Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Victims compensation fund
Dear Sir/Madam: this e-mail is to request that you review your policy to deny compensation to the partners of gay victims of the Sept 11 disaster. It is abhorrant to me that you can discriminate against Americans on the basis of their sexual orientation. THis is neither right nor fair, and is contrary to the spirit of unification that this terrorist action has evoked in our country.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Victim Compensation

I do not know the amount set-aside for the 911 Victims in
New York, Pennsylvania and Washington. However, rates of
payment should be based on Current Annual Middle Individual-
Income level. Those who earned less than the National
Average would probably have not covered themselves with
life insurance or only with a low amount. Nor might they
have been working in jobs that provided employer paid
medical insurance or Worker's Compensation, pensions and
the like.
Pensions, Charity Awards and Worker’s Compensation, Life,
Medical or business or State Disability insurance, and
Social Security should "not" have to be exhausted in order
to receive the benefit from the government. Therefore, the
victims in the higher income brackets who have these things
will not appear to be penalized.
I have not seen that people cannot sue any other entity.
Many businesses in and around the World Trade Center are
gone, or reduced. Yet there is the potential for victims
or their heirs to sue. These awards should also not have to
be exhausted in order to collect the government award.
This is a payment made on behalf of the airlines, which
would otherwise be liable regardless of any other of these
compensations.
Victim Compensation should be considered a “minimal
supplement” to their Loss of Income. It is meant to help
the families meet the financial challenge of losing a
provider through death or through disability (based on a
typical insurance company schedule for disability or
dismemberment/disfigurement, and medical expenses not
covered by insurance) in their household. As long as you
are bailing out the airlines, the limit per beneficiary
should be modeled after no more than the middle individual-
income base.
However, where the victim who died is a child up to age 18,
(or college students to age 25) it would be assumed they
had not been a primary contributor to a household, yet a
compensation should be awarded. It would seem the minimum
amount (1 year income) on the schedule would still be
awarded as there are expenses with burial and some family
members may not have had paid bereavement days through
their employers. This is the case where humanity is
applied to show some value to the grief.
Those injured, yet not disabled or disfigured, should also
receive compensation for time lost at work, plus medical
expenses not covered by insurance. Example: the Middle-
Individual-Income Adjusted rate x hours missed ($14.37 x
120 hours = $1,724.40 and out-of-pocket medical expenses).
Assumption:
* 20 years old would have a projected income for 45 years
(to age 65)
 Annual National Average is somewhere near $28,000
($13.46/hr.)
 Insurance premium for medical coverage (employer paid
portion, i.e., 80%) of perhaps $.91/hour ($200 mo. x
80% /2080)
* TOTAL Adjusted First Year income: $29,889.60 ($14.37/hr.)
* .03 projected increase per year (or whatever the national
average on increases actually is):

1-year (Minimum): $ 29,889.60
5-year: $128,798.35
10-year: $312,761.17
20-year: $773,255.15
30-year: $1,392,120.55
40-year: $2,223,823.89
45-year (Maximum): $2,741,469.97
Payment for a Death would require an amount adjacent to the
number of years they would have lived before the 65-year
retirement age, but “not less” than $29,889.60 (that would
cover those past the retirement age).
If Joe and Mary Smith were each 35 years old and died in
the event, their heirs would be entitled to a total of
$2,784,240 (2 x the 30-year rate). Which, if deposited and
accrued .04 interest/year, it would provide $111,369
interest income a year on which to live, the equivalent of
each earning $55,684/year. If they follow this method of
preserving their award, the first year of annual income
will then be near twice the National Middle-Income level,
while maintaining the original award amount.
I believe this would be fair since the beneficiaries would
be signing away the right to sue the airlines for wrongful
death, malpractice, pain and suffering, unsafe conditions,
and etc.
If you do not have $12+ Billion, use the Minimum Wage
scenario because that amount is the “least any citizen
could have earned”:
Assumption:
* 20 years old would have a projected income for 45 years
(to age 65)
 Annual Minimum Wage is somewhere near $13,000 ($6.25/hr.)
 Insurance premium (employer paid) of perhaps $.91/hour
(Employee only, paid at 80% of full medical premium by
employer)
* Total first year income: $14,892
* .03 increase projected per year:

5-year: $64,175
10-year: $155,836
20-year: $385,282
30-year: $693,638
40-year: $1,108,043
45-year (Maximum): $1,365,965
In this scenario, Joe and Mary Smith’s heirs would receive
$1,387,276. Which, if deposited and accrued .04
interest/year, would provide $55,491 interest income a year
on which to live, the equivalent of each earning
$27,745.50/year. If they follow this method of preserving
their award, the annual income will then be near the
National Middle-Income level the first year while
maintaining the original award amount. It will have
allowed the beneficiaries who would otherwise not have
received Worker’s Compensation, Pensions, Charity Awards
and Life, Medical or Disability insurances, or had the
ability to sue the airlines, that extra margin of relief.

a line. I’d like to know my idea was a good one.

Victims compensation
I am attaching what I sent to the Families of September 11, and I want
you to know that this is the feeling of many of the people that I talk
to in my community.

