Victim's Compensation
Hello. Members of the gay and lesbian community were also effected by the tragedy. Many lost loved ones such as life-partners and parents. These people need to be compensated for there losses as well, for it would make for another tragedy if not. Thank you for listening and I truly hope these remarks are heard.

Interim Final Rule
I have been keeping up with the comments submitted here and it seems that the majority fall into 3 categories:
(a) "form letters" lobbying for the inclusion of the gay/lesbian domestic partner as 'eligible'
(b) family members of a deceased victim who want MORE, MORE, MORE!
(c) the 'non-recipient taxpayer' - who find the amounts too high and the greed inexcusable
As far as (a), I say "go with state law". If gay/lesbian partnerships are treated the SAME as marriages by their state, then they should be here too. As should "common law" marriages. But "treated the SAME" should be all-encompassing - the state supports your right to participate in the "benefits" of recognition of your partnership, but also defines the restrictions/responsibilities on ending the relationship. If the state does not have any laws addressing terminating the partnership (divorce, child custody, probate, etc.), then it is NOT THE SAME as 'regular marriages', and those partnerships should not be recognized here either.
As far as (b), based on their behavior I would not give family members of a deceased victim anything. They have forfeited there 'right' to our compassion by being so unwilling to accept it graciously, respectfully, and QUIETLY. I keep hearing/reading statements of how 'we will be forced to sue' because the offered compensation is so limited. This is nothing more than a blatant threat (extortion?)- give me more or I'll sue everybody. Cut them off and let them go to court. Use the taxpayers money ONLY for the living - those victims who survived, but were injured (as defined in this rule). If you ABSOLUTELY INSIST on providing compensation to the 'family members of a deceased victim', I think you should go through all of your calculations, come up with one total, put it a pot, and then let them all fight over how to split it amongst themselves - ANY WAY THEY WANT TO!
As far as (c), obviously I agree! I do not like the precedent being set. I don't think it will be followed through on. I think Congress acted impulsively when enacting this. It was only 2 weeks after the event - too soon to be making such dramatic gestures. The whole country was still a little irrational/panicky about where things were headed and the number-of-victims-estimates were still inflated by over 100%. Now that things have settled down a bit and everyone, including Congress, has had some time to digest the event, perhaps you should go back to them and ask 'Do you really think this is a good idea?'. I hope they would respond 'No'.

Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.
Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

The unfair reality of the Victims Compensation Fund
I lost my husband on 9/11. I have three children ages 4 and 2 and one
born one month after the attack. His company is only giving
health care benefits until April of this year. How can I afford health care
when the fund is deducting life insurance, pensions (which I do not have) and
charitable donations as well as placing an economic cap on the salaries
earned? How can I manage when I will walk away with a little over a years
salary? I do not and will never have the earning potential my dear husband
had not to mention that I was a stay at home mother. Please I implore you to
revise the rules to not include life insurance which we paid for and
sacrificed to have. I feel as though we have already paid the ultimate
sacrifice...a lifetime without my husband, a daughter who never met her
father and two children who will only have vague memories. Haven't we been
robbed and raped enough? Please do what is right and just for our children
in the name of our loved ones.

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

9/11 fund must be fair to gays and lesbians
Dear fund mangers,
I¹ve just been informed that you are not treating all people equally in
disbursing your fund. You should treat gays and lesbians the same as other
people. It seems that this would be a no brainer given what the terrorists
stand for but it seems that you with your exclusion of gays and lesbians and
non acceptance of their family and partners you are buying into the thought
pattern of the terrorists, that of thinking ³we are right and ?you¹ are
not². I am appaled that this kind of thought might even exist, let alone be
acted on.
I am outraged that you would not consider the family and partners of gays
and lesbians. Many gave their lives in this struggle and one may have saved
us from some other horrible disaster in DC on the flight that crashed in
Penn. I don¹t understand why you can¹t accept these people as they are.
Please think before you act in this reckless manner. Your exclusion of gays
and lesbians will be a moral crisis in the making.

Both my parents were on flight #11. I have heard that the victim compensation fund will subtract from any payments the amount of life insurance that the victim's family had from any payment the fund would make. I think this is highly discriminating. The victim's who worked hard, paid taxes, and chose to spend their hard earned money on life insurance should not have their heirs get a reduced benefit for their forward planning.

a) We believe there should be no age cap on the earnings potential of
the victims of this terrible tragedy. Why should they have a cap if the rest
of us are looking at retirement now starting at age 70.
b) There should be no deductions for any charity received by the
victim's dependants. They are ENTITLED to their share REGARDLESS of any gifts
they may have received.
c) Life insurance was PAID for by the Victim and should not have any
bearing on what the family has a right to.
d) The right to appeal should not be denied to those who are suffering
due to the tragic losses inflicted on them by this horrific event.

