As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Loss of loved ones is the ultimate loss, however what makes this any different than the losses suffered in the Oklahoma bombing, all the embassy bombings, military personnel, the Vietnam War, Pearl Harbor, World War II. DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I find it very disturbing that the argument by Kenneth Feinberg was that gays are "left out of my program to the extent that their own state doesn't include them." Why, then, doesn't that same argument apply to the illegal aliens, who are violating federal law? And, when did it become "his" program in the first place? What is the status of the 176 (or so) charities organized after the Sept 11 event that as national columnist Bill Moyer states have collected 100s of millions of dollars supposedly for victims relief? Will the victims get any of these charitable contributions made be millions of hard working, honest, trusting American citizens? Will these charities funds be included / accepted into the victims compensation award fund? Bill Moyer and I know some are honest, He and I also will bet their are some rotten eggs in the basket and they know the DOJ, Internal Revenue and other law enforcement agencies are so tied up with the Sept 11 event that they'll probably never be found out. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Please find below my thoughts regarding the Victims Compensation Fund as permitted under the â??commentsâ?? deadlines which have been set forth. 1. Calculation of loss should be consistent and straightforward. Â A loss is a loss regardless of its implications: i.e. the calculation of economic and non-economic losses to an offspringâ??s estate through the death of that offspring should be no different from the calculation of loss to a family person who had created different obligations. 2. Some linkages, like a grid, between categories of victims families and dollar amounts of payment may be necessary due to the planned 120 day turnaround target. But these should be created with enough fine differentiations to enable frequent close matches to circumstances without need for special hearings. Supporting documentation should be fairly simply to submit. 3. However, a hearing/comment opportunity should be provided for those extraordinary situations which you cannot predict today. You can generate new streamlining rules for these as the learning process moves forward. 4. An individual's foresight in providing his estate with private life insurance or the estate's good fortune in receiving a charitable grant should be outside the considerations for the fund's payout amounts. Wednesday, January 16, 2002 11:06 AM Compensation Commets Dear Sir: The men and women who died in the WTC were for the most part private citizens arriving early to work. Because they took there jobs so seriously they were at there desks. Many of them were young with small children. It is my understanding that you are not only reducing there benefit by life insurance but also by social security. How unfair. There spouses and children will only receive these payments for a limited time. It was my understanding that social security was to help the survivors get through troubled times until they reach a certain age. This should not reduce any award. As too, pensions specifically 401 K funds. The young have been encouraged to put away for there retirement. Very few today can live on Social Security alone. Are you penalizing them for saving for the future? And as to placing caps on either lost earnings or on the award itself, why did they pick the WTC? It was the heart of capitalism. For these victims to get to these positions they had to work long and hard hours. I feel the these caps should be raised and each family deserves something.
