In fact, the statute under which you labor - Public Law 107-42-states, in relevant part, that a person is eligible for the compensation under the law if two conditions are met: that the person "(i) was present at the World Trade Center..." and"(ii) suffered physical harm or death as a result of such an air crash." To begin with, Congress wrote that is wishes to compensate any person that was present at the WTC and suffered physical harm. It would appear that your inclusion of a 24-hour medical treatment requirement limits the wish of Congress. The Executive Power can not limit the will of the people as expressed by Congress; it should only execute it. You saluted this law as "unprecedented expression of compassion on the part of the American people to the victims and their families..." It seems cruel and unamerican to exclude from this expression of compassion many victims just because it took them more than 24 hours to receive medical treatment. In fact, you admit that September 11 victims were "devastated by the horror and tragedy of September 11." To some of the victims, living and reliving this horror(not only the first day but days, weeks and months), disoriented them and made them live recurrent nightmares and flashbacks disabling them from any activity. Others were so scared that did not dare go out of their homes. Still others, to this day can not take a subway or go out of their homes without their loved ones. In other cases, victims were feeling so bad from the injuries to their bodies and respiratory systems that simply could not get out of their homes. Many were disoriented for a long time. In many cases, the victims had children to take care of, who were terribly frightened and emotionally affected. They had no real choice. They had to live with their pain while they took care of the children. In other cases it took time for the victims to organize themselves and find care for their children so that they could go to get medical treatment. Finally, your introduction to the interim final rule acknowledges receiving comments from many organizations. Notably, you do not mention any medical, scientific or psychiatric organization. The rules should be made on medical and scientific basis. Medical, scientific and psychiatric associations are in agreement that (1) "physical harm" can not be defined by the period in which treatment is sought for the injury, (2) physical injuries exist whether the victim seeks medical treatment or not, and (3) a victim may have physical harm and not even know it, at least for a long time. Conversely, there is no medical, scientific or psychiatric evidence that correlates the severity or existence of "physical harm" with the period in which medical treatment for it is provided. Each human being is different. Your own Department of Justice has doctors, social workers and psychologists advising the victims: These professional will tell you-and have done so already- that the victims with physical harm are as likely to have retreated onto themselves for days and weeks so that they were unable to go get medical treatment within 24 hours. The federal Center for Diseases Control-as well as the Surgeon within which the victim sought medical treatment. Prestigious groups as those mentioned, together with the American Medical Association and the American Psychiatric Association as well as professors and researchers should also be consulted: they will tell you that the 24-hour medical treatment rule is not medically or scientifically based. Over 100 WTC victims and their families integrate the Hispanic Victims' Self-Help Group. The "medical treatment with 24 hours" requirement imposed by the rule will exclude from the benefits provided by the law more than 50% of the victims with medically proven physical harm. As you say, your office is "required, of course, to adhere to the language which Congress set out in the statute." The statute provides for compensation to victims who suffered physical harm in the World Trade Center - and other specified places- on September 11 as a result of the air crashes. Your office is not make a rule limiting the language and purpose of Congress's compassionate pronouncement. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I attach my 17 page CV to this letter reflecting my significant experience, certifications, peer review and formal education in both disciplines. These speak most directly to expected earnings and pecuniary loss from the vocational perspective. Moreover, we are willing to meet in a group meeting setting with you and your experts along with the current Presidents of the American Board of Vocational Experts (ABVE) and the American Board of Rehabilitation Economics Association (AREA). Much of the debate thus far has been focused on issues of lost household services (HHS), and work life expectancy. While senior members of the National Association of Forensic Economics have focused heavily on these issues in relation to the VCF in both the print and television media, these are relatively minor issues compared to expected earnings. It should nonetheless be stated that the male hourly data emanating form the "Dollar Value of a Day" study is inconsistent with eight previous HHS time use studies. These figures appear plaintiff oriented in our experience. In the case of HHS, the great majority of the decedents logically were full time workers rather than home makers. They otherwise would not have been at work at the Pentagon or WTC when the tragic events of September 11 took place. Consequently, the ways the rules read these victims' families are not entitled to this element of pecuniary loss. It is almost a moot issue. Secondly, the total differences among the three primary work life expectancy tables are minor in the case of males. These include the 1986 BLS study, the 1996 Hunt, Pickersgill & Rutemiller Study, and the two studies by James Ciecka published in the 90s. Conversely, in the case of females, use of the aged BLS studies (1980 data) reflect a significant difference form the three more recent studies delineated above. Using the BLS studies in the case of female decedents' would thus be inequitable as they do not reflect positive changes over the last 20 years. It was our understanding that the VCF had recently decided to use the most recent 1998 study by Ciecka as a result of this forensic economic input. Nonetheless, both and are suggesting as of today that this in fact has not been accomplished and the inappropriate BLS (in the case of females) is still being advertised by the VCF. Most importantly and irrespective of the preceding, the earnings issue brought up in the New York Times article, " The Damaged Spirit of the 9/11 Fund," by Fred Price and Mitch Kleinman dated January 16, 2002 suggests with great face validity that many of the WTC victims were young professionals in their 20s and 30s. In these cases, the decedent's demonstrated earnings may not accurately reflect their long term expected earnings even with robust age earnings adjustments. Vocational