Please be advised that I represent         (now age 18) and        (age 14),
the children of        , a passenger on United Airlines Flight 93 from Newark, New
Jersey to San Francisco, California on September 11, 2001.
I am         Uncle, attorney, and friend of        , so it is with a heavy
heart that I write you this letter regarding the legal issues surrounding         claims
with regard to the Fund.
        and         are sons of         from a previous marriage.         was remarried
at the time of his death. In January of 2001,        ,         youngest child, began to live
with his father and stepmother. Mr.         was         sole supporter while paying child support
for        , his oldest son.
As a result of the tragedy on September 11, 2001,         moved back with his mother and
brother. It is my understanding that         died intestate. According to Pennsylvania law,
the estate of a decedent dying intestate passes to the spouse and children equally.
I understand the Fund will only accept one claim from a "personal" representative. I have the
following concerns regarding my nephew's circumstances:
(1) In the event either the spouse or the children have not decided whether to file suit against
United, et al, or file a claim with the Fund, is either the spouse or the children allowed to proceed
with filing a claim with the Fund prior to the other filing? It is my understanding that the Fund's
rules and regulations do not address this issue. I understand that there is to be one claim and that
the claim will be considered a complete claim upon all parties eligible for filing to do so with the
personal representative. This could delay any compensation to either the children or the spouse
depending on when they agree to file collectively;
(2) In the event either party decides to file suit and then the other party files a claim with the
fund, is the party filing the suit allowed to withdrawal their Complaint against United, et al., and
file a claim with the fund as long as the filing of the claims is within the statutory provisions of
the fund? If so, will that delay the determination and compensation of the party who filed the
claim with the Fund first?
(3) If possible, please address the following scenario: If the children file a claim with the
Fund tomorrow and the spouse does not, will this withhold the children's compensation
determination, and ultimately the children's compensation because the stepmother has not joined
in the filing of the claim? If so, then as the Fund is written, eligible claimants in a non-traditional
family setting who file claims will be unfairly and unnecessarily delayed in receiving their
compensation.
As I am sure you are well aware, these issues do not only concern my nephews but many
children of non-traditional families who lost a parent on September 11th. I look forward to your
response and any changes that will address these issues for children of non-traditional families.

1. The interim rule fails to make provision for possible
conflict arising out of disparate interests of various survivors of
a deceased victim, where one survivor does not wish to accept the
benefit offered by the Fund but intends to sue but another survivor
desires to accept the benefit and does not intend to sue, where
both survivors would qualify as "heirs" under state law.
2. The interim rule fails to make clear whether the Fund
award is divisible between multiple survivors and whether, if it is
divisible, how the division is to be made and whether one
survivor's claim would preclude another survivor's determination
not to claim but to sue (see comment 1).
3. The interim rule fails to make clear whether the Fund
award is the property of the decedent and accessible by creditors
of the decedent or whether the Fund award is the property of the
survivors and therefore immune to claims of creditors of the
decedent.

Help the victims
It is with a disappointed and heavy heart that I write this letter to you.
I am a good friend of the family; and their husband and father, was a good friend to me, my
best friend, for the 18 years that I knew him. He worked hard all his life
to obtain his goals and finally had those goals in sight when terrorist took
his life on September 11, 2001. He was in his office, at his desk, doing
his job as a bond trader and the terrorist that killed him attacked him
because he was the very strength of America: its economy. was the
type of person that the terrorist wanted to kill, someone who made the
American economy move.
left behind a loving wife and two young children that will only know
him through the stories of family and friends. His wife's pain is and
suffering are a heavy burden to bear, and I know this because I have watched
her bear it for the past four months.
worked hard because he wanted to take care of his wife and family, he
wanted his children to grow up in a comfortable home, go to college and
become as successful as he was becoming. I am proud of the manner in which
my friend cared for his family, but I am not proud of the way in which my
government chooses to support the victims of the undeclared war against our
country. The logic of the Special Master is flawed and does not justly
compensate the victims. How does he arrive at the conclusion that
non-economic damages (i.e. pain & suffering) are equal to $250,000 for the
decedent and $50,000 for each surviving person when juries award larger sums
to people that break a hip tripping on a sidewalk? The pain and suffering
of the victim's families are unprecedented from the attack on September
11th, the monies chosen by the Special Master to compensate the victim's
families for this pain and suffering are unremarkable.
Equally unprecedented is his decision to use collateral offsets, such as
pension and life insurance to diminish the compensation for potential loss
of earnings. Life insurance is earned by paying premiums and should have no
effect on the compensation given by the victims compensation fund.
Finally, the calculation of the compensation for potential loss of earnings
makes no sense. How does he arbitrarily exclude earnings for 2001? Earning
for 2001 should not be excluded, they should be prorated so that they are
representative of a full year, not nine months. How does the Special Master
decide to put an arbitrarily cap on the earnings of people that worked in
the financial industry so that it becomes equal to those that did not? This
appears to be an attempt to make all things equal in a situation where they
clearly are not.
Americans have shown that we support the victims of September 11th. We have
donated to charities that represent them, we wear flag pins on our lapels to
show our solidarity, and we stood behind the President's decision to use
military action against the terrorist and those who support them. Our
government now has the opportunity to show them that we care once more.
Instead we ask hem the victims' families to give up their right to a fair
civil trial and offer them little in return. I have seen family
suffer enough because of what our enemies have done; I don't want to see
them suffer because of what my government fails to do. The children of
September 11th will grow up knowing that their parents died national heroes,
please don't let them grow up knowing that their government treated them
like something less.

