The relationships these people had with their departed loved ones were no less valid than the one I have with my husband of seventeen years. I'd guess a good number of them were of longer duration. And they are just as emotionally and financially devastated as I would be were I to loose my spouse. And yet, in spite of all of this, they are facing no relief, no help, because our wonderful country cannot see fit to wrap the arms of civil union around the LesBiGay community. For some reason lost to me, those in power are unable to separate the 'legal' contract of marriage from the religious rite of matrimony. There is no reason whatsover to prohibit gays and lesbians from engaging in civil marriages - to protect themselves, adopted children, property and other interests. Nothing save the intolerant, judgemental, paternalism of the religious right. The 'rite' needs to be separated from the 'right'. I implore you, in the spirit of dignity and fairness, please afford the survivors of those killed on that terrible day the same rights you would afford to me had my husband died that day. Monday, November 05, 2001 4:08 PM Comment - Compensation Payment Comment concerning a victim's compensation payment to family members of those killed as a result of the 9/11 attacks: The surviving family members of those who died as a result of the terrorist attacks on 9/11 must be compensated by the victim's compensation fund. Although the acts causing the death of innocent people on 9/11 were acts of war, war had not yet been declared. There was no advance notice to those who died to avoid certain activity that could cause death, therefore they were not contributorily negligent in any way. It was the government that was negligent in performing intelligence required to detect in advance that attacks against the United States were planned. Had proper intelligence existed, and perhaps had government agencies heeded advance warnings made by foreign governments of the danger, the attacks could possible been avoided. In addition, the INS wrongly allowed terrorists with expired visas to remain in the United States; the Justice Department failed to inform the INS of the identity of terrorists seeking entrance to the United States; the INS wrongly allowed the terrorist ringleader, Mohamed Atta, to enter the United States although his name was on a United States security blacklist. Had these United States government agencies been performing their function properly, the attacks against the United States may have been prevented. For these reasons, it is proper that the United States government compensate the surviving immediate family members, spouse and children, for the loss of those killed on 9/11 as a result of the ttacks. Although monetary compensation cannot replace a loved one, and the victims cannot be made entirely whole, compensation should be calculated in a way similar to a wrongful death action under Federal law. That compensation should include the estimated lost wages for the anticipated remaining working lifespan of the decedent. The survivors should be expected to meet daily living expenses, including health care and college from this payment as they would had the money been earned wages. The compensation should be calculated regardless of any existing insurance or retirement proceeds since that money is independent of real lost wages felt by dependents of the survivors. Compensation for other expenses such as attorney's fees, pain and suffering etc. should be allowed only if they are permitted in a federal wrongful death action. Eligibility To Make a Claim Don't parents count? According to the regulation, if my daughter-in-law, (whom I am very close to), decides to go with the Fund, I am totally excluded from receiving any monetary damages. It should be specified that other family members (parents) should also be part of the award. Their award should not be deducted from the spouses. As the law stands now, I also cannot sue or file a lawsuit against the terrorists, terrorist organization or countries that support terrorism, nor can I sue any company for negligence. I am totally excluded as if my heartache does not matter. The regulation should clearly state that surviving family members have their own, derivative claims. The regulations should also create uniform rules addressing which family members are entitled to share in an award and how they will share in the award. Again, don't I count? 2. Nature & Amount of Awards The victims should have the option of accepting the award or being able to sue on their own. They should not have to sign away their right to sue before they know what the award will be. The victims should also be allowed to sue the assets of the Terrorist funds whether they receive an award from the Fund or not. The Act could not have been intended to protect the financial interest of terrorists or terrorist organizations. Collateral benefits should not include payments from charities. The regulations should create a procedure by which there can be an administrative appeal of the award. I certainly you can help me to have a voice in this matter. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. BUT, I would not have made personal donations to private charities had I known the taxpayers were going to provide $1 million to each of the families. That sounds like very ample compensation.
