Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Sunday, November 25, 2001 12:09 AM Comments Dear Mr Zwick, My name is , my husband was killed while at work at on September 11. Here are some comments that I have concerning this fund. Topic 1 & 2 There need to be definitive ways to determine economic and non-economic loss. Economic loss will vary according to job, age and potential. Noneconomic loss is very difficult to determine. Life is hard to put a price on. Marriage, children all increase that value since there are more people intermingled with that life. What are collateral sources of compensation? Life insurance, pension plans, 401K...should be irrelevant to these claims. These people worked hard for this money and/or paid into these things while they worked. The airlines should not get off paying out any money to the families. They were ultimately responsible for these deaths and these monies should not be included for any reason. This money was due them if they died a normal death (not one via a hijacked plane crashing into their workplace). The airlines need to take responsibility. Topic 3 If a claim is improperly filed, a person should be able to refile and their time should be reset. I also believe that a person should be able to appeal a claim if they don't believe they got their due. Topic 4 Proceedings should be held in a convenient location, possibly in each county. Office locations for assistance should also be available by county and toll free help lines would be necessary. A letter should be sent out to each family affected informing them of what needs to be done. Fees should be limited for any professionals hired by a claimant. You have implied that if state law discriminates against gay people, then so will you and the 911 Fund. The problem for gay Americans who lost loved ones on 9/11 is that most states do not legally recognize gay relationships, and the very few that do tend to do so only for state employees, not for citizens at large. And while a handful of cities do in fact recognize such relationships, under your formula, its's the state law that counts, not the city's. So in the end, pretty much everyone who died - including people who aren't American citizens and were living in the US illegally - will be honored by the 911 Fund as deserving of American's special recognition and thanks. The sole exception will be gay and lesbian Americans, because you and t he 911 Fund wouldn't want to do anything contrary to US law. On the six-month anniversary of the attacks on the World Trade Center and the Pentagon, you and the 911 Fund are telling the American people that regardless of whether a gay man was one of the four heroes on United Flight 93 who saved US Congress and the White House from utter annihilation, the 911 Fund plans to discriminate against an American hero ( ) because most of the country sanctioned such discrimination prior to September 11th. If September 11 has taught us anything, it's that our patriotism and love of country transcend our differences and unite us all. It would be ironic if the generosity of so many Americans in giving to the 911 Fund were used to further divide us as a people, and send the message to all that some American heroes are more equal than others. Monday, March 18, 2002 2:45 PM Gay and lesbian partner compensation To Whom It May Concern, It's an outrage that the 9/11 Compensation fund excludes partners of gays and lesbians. There were many gay heroes on that day, including (who helped bring down the plane in PA) and (who died in the line of duty when the first tower fell), and countless others. We shame their heroism and their memory by neglecting their spouses who, just as their straight counterparts, are left to take care of their families and grieve in the wake of this grave incident. I do not believe that my tax dollars should be drawn on to support an affluent life style but be equally and fairly split by those affected by this tragedy. Monday, March 11, 2002 12:00 PM Sept 11 compensation fund I am terribly disappointed that the compensation of victims families of Sept 11 attacks is not including partners of lesbians and gay men. Kenneth Feinberg's appearance on March 10 NBC "Meet the Press", where he stated he must follow state regulations, is just a different form of terrorism sanctioned by the US government. Gay men and women have paid the price of not being included in life, liberty and the pursuit of happiness as long as there have been people on the planet because of discrimination and homophobia. This is just awful, and I have less trust of my government each day I hear about how unfairly it treats people. Sure, the illegal aliens will be compensated, sure the common-law opposite sex partners, sure all of the folks touched by this tragedy, except lesbians and gay men.
