Dear Mr. Kenneth Zwick,

I write as a minister and as a member of Amnesty International, a worldwide
human rights movement committed to ensuring respect for the basic human
rights of people without discrimination, in support of equal access to
benefits under the September 11 Victims Relief Fund for all victims,
regardless of sexual orientation or marital status.  As you know, the
United States has committed to uphold international human rights standards,
including the Universal Declaration of Human Rights and the International
Covenant on Civil and Political Rights, which prohibit arbitrary
discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

one last comment

Please be kind to the children.  $50,000 each is not enough.  They have many
more years to live than the parent.
There are many who are in new marriages who are getting much more from the
victims employer whereas the ex es can only depend on charity and the fund
and to SHARE THE FUND NO LESS.
 
I think  the new and old family should file separate claims, not one per
family.  The old family is really losing to the pensions, workers comp.for
life and much more to the new spouse.
 
The new spouse is next of kin no matter how long or short the marriage and
getting a lot of checks sent being that they are the main name listed.
 
Be strong and do the deductions.
There are greedy widow(ers)  who want to hit the lottery on this.
 
Many/most  of them will never have to work again, but the ex wife of
probably more years will have to with the responsibility of the children
from 1st marriage.
 
It's not fair for those in new marriages to take "all".

September 11 Victim Compensation Fund

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

At today's Family Meeting held in Ridgewood, NJ with Special Master Kenneth 
Feinberg, it was stated that the US DOJ can and will be a participant in the 
litigation against the airlines (the $6B insurance maximum) to compensate it 
for the money paid out of this fund.  This right is clearly stated in the 
statute regarding the "right of subrogation with respect to any claim paid 
under this title".

The press has not clearly stated this and the American people think the 
money coming from this fund will be from taxpayer dollars!  Only amounts 
greater than $6B will be from taxpayer dollars and all calculations so far 
have the total much less. The American people have a right to know this 
fact.  The Final Rules should state this clearly.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

'I am outraged that gay and lesbian partners of those 
who died on September 11 are not automatically going to 
receive the same benefits as heterosexual spouses.'

I was hoping that the horror of Sept. 11 might have taught us that 
patriotism, love of country and matters of spirit  might unite us as a people 
transcending whatever other differences might exist.

So much for liberty.


I am really upset that the land of the free and the home of the brave can 
STILL discriminate against gay people because it seems to be popular. Gays 
are American Citizens and deserve every right afforded all citizens. If this 
is the land of the free lets see some action on that right now. If gay heroes 
are not as good as straight heroes, then we have some sick idea of what 
freedom is. Better we all move to Holland or Denmark where  freedom really 
rings. 
Here is a story written by      , a gay activist in Washington who happened to 
witness the burning of the pentagon.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.

very important issues.

I think it's utterly ridiculous that the American taxpayers are being
held liable for the actions of a buncha terrorists. Are we going to
start paying money to everyone who loses a loved one? My mother and
father died a while back.......What's my share of the loot?

We totally support the President's actions, in fighting these terrorist
punks. But, I and many, many, many others have a real problem with this
compensation fund concept.

I feel very sorry for those who lost loved ones. BUT, WHY DO THEY

Comment from a fiance

Dear Mr. Feinberg,

I am a fiancé of a wonderful 33 year old man who was killed while at
work at &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp .  We happily lived together as husband as wife,
however, we were not legally married and our chance to due so was taken
from us on which is now the most tragic day in history.  I only ask for
your consideration as a fiance/domestic partner and for your
consideration for all domestic partners and couples who lived together
and who's lives have been shattered at the loss of their spouses.  We
that lived together were family and the compensation fund should be
given to those that the deceased would have intended and financially
supported while they were alive.  Please consider all cases accordingly
with the realization that we fiancés soon to be married awaiting for the
day to say "until death do us part", were literally parted by death
having the chance to legally become married torn from us.  Please
acknowledge us for our future as our fiancés and partners wishes would
have been.  Please help us and protect us the way our loved ones wanted
too and for so many of us all ready were.

Many of us have spoke of you and the tremendous job you have ahead of
you with so many lives in your hands, we hope for your strength during
this difficult time for you as well as ourselves.

Comments on September 11th Victim Compensation Fund of 2001
Interim Rule, 28 CFR


I am working closely with a family that lost their father on September 11th.  
The Interim Rule still leaves significant uncertainty regarding the rules for 
the compensation fund, and the potential compensation from the fund.  As a 
result, the objective stated by the Special Master "...that claimants be able 
to enter the program - or choose not to enter the program - with an 
understanding of how their claims will be treated" has not yet been achieved. 
 Clarifying the open issues and removing the ambiguities is critical to the 
ability of claimants to make an informed decision on participation.

