I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Thursday, March 21, 2002 4:30 AM Comment on Final Rules Dear Mr. Zwick: I did not suffer any personal loss on 9/11 but I am one of the people whose money is being disbursed by your fund and therefore I have a strong interest in how you are planning to compensate survivors. It is so sad to see a horrific event which united all Americans in their sorrow and in their generosity, become politicized with regard to who qualifies for compensation. I am speaking of what appears to be the exclusion of homosexual partners. How sad that we are making distinctions about which people matter on the basis of carefully worded qualifications which make it appear that only under certain circumstances will these relationships be given the status they deserve. I know that homosexual partners suffered the same loss both emotionally and financially that I would have suffered if my husband had been a victim. I contributed a lot of money to all the funds. I contributed till it really hurt. Had I known that such distinctions and political considerations would be applied I would not have made contributions to any fund that planned to exclude homosexual partners. It is heartbreaking to me to see how this is all coming down. Your good intentions no longer impress me when your final rules are in some cases discriminatory and judgmental and meant to please those who harbor bias that is little to do with the issue of loss and all to do with their own personal idea of morality. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. A deadline in which a person or family can be considered a "victim" must be set. At which time the donations should be divided evenly to those people. I feel all other compensation the victim is entitled to should NOT be reduced. It is also my FIRM belief, none of the monies received from the American people should be used for administration costs. The horrible treatment of the women is Afganistan is so obvious now but how come the lack of equal protection for gay people in this country isn't even noticed. Althought they still have the same bills to pay and felt the same horrific pain from losing your loved one but for some reason it just doesn't matter ? Monday, March 18, 2002 4:29 PM I as an American gay person am outraged that gay and lesbian partners of those who died on September 11 are not automatically going to receive the same benefits as heterosexual spouses, I have personal friends that lost partners. The government wants us to fight for it's freedom which we do without question but when we die for our country or in incidents like Sept 11 we are outcast. Monday, January 14, 2002 10:45 AM (no subject) In response to Special Master Kenneth Feinberg: My son, &nbsp&nbsp&nbsp&nbsp , a New York City Firefighter, perished in the World Trade Center. My son was 29 years of age, single with no children and earned approximately $50,000 per year. According to the guidelines in the "Presumed Economic and Non-Economic Loss Tables" on the USDOJ website his life would be worth approximately $816,000 minus "collateral payment". He had a $200,000 life insurance policy and as a fireman who dies in the line of duty that sum is augmented by an additional $50,000 to his beneficiaries. My wife and I are the next of kin, however, my son named his two brothers and sister as beneficiaries of his life insurance. We were recipients of a federal death benefit of $250,000 and as next of kin we are eligible to collect his pension of $2,025 per month. My wife is 57 years old and I am 60 years old. When this legislation was enacted and Congress bailed out the airlines, The City of New York, and the lease holder on the World Trade Center building, the intent of this law was that this fund would replace the rights of the families to sue those entities. Now the Special Master has stated that the collateral payments must be deducted off of any settlement. At the time this bill was passed into law the number of casualties was thought to be over 10,000. Since that time we have learned that because of the efforts of the over 400 firefighters, policemen and rescue workers who perished in the World Trade Center over 25,000 lives were saved in the greatest rescue ever achieved, bringing the death toll to around 3,000. These people perished because of a terrorist attack on The United States. To Mr. Feinberg I pose the question, "how much would my son's life be worth to him if he helped save his life or the life of one of his loved ones"! I urge you to please follow the will of Congress who's intent was not to further desecrate the memories of those who gave all in this first battle by a foreign power on our beloved shores. Sunday, January 13, 2002 12:19 AM ELEGIBILITY FOR FIANCES FOR COMPENSATION To whom it may concern: I need to bring to your attention a very REAL situation that is being IGNORED or DISMISSED: Fiances of the victims. Speaking as a Fiance, it is a horrific feeling to be totally unaccounted for in this whole 9-11 tragedy and it almost seems like my 8-year relationship with my fiance ( 4 of them living together sharing a home) didn't exist!?!?!? Despite not having the piece of paper that says we were married under state laws, our union was VERY REAL and I AM a victim. My 6 yr. old son and I are BOTH undergoing therapy to help us cope with our suffering - the SAME loss as that of a widow's, which I absolutely consider myself to be. Situations such as mine NEED to be recognized and compensation needs to be addressed FAIRLY: taking into consideration the lives of those that died under the times that we live in NOW. The truth of the matter is that people nowadays don't get married right away and more often than not, end up living together long before marrying. Does this mean that they do not share their lives with one another? Does this mean they do not consult with one another as husband and wife? Does this mean they are not responsible for one another? Does this mean they do not share each others' expenses and support each other? Does this mean they are not committed??? A piece of paper DOES NOT marry people, people 'marry' which means they COMMIT to each and in that sense, we WE MARRIED EACH OTHER! THE POINT: I DO NOT mean to take money away from his mother, the "next of kin," but merely want to be INCLUDED in this along with her. She may have raised him, BUT I SHARED HIS LIFE !!!!!!!!!!!!!!!! Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
