chemical weapon.  The compensation in a case like that could be $100 billion or more.  Can we afford it?  

Can the airlines be blamed for the insane behavior of terrorists?

Justice Help all terrorist victims


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex
unions.  They suffer just as grievously for their deceased loved ones
as do other survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups
and individuals who would have the Department of Justice limit
compensation to survivors of heterosexual unions.  They are interested
in a political victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

Use of Structured Settlements in Implementing the Victim Compensation Fund

If structured settlements are incorporated into the plan to distribute from the Victim Compensation Fund, such transactions should be handled by settlement brokers who are selected by the injury victims and not the Department of Justice.

September 11 Victim Compensation Fund

Dear Mr. Zwick:

I am writing in response to the Department's request for public comments 
regarding the forthcoming regulations for implementing and administering the 
"Septmember 11 Victim Compensation Fund."  I strongly urge the Department to 
draft regulations that ensure compensation is available to all victims of 
the attack, including the committed partners and the non-biological children 
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic losses suffered 
by the families of gay and lesbian victims are no less than that of other 
families.  Just as the terrorists drew no lines in choosing their victims, 
our country must draw no lines in compensating those who suffered the most 
personal of losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom left behind 
loved ones.  I urge the Department to honor these bonds by treating the 
families of gay and lesbian victims as you would any other.

Victims Comp for Terrorist Acts

Hi,

The victims of terrorist acts whether Anthrax or bombing should receive
monies irregardless to charity gifts, state programs, insurance monies,
employer funds or actual income.  If the government tries to use means
tests then it really doesn't save money.  It diverts the monies that could
be going to the victims to the government workers and private consulting
companies.  Infact by the time you employ thousands of workers, lease
buildings, purchase equipment/supplies and setup communications you could
have  paid the checks out at a lesser cost.  Please keep in mind that the
payout program should realize that the individuals lives where cut short
and that some victims probably would have lived for another 30 to 40 years.

Compensation for Gay Victims of 9/11

Mr. Zwick:

I've detested the "United We Stand" slogans that appeared like mushrooms
after 9/11. Why? Because as a marginalized gay citizen of the United States,
the "United" means everyone except me or people like me. The recent news
coming from the Victims Compensation Fund proposing to exclude gay partners
from compensation solidifies my repugnance for the superficial brand of
nationalism that now permeates our country. Excluding gay partners from
compensation is just another instance of the deep-seated bigotry that runs
rampant here.

Why should I pay taxes? Why should I fight for this country? Why should I
support a President not from my own party when, at least according to press
accounts discussing the compensation fund's anti-gay policy, I'm not valued
even as much as an unborn fetus? Why? Because even when marginalized,
demonized and hated by so many of my countrymen, I still believe in the
basic principles upon which our country was built and try to live by them
every day.

Do the right thing for America, Mr. Zwick, and show the world just how wrong
the Taliban and al Qaeda's beliefs about the U.S. are. Show them that
Americans are a compassionate people. Don't exacerbate the pain, hurt and
unrelenting loss felt by gay partners of those who died on 9/11 by denying
them the just compensation ALL the victims deserve.
