Friday, January 18, 2002 10:35 AM VICTIM'S COMPENSATION FUND My sister (38 years old) was a victim of the WTC tragedy. Under the current plan my mother would receive nothing from the fund. My sister was at the higher income level and was single (lived with someone for 18 yrs). According to the tables, my sister was not worth much. The table does not take into accound future salaries until retirement (they say each victim would have spent most of their salaries). My sister did not have any expenses since she lived with a man who paid all the bills, therefore she could have saved all her earnings. My sister has also been descriminated against for not having children, although had she lived she may have had children. Another concern is that my sister's insurance beneficiary was not her mother (who is the legal "next of kin"). How can insurance be subtracted? There should at least be a non-economic (pain and suffering) payment to all the families without any deductions. I can't believe a human life is only worth $250,000, especially when they were murdered! DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a diswasher in one of the restaraunts destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayers money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian famillies are especially vulerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunaely, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Monday, February 04, 2002 3:24 PM Victim Compensation Fund Comments Although the deadline for comments may have passed, I feel compelled to write my thoughts on how this fund has been set up. My husband, was in the South Tower on the floor attending a meeting. This was not where his office was located. He worked in Stamford, Connecticut. He was 59 years old, a dedicated husband, father and employee. We were married for 38 years and were high school sweethearts. He raised three wonderful, productive sons all of whom are serving society. He was looking forward to retiring having worked since he was 15 years old. Since he traveled so much on business, he took out extensive life insurance. He wanted to be sure that if anything happened to him, I would be taken care of. HE DID NOT PAY FOR INSURANCE OUT OF HIS PAY TO INDEMNIFY THE AIRLINES! I am not a young woman. While I do not have dependent children, my options for building a future life are limited. How do I start to rebuild a life when I have been with my husband since I was 15 years old? What is this worth in pain and suffering? Why should any monies I have received have anything to do with the amount of compensation I would be entitled to receive from the Federal Government? Both my husband and I have more than contributed to our society. Now, in addition to having suffered this horrendous loss, we will be penalized for being the pillars of society. We have been the tax payers from whom you got and are getting the money to finance this fund. We are the planners, the savers and the providers of future generations. Wednesday, January 30, 2002 9:37 AM I am completely disheartened by the Government program to reimburse survivors of the September ll attack. I live on a small Social Security pension and although I cannot afford to give any money to anyone, I did feel it necessary to give a donation to the survivors. Apparently the enormous amounts of money collectd, much of it from people like me with very little income, was not enough to satisfy these greedy people. The ones with the most money are the loudest in their complaints. No other victims of tragic loss have ever been compensated by the Government and the poor people who lost jobs and the people of other tragedies have been forgotten. The new wife only 5 years. With her deductions and 4 people pulling from the balance my children will receive $150,000? something similar. Also, since I was dependent on ex. husband for child support, I would file a claim against also. They have no relationship or contact with step mom and step mom is lowering the figure bec. of all her benefits such as workers comp, pension etc. I think you need to impart exceptions because my three children will surely lose. Don't forget that some of widows(ers) are newly married picking up a large sum of money for a short relationship. It's the young children who have many years to live. Please be kind and generous. I still think it needs to be individualized. You have to do the deductions otherwise the people that receive large amounts from employer and then from the fund does not make for a fair game plan. Sunday, March 31, 2002 4:07 PM Please rethink Allocation of 911 Victim Compensation Greetings, My name is , a resident of Louisville, KY and a lesbian. As with every other American, the events of 911 have been very damaging, not only to my spirit, but also to the conscious that I have for what "justice" will mean after such a horrific event. Part of this justice needs to come in the form of compensating those gay and lesbian partners of victims from the 911 terrorist attacks. I think it is absolutely dishonoring to the fabric of our country to not acknowledge and bring just compensation to the partners of individuals whose lives were lost. Despite what the misinformation might be about gay and lesbian couples the truth is that MANY of us have long-term and committed relationships that have enabled us to live in a joint relationship of interdependence. With this interdependence comes a trust that each partner will do his or her part in supporting the relationship emotionally and financially. When one of these partners dies, the repercussions, not only emotionally, but financially can be quite a burden. One that no one should have to suffer if there are means to lessen that burden. The United States has those means and responsibility to make this situation right and compensate the partners of those who lost their life-time partners in these three horrific attacks. Sent: Thursday, January 24, 2002 8:22 PM Subject: Victim's Compensation Fund Attachment 1: The airline bailout act gave the airlines $15 billion in cash and loan guarantees and capped the airlines' liability for the September 11 crashes at the limits of their insurance coverage. Because of this cap, the damage caused by the crashes greatly exceeds the private fund available to compensate victims and their families. Thus for the vast majority of victims and families, the cap has the effect of eliminating the right that they would otherwise have to sue the airlines. Congress set up the fund to ensure that the airline bailout would not come at the expense of the victims' families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. DOJ has ignored this mandate and instead has written arbitrary regulations that will result in compensation levels far below the losses actual suffered by the victims and their families. In fact, many families' total compensation from the fund and all collateral sources combined will not even fully replace lost income. In effect, these families will not receive any of the non-economic compensation required by the statute. After collateral sources are deducted, as required by the statute, some families would receive nothing from the fund under the interim final regulations. DOJ's formula allows for non-economic awards at only one-tenth the level paid incomparable cases, even though Congress explicitly enumerated a broader range of non-economic damages than could be recovered in any single jurisdiction. DOJ's formula for non-economic damages is $250,000 for the person killed and $50,000 for the spouse and each dependent. In a wide variety of air crash and terrorism cases, however, judges, juries, and mediators commonly have provided non-economic damage awards well into the seven-figure range. Independent economists have found serious flaws in DOJ's method of calculating economic damages, including use of outdated and inapplicable work life and life-cycle earnings data. DOJ greatly underestimates promotions and other increases in earnings for victims. It relies on civil service and military retirement system actuarial data that track federal worker incomes and pension requirements, not the higher-paying private sector career paths followed by the vast majority of the victims. The interim final regulations also arbitrarily cap a victim's income at $231,000 a year. Combined with the faulty methodology described above, the income cap would result in some families receiving compensation for less than 25% of their actual economic losses. Under DOJ's rules, a family's award may be increased above the "presumptive" award only by a showing of "extraordinary circumstances" -- beyond those suffered by other victims or victims' families. This high burden of proof makes a charade of the right to a hearing provided by the statute. DOJ should fulfill the act's intent by revising the rules to compensate victims and their families for the types of damages specified by Congress, at levels comparable to those provided in the tort system the fund was designed to replace. While DOJ has shown flexibility on some aspects of the rules, it is resisting the victims' and families' requests for significant changes. If the proposed regulations are not changed significantly, victims' widows will have to sell their homes, deplete their children's college funds, and give up their plans of being full-time parents while their children are young. Many families, anticipating little relief from the fund, will decide to sue the airlines and others, despite the handicap of the liability limits.
