Nor did my husband who is from New York whose father is a retired firefighter from the Yonkers fire department. However, I hear that your organization, in sending out compensation for victims who did lose someone are doing two things which I find rather disturbing. One, you aren't compensating the families of victims equally. You are in fact divying up finances by how much the person made. People who had a higher income and didn't plan for their families will get more than those who did or those who made less for that matter. As someone who donated money to the cause, I would hope my money would go to all in need equally. Second, I've read that while you are covering those families who may be illegal immigrants and the unborn, which I greatly admire, you are overlooking domestic partners in the compensation package. I would hope you would review this policy as well. If I had left someone behind and hadn't been married whether by choice or by law, I do hope that this would not preclude my partner being given the same benefits as those who were married. It was not the intent of Congress or the President to preclude those who proceed with claims under the Act from also filing suits against the assets of Osama Bin Lidin, El Queda, the Taliban or any other terrorist individual, organization, or government involved with the events of September 11th. Such "frozen asset" suits should be specifically excluded from the waiver provisions under the rules implementing the Act. 2. He was a good man who cared deeply about our family. He spent the most of his adult life making sure that he provided for us in every way that he could. I am a teacher in the New York City public schools. My girls, and are 16 and 13 years of age respectively. and I worked hard to raise our children well but always with the idea that we hold a responsibility to provide for them should something happen to one of us. We worked for everything that we have. We lived within our means, contributing to our pensions, 401ks, catastrophic insurance, workers compensation insurance, social security and personal life insurance. We have suffered an incredible loss. My husband, my friend, my childrens father was taken from our lives. The Congress has established the Title IV of PL107-42, Victims Compensation, as part of the bailout of the airlines. Public opinion understands that we the victims, will be compensated with enormous sums of money from our government. Our neighbors are talking about us because we are now going to be wealthy individuals albeit without our husbands and fathers. As you well know, this is not the case. As you have established the rules, my family will receive nothing from this fund. I believe the following to be unfair. The twenty four hour rule The subtraction of collateral sources from the amount of compensation without at least a basic award regardless of these sources I also ask where within this rule was a family with a disabled child considered? Demanding that upon application the claimants right to seek further compensation from either the government or airlines with no knowledge of the amount of compensation is undemocratic. No money can replace my husband. I would have no need or desire for any compensation if my husband were here. But I would like to live out the remainder of my life knowing that I can provide completely for my children especially for my developmentally disabled daughter. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." It shows a flippant disregard for Americans, for human beings, whose loss is just as real, as heartfelt, and as palpable as any other human being's. Zwick Mr. Zwick I was amazed to learn of the way in which the 9/11 fund is discriminating against gays and lesbians. Unborn children and illegal aliens are being included without regard to the state and federal laws applicable to those groups. However, gays and lesbians will only be included to the extent applicable state laws allow. It is disheartening to discover that prejudice and hate can continue to live so strongly in a time when unity is so important. First, in the comments of , who actually blamed gays and lesbians for causing God to allow the attacks to occur in the first place. And now, in the unfair treatment of gay and lesbian citizens of this country when it comes to their participation in the fund. The enormous amount of national pride that has been generated and displayed since 9/11 is an amazing and wonderful thing. So wonderful that the American public has been willing to focus less on our country's deteriorating financial condition. A fact no doubt welcomed, and probably encouraged, by the current administration. That's smart politics. But to also use recent events as yet another vehicle for discriminating against the gay and lesbian community is unconsionable, and has much more to do with hate and intolerance than it does with politics. ALL of the deaths caused on 9/11 are tragic, and I mourn every one of them. It is heartbreaking to learn that the U.S. Government mourns those gays and lesbians who died on 9/11 less than the other victims. This submission is on a different topic and is specifically directed to your election to publish the names on this site of persons forced to accept your meager terms due to financial exigencies. For all the world to see, you now see fit to broadcast who has come begging to you in an apparent effort to get other victims to learn of their friend's plight and to get on board with you as well. In public you emphatically tell people to trust you; that you will treat them fairly. You also tell them that this is a totally anonymous process and that the specifics of the claim and their identities will be protected. You then publish their names. Why should non-joining people trust you to look out for them in bigger ways? Now that you've told the world who the claimants are every scam artist, salesman and needy relative will be lining up. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. Saturday, January 05, 2002 2:53 PM Calculation of Economic Loss Question My daughter died in the WTC bombing and I question the fairness in using the victims 1998-2000 earnings in the "Calculation of Economic Loss". In our situation my daughter graduated from college in May of 2000 and only started working full time in August of 2000. She had a non-paying internship in 1998, a summer internship in 1999 and starting working full time in August of 2000. Averaging the three years results in compensation of about $10,000 per year. By comparison, her annual salary and bonus at the time of her death was about $80,000 or about eight times the amount derived by averaging her salary for 1998-2000. I feel quite strongly that in these situations where the victim only recently joined the workforce on a full time basis only the current salary should be considered in calculating the economic loss.