inequities in compensation formula
I am writing on behalf of parents of a World Trade Center victim who are being grossly shortchanged on both the economic and the non-economic parts of the Victims Compensation Fund, as well as other aspects of the regulations.
- Basing compensation on the last three years of a victim's salary is unfair in that it does not take in to account the potential for a young person (and this victim was young) to earn a good deal more over time as his work experience accumulates and he achieves graduate degrees beyond the college education he had.
- The non-economic award is also grossly unfair because we know the victim suffered tremendous pain for a very long time. He was last seen on the Floor, Tower Two, going back to do work, and called his mother at home saying that he was okay and had to
work. We know the victim was trapped for a long time, and Special Master Feinburg still insists that the pain and suffering award is fair, when what he wants
to give is one-tenth the amount under similar circumstances of terrorist attacks.
- It is also unfair that the fund categorizes "dependents" as only spouse and children. The victim was his parents' only son and according to Asian tradition responsible for his parents even though he did not claim them as dependents on his tax return.
As with many immigrant families, he lived with and supported his retired parents and was their primary caregiver and constant companion. Besides dealing with their grief
and struggling to survive every day without him, his parents are faced with a system which does not recognize them.
- In addition, there should be no collateral payment deductions of any kind from the award. That would make the fund highly unfair.
- Also, it is absolutely wrong that the victims family must sign away their rights upon filing as
claimants when they do not know what their award will be. There should be a fair hearing of each victims family, because individual circumstances are different.
The victim was a true American who deserves much better than what the Fund is offering.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars
per year might receive thousands of times as much compensation as the survivors of a dishwasher in
one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent
worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It
would be a double blow to the survivors to first lose their loved one and then watch as most of the
taxpayer money went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Comment aboutthe Interim Final Rule
I believe everyone working as hard as they can since the September 11th
tragedy should be commended. I think President Bush is doing the best job he
can right now and the best job he knows how to do, despite what he has
already been through in attaining the position he now holds. Believe me, I
would not want his job for anything in the world.
HOWEVER, what I do want and what I want the United States Government to know,
realize, and understand is that there a lot more people suffering in this
country than those who are the actual victims or related to those who became
victims of this tragedy. Due to the severity of the situation and the
already crumbling economy, this country almost came to a screeching halt,
economically speaking, in the days and weeks following this event. I live in
a mid sized city (about 38,000 people) on the Wisconsin side of the WI/IL
border. This community has been know to many of the residents living here
for any length of time as a welfare town. About half of the residents living
in this community live at or below the poverty level. I have lived there,
and I know how difficult it can be on a good day. However in the 2 years
prior to the attacks in New York, we have lost most of the major businesses
in this city to bankruptcies and business decisions to move, that we almost
have nothing going for this town if one is out of a job and needing one.
There are, of course, the minimum wage jobs, and only a select number of
those, but one cannot support himself, much less and dependents on what that
brings home. That, and once one has earned above a certain wage, no one
paying that low will hire that person for fear of him leaving if he were
offered another position for more money. I have more than once been told I
was over qualified because of how much I have made in the past. Since the
attacks, companies all around this area and around the country are downsizing
due to lack of work and to try to save capital expenses, which leaves those
workers to try to find something else in our already impoverished country.
Not only are the wages no longer there, but neither are the insurance
premiums, which all families need, and some more than others. If one has the
opportunity to be a stay-at-home parents, then they do not even qualify for
Medicare. (I would be glad to discuss this with someone of they would care
to get in touch with me.) So now, not only are there direct victims of this
tragedy, which they all obviously are in need during this time of crisis, but
so are the rest of the country, whose taxes are going to be raised to help
support the funds needed to help those more obviously in need than
themselves.
Good luck to the President and may God give him the wisdom to make the right
choices. Good luck for the rest of the government branches, and may God give
them the wisdom to work together with everyone to come up with a way to
wisely see us all through this together.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th,
including the children and families of low-wage workers and gay and lesbian families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the
restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all
those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double
blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those
who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of
marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove
that their union is legitimate. Fortunately both the Red Cross and the State of New York have already
announced that they will not discriminate against gay and lesbian families. The Department of Justice should
do the same.
