As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Friday, March 22, 2002 2:36 PM Discrimination is un-American Partners of gay and lesbian heroes of September 11 will not necessarily receive the same benefits as the spouses of heterosexual victims of the horrible terror attacks. That is unacceptable. When it comes to gay and lesbian heroes of the day -- who helped bring down the flight in Pennsylvania, who died in the line of duty when the first tower fell, and who was of the plane that crashed into the (there are many more) -- we are told the law is the law and no exceptions can be made. ENOUGH IS ENOUGH If September 11 has taught us anything, it's that our patriotism and love of country transcend our differences and unite us all. We were told that September 11 was the day that "hyphenated-Americans" were no more, and rather than being Italian-Americans, African-Americans or gay-Americans, we were now simply Americans, all of us together as one American family. It has come to my attention that same-sex partners of the victims will not necessarily receive comperable compensations as other survivors. It seems that the justification for this is that the law does not guarantee such compensation. I and many others I know of find this unsettling. If there was one lesson the events of September 11th taught us, it is that be we African-Americans, American-Indians, or gay-Americans, we are all Americans. Furthermore, in times of crisis, we stand by our fellow citizens, even if they are not yet born or if they are not full citizens under the law. Indeed, fetuses and survivors of victims who were here illegally are entitled to compensation. Therefore I see no logical reason why same-sex partners are not given the same merit. Wednesday, December 19, 2001 10:09 AM Please help December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Tuesday, March 19, 2002 8:14 AM Discrimination Policy I was just made aware of your policy to openly discriminate against the surviving partners of gay and lesbian Americans who died in the September 11, 2001 tragedy. September 11 was an attack on all Americans - now in the aftermath, you and others at your fund are using this tragedy to attack another segment of the United States by denying surviving gay and lesbian partners equal compensation from the 9-11 fund you were entrusted to manage. As I understand it, everyone except gay and lesbian surviving partners will receive money from the 9-11 fund - including those who are not even legal American Citizens. So, an illegal immigrant (one who is here by breaking the laws of our land) is more of an American and entitled to more compensation than someone who was born and raised in this country but happens to be gay. I hope God will show mercy on your twisted soul for using such a tragic event to further discrimination against gays and lesbians. You and must have been talking about ways to use this tragedy to further your own twisted agenda of hatred for gays. Tuesday, March 12, 2002 10:49 AM I was appalled to learn that funds from the September 11th fund will be divied up in such a way that diminutizes important gay and lesbian familial relationships. The inconsistencies of the policy are abhorrent. It is especially predujicial of the funds' allotment when Attorney General Ashcroft is allowing for immigration law to be compromised, but refuses to compensate life partners of gays and lesbians killed in the September 11th attacks. While these individuals gave their lives on that date, it is apparent their loved ones' pain and suffering is less than that of others who too lost loved ones. The judiciousness is an unfair estimate by accepting what was given (someone's life, someone's partner's life) but not giving anything in return. I am disappointed and angered by the unequitable standard that has been set when it comes to all individuals affected by the attacks. It is apparent that the current administration feels some lives are held in higher regard than others. It makes me saddened and ashamed to see our country's government act with such callous and unfair favor when it comes to its citizens that gave so much on that day. Why should they have a cap if the rest of us are looking at retirement now starting at age 70. b) There should be no deductions for any charity received by the victim's dependants. Friday, March 22, 2002 9:30 AM Unjustified Hello. I am very disturbed that people are being compensated monetarily for loss of life in New York. People lose their lives from terrible acts or accidents daily. It is not the role of the government to find the family of each of these people and pay them for this unfortunate circumstance. Financial compensation for deaths should occur in cases where someone is at fault or blame can be placed on an individual or group, as a deterent for others who might commit a similar act, but in this case, how can the american government or the american people be faulted for what happened? It was simply a terrible and unfortunate act. By compensating family members, we are essentially taking responsibility for the act in the same way an airline takes responsibility for faulty equipment that leads to a crash. The news is full of comments from angry family members of victims who ask how the life of their loved ones can only be worth a few hundred thousand dollars and that they should receive more. I find it sickening that they use this argument because they are trivializing the life that they are trying to place value upon. I do believe that financial support is necessary for families that have lost a major income provider, but arbitrarily giving each family a baseline amount of money is without a logical foundation and is inappropriate. Lastly, if this plan is brought to fruition, how can one define the parameters of a "family"? For example, whether we agree with gay relationships or not, I think a life partner of a victim is more entitled to the benefits from September 11th than is a family member who had not spoken to the deceased in years. There will be many family members who will benefit from this compensation that were much less emotionally connected to the victim than many gay partners of victims. I hope you realize that victim compensation is innapropriate and will encounter many circumstances where people who did not truly love a victim benefit from this and others who were emotionally bound to victims are left out. Monday, March 18, 2002 9:13 PM compensation for same-sex partners Greetings, The long-term live-in partners, whether same sex or opposite sex, of those who were killed on 9/11 should be compensated in the same way married couples are. I understand that certain federal laws are being overlooked so that illegal aliens who are spouses or children of the deceased can be compensated. I believe that the fact that our laws don't currently allow gay or lesbian couples to legally marry should also be overlooked so that remaining partners may receive the compensation to which they are ethically entitled. There has been such an outpouring of money donated to all the victims of the World Trade Center disaster, that I think there should be some to spare to aid the people who used to live in that area. Their lives have been touched by this tragedy in that they had to move out, leave their belongings, and some are still not allowed to return. These people want to go back to their homes and are not scared to do so. I think they should be commended. While I feel saddened by what happened to our wonderful nation and the peoople who lost a loved one in the WTC, I think it is completely riduculous how greedy these victims are being. Getting over one million dollars for your loved one should be plenty of money. Even if it was 100,000 dollars that is compensation enough in my eyes. Victims of crime are compensated by their attacker, that is how it should be here. Not only is the greed of these people upsetting me but also the feelings they have about suing the airlines. The airlines are not responsible, the terrorist who hijacked the planes are responsible, it really is that simple. What next, are you going to want to sue the passangers families on the planes who did not stop the plane from running into the buildings? Give me a break and grow up. I understand the pain you are in, I lost loved ones too (not in this tragety). Money will not make your pain go away. And what about all the people who lost their jobs due to layoffs and the falling economy? They no longer have an income either but they are doing what adults do and find other jobs, not complain about only getting 1.6 million.