I have organized my comments on the Statement by the Special Master and on 
the Interim Rule by the appropriate paragraph of the Interim Rule. My 
comments are:

104.43 Determination of presumed economic loss for decedents.  It is clear 
that a formula was used to generate the presumed loss tables. However, only 
partial information on the elements of the formula has been provided.  
Further, the assumed location of domicile, and corresponding tax rates, has 
not been identified.  Also, the factors for estimating consumption have not 
been defined.  The result is that the potential claimant is left to guess at 
a presumed amount that could vary significantly from what the fund will 
calculate.  Providing explicit information on the underlying formula in an 
updated version of the presumed loss tables is key.

104.44 Determination of presumed non-economic losses for decedents. The 
Statement by the Special Master indicates that the most rational and just 
approach for non-economic losses is to base them on categories of claimants.  
He further continues "The most obvious distinction is between those who died 
and those who suffered physical injury but survived."   That distinction is 
the only one recognized by the Interim Rule.  However, there are also 
distinctions based on the circumstances of death for the decedents.  In 
particular, those trapped in the area above the floors destroyed by the plane 
in WTC Tower One and below the locked Emergency Exit doors to the roof were 
subjected to extraordinary suffering for an extended period of time (many 
even choosing to jump from the building).  These people account for a 
significant portion of the overall fatalities, and would seem to constitute a 
distinct category of decedents.  Knowing the circumstances of their suffering 
has also exacerbated the suffering of their family members.

As a further comment, the values assigned to the non-economic loss seem very 
low compared to what might reasonably be expected from a successful tort 
action with facts as in this case (e.g. the locked Exit doors).  Since the 
non-economic loss amounts are not defined by the statute, one approach might 
be to simply increase them significantly, e.g. by a factor of 2 or 3 for 
everyone.  This would have the further benefit of reducing the spread of the 
overall awards resulting from differences in income of the decedents, and 
would reduce the number of claimants receiving minimal or no awards due to 
collateral offsets.

104.47 Collateral Sources.  While the language of the statute provides a list 
of items that are to be considered offsets, the meaning of each item is not 
clear.  It would be most helpful if there were a clear statement of the 
specific items that are to be offset, and their treatment, together with a 
commitment that those items will be the only ones.  Questions on the current 
language include:
    - Pension funds.  Is this limited to employer-provided pension benefits, 
or does it include 401K funds and IRAs?  If 401K funds and IRAs are included, 
are employee contributions and the associated appreciation deducted from the 
value of the account before considering it to be an offset?  If not, aren't 
you basically offsetting the award with the amount in a savings account? 
Considering investment assets as offsets would not seem to be consistent with 
the intent of the statute.
    - Payments by federal, state, or local governmentsâ?¦  At a meeting with 
families on December 17, 2001 the Special Master said that Social Security 
Survivor Benefits and Worker's Compensation payments would not be collateral 
offsets.   Please confirm that these are not included in the definition, or 
if they are, how the present value is to be determined.  Also, are payments 
by Victim Compensation Funds included in the definition?
    - Charitable donations.  Subparagraph (b) (2) first says that charitable 
donations are not offsets, but then goes on to say that the Special Master 
may determine that they are.  Which will it be?

There have been many complaints about the inclusion of life insurance as a 
collateral source offset.  While the statute requires it to be a collateral 
source, it does not define how the offset is to be calculated.  Since these 
are funds that the family would normally receive upon the person's eventual 
death, it would be reasonable to take the decedent's life expectancy into 
account and assume that the life insurance payments would have been paid at 
that time.  The present value of the payments would then be used as the 
offset.  Premiums paid by the decedent should also be deducted from the value 
of the policy.   Adopting this approach would increase the probability that 
families will participate in the fund, while preserving the intent of the 
statute.

Taxpayers'Money

Please bear in mind that this is not money "dropping from trees," it is 
taxpayers' money.
This should not be a "gift" to the families of highly paid people.  If 
someone worked for a financial firm and their family will be receiving 
several millions in insurance, they do not need taxpayers' help. 
This should be limited to people who NEED help. I am thinking of the 
cafeteria workers, janitors, police, etc., whose families may very well be 
destitute.
AND, something that has not been mentioned anywhere....What compensation is 
paid to the families of the REAL heroes, the servicemen/women killed in 
action?
One last thought. If I am walking in Central Park and am killed by a 
lightning bold, what compensation will the government provide to my family. I 
don't mean to be sarcastic, but, do you see the precedent that is being set.