issues to be addressed in this context are the individual specific human capital factors of formal education and work experience in addition to the potential for further career advancement. While we understand that the VCF has provided for a generous age earnings wage growth factor, especially in the case of these younger workers, it still may not capture the earnings potential of the young professional decedents given the following assumptions: 1) these decedents were among the brightest and best educated Americans; 2) they were working for Fortune 500 companies in early career; and 3) their human capital educational expenditures were not nearly fully realized and would not have been until at least mid career when significant promotional opportunities would have arisen. Vocationally, without additional formal education in most cases, one's earning are unlike to increase beyond the age earning cycle and/or standard wage growth after the age of 35 or 40. There is methodology that can assist the VCF in determining expected earnings. Specifically, the input of a vocational expert or vocational economist can help establish one's promotability based on age, education, and work experience. Wage rate data from Economic Research Institute (ERI) can then peg the expected earnings based on occupational and experience should these differ form the actual earnings as depicted in previous W-2 statements. Perhaps a particular age cut off period could be implemented wherein those under the age of 35 would be entitled to an independent vocational assessment of expected earnings (earning capacity). ERI is a Redmond, WA. based research company that provides executive compensation and salary wage data. It is primarily an instrument used by human resource professionals. An increasing number of vocational experts and forensic economists are utilizing this statistically validated wage data. It covers most occupations in cities exceeding populations of 50,000. are currently completing a closely related paper for a special Spring 2002 employment law edition of the Journal of Legal Economics in addition to presenting this paper at the 76th annual meeting of the Western Economics Association this summer at Seattle. would also be pleased to discuss this proposed methodology with the VCF, and any other interested parties at your convenience. Many members of the professional vocational community certified by ABVE and/or AREA have extended reliable offers to us to perform pro bono work on behalf of the VCF. These commitments have transpired just in the laws two days following our spreading the news of the dire need for vocational appraisals in many of these cases your office has been charged to evaluate for pecuniary damages. "[Gays and lesbians are] left out of my program to the extent that their own state doesn't include them. I cannot get into a position in this program, which has a one-and-a-half or two-year life start second-guessing what the state of New York or the Commonwealth of Massachusetts or the state of Virginia or New Jersey, how they treat same-sex partners, domestic live-ins, etc. I simply say this: What does your state law say about who is eligible? If your state law makes you eligible, I will honor state law. If it doesn't, I go with the state. Otherwise, Tim, I would find myself getting sued in every state by people claiming that I'm not following how the state distributes money. I can't get into that local battle. I've got to rely on state law." - Kenneth Feinberg on NBC's "Meet the Press," March 10, 2002. While I appreciate Mr. Feinberg's legal and political situation, the argument doesn't really hold up. He also said "The attorney general, in consultation with Immigration, etc., undocumented aliens who come forward, the families will not suffer any consequences. They are covered by this program. They will get a check. The employer, where we need the economic information about the undocumented alien, will not be penalized," I have a hard time believing that all states have laws which allow compensation to illegal immigrants, while those same laws would not apply to domestic partnerships and same-sex relationships. Also, overlooking local law in favor of state laws means that those who should be eligible for benefits will be denied because of political wrangling. The fallout from the Sept. 11 attacks has produced unique situations for all people affected, and we all must respond to the situation in a fair, open and generous manner. Your proposed resolution to the families of the loved ones lost in this tragedy concerns me greatly. I strongly believe that an attempt to have an individual waive their legal rights constitutes denial of due process. Our great country is all about freedom and the fundamental right of due process. It is more disturbing that this waiver of rights is being offered when the people entitled to relief do not know what they are entitled to. While it may be difficult to have a uniform plan for a recovery, looking at only the last three years income is patently unfair. Such a plan fails to consider the wage expectancy of a younger individual had they been able to keep working. Thirdly, the scope of dependency is too narrow. I urge you to consider a broader scope of dependency by including those family members who were dependent on the ones we lost at the time of the tragedy. As I read the internet headlines of the rulings as to how to give compensation to the families, I was was overwhelmed and angry at the information that the families are demanding more. Billions given by the American Public and as well by people and government all over the world. I believe that ample donations have been received from various sources to compensate those affected. If our government is responsible for every accident and every loss of life, then every person should be afforded the same consideration when an accidental death or injury occurs. The loss of a child, husband, wife, father or mother, sister or brother is just as catastrophic to those who sustain this loss due to reasons other than the WTC catastrophe is just as real and devastating to those as it is to those who lost loved ones in the 9-11 disaster. Friday, December 28, 2001 1:53 PM Comments I think that the idea of Congress benefiting this one group of unfortunates at taxpayer expense is discriminatory and an unlawful distribution of taxpayer money. I am not without compassion for the victims of Sept. 11. My daughter was in the North tower when it was struck, but was fortunate to escape with minor injury. Had she been killed I would not have expected a federal handout, nor would I have accepted one on her behalf. The September 11th victims have no more right to taxpayer relief than a person hit by a meteorite or a person run down by a penniless drunk. If Congress were to provide for all unfortunates on an equitable basis I would strongly support such largesse. But to discriminate on behalf of so small a group of constituents is without merit and mere political expediency.