To Whom it may concern,
I do not want to sound cold hearted, callous, or uncaring, but many of
the families involved, including your organization, sound greedy and
self-righteous. Yes, you lost your loved ones, but so do families of
soldiers in combat, police officers, firefighters, and many others. Is
it the job of the government to compensate these people also? What
about the soldier who loses his life and only has $10,000 of GI
insurance, or the police officer who is shot by a crackhead? They are
not reembursed with this extraordinary amount that you are receiving.
$1.65 million is ample, and proceeds from life insurance or worker's
compensation should be deducted from this amount. You are greedy to
want more, when there are 34 million people in this country without
health insurance, people are going hungry, people are homeless, and
children are mistreated. Who do you think you are to demand more?
Most people are afraid to write you because they may sound cruel, but
the talk in the coffee shops, barber shops, beauty parlors, and the
street, all back up what I am saying. Be thankful for what you are
getting, and do not take any more advantage of the generous American
public.

It's disgustful how greedy the victims of Sept 11 have become. I heard a lady
bithching that she would not be able to afford to continue sending her kids
to private schools. I lost my mother when I was 12 years old and no one
bailed us out. We had to adjust to our new realities which including moving
to a smaller house, changing schools and no more family trips. That is life
and sometimes its unfortunate and unfair, and realities must be affronted
regardless if they are 9/11 victims or victims of any other events. The
government has no right of using taxpayers money and making millionaires out
of victims of unforeseen events.

Dear Mr. Zwick:
I am writing in response to the Department's request for public comments
regarding the forthcoming regulations for implementing and administering the
"September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure compensation
is available to all victims of the attack, including the committed partners
and the non-biological children of gay and lesbian victims.
It is unquestionable that the devastating grief and economic losses suffered
by the families of gay and lesbian victims are no less than that of other
families. Just as the terrorists drew no lines in choosing their victims,
> our country must draw no lines in compensating those who suffered the most
personal of losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom left behind
loved ones. I urge the Department to honor these bonds by treating the

I am writing in response to the Department's request for public comments regarding the forthcoming regulations for implementing and the administering "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims.
It is unquestionable that the devastating grief and
economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom left behind loved ones. I urge the Department to honor these bonds by treating the families of gay and lesbian victims as you would any other.

The exclusion of gays and lesbians from this fund is profoundly wrong,
profoundly sad.
Our sons, our daughters, our mothers, our fathers, our lovers--all are missed
with a grief as profound as any other bereaved family. All were depended
upon to support their children or their parents, to string up Christmas
lights, to sing in church, to light the Hanukkah candles, to help us laugh at
the end of a long hard day, to cook dinners, or bring home the groceries or
even to save other lives in their work as fire or police personnel. We
needed them. It is cruel and un-American to assume otherwise. Please insist
that this country is fair in it's compassion.

9/11 fund
If what I read about partners of gays and lesbians not receiving benefits equivalent to the other families is true, then this fund will not only not receive my support, I plan to inform everyone I know. How dare you perpetuate bigotry and prejudice following such a prime example of these traits that 9/11 represents. The events on that day were perpetrated by people who are selfish and closed-minded. And it appears as though your organization is filled with the same people! How dare you! This country was founded on the freedom of choice and diversity and now your organization is spitting in the face of every American with your disregard and bias. I am so glad you did not raise my children!

It is my sincere hope, the Bush Administration and Justice Department do not
make compensation, for the victims and relatives of the 9/11 attacks, a
"political statement" or "agenda item". The "September 11 Victim
Compensation Fund" should not be used as a lightening rod for political
grand-standing.
I strongly encourage the inclusion of all human beings, affected by this
National tragedy, in any relief effort provided. Specifically, it would be
repugnant to exclude surviving loved ones of lesbian/gay family members, when
doling out remedial resources. Such exclusion would only serve to deepen the
pain felt by those survivors, adding vast insult to incomprehensible injury.
Surely, such an act of malice would be considered equally repugnant by the
current administration and those heading-up the Justice Department, whose
family-friendly focus has been much touted throughout the press.
Please, do not disappoint this active community member and long-time voter.

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

Disappointing and Disrespectful
Dear Mr. Zwick:
My name is . My father was sitting in the row of Flight
11 when it crashed into the North Tower of the WTC, and killed my best
friend who worked for . Needless to say, the loss that
I have suffered goes beyond any financial recompense.
Nonetheless, I cannot share strongly enough my grave disappointment with
compensation fund.
How is it that a family can be penalized because the caregiver went to
great lengths to insure their well-being in the case of death? My father
grew up with NOTHING. He worked tirelessly and passionately for 51 of his
58 years. His first job was at 7 y.o. selling papers on the corner. He
built a business and nurtured a family with a good work ethic and lots of
love. Due to his talents and good character, he was successful and
therefore generous to his wife and children. Now, that he is gone, my
mother is left to try and salvage her well-being and that of my brother who
has not yet even entered college. One would expect that with all the rest
that she has lost - her soulmate, husband and partner, she should not have
to lose her home and her quality of life.
Furthermore, granted that my father suffered such unimaginable trauma and
pain - watching the terrorists stab, wound and kill in front of his very
eyes -- don't you think he would doubly want for her well-being, knowing
that she goes to bed every night thinking of his excruating last moments.
The system that has been created pays no heed to the magnitude of the
individual losses suffered on September 11. But if nothing else, it is
unconscionable to penalize responsible citizens for having insurance.
Think about how you would feel if were you that was lost that day, and it
was your family, your partner, your children, who were left a painful and
uncertain future. That should be your guide as you define the standards of
the compensation fund. These are not numbers -- but people.
I would be happy to add to these thoughts at any time.

The Department of Justice received more than 11,000 e-mails in response to the agency's public solicitation for comments upon its plans to distribute the September 11th Victim Compensation Fund of 2001 established by Congress to benefit the victims of September 11 and their families. Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological
children of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal
of losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as
you would any other.
