As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. Sunday, December 23, 2001 3:51 PM VICTIMS COMPENSATION FUND In reading the provisions of the Victins Compensation Fund, I find that Life Insurance on the insured may be considered a Collateral Source which would offset compensation. I noticed that comments were made regarding the fact that premiums may have been paid by the victims for such insurance, and the fairness to include such benefits in the offset process. Certain Life Insurance policies include Cash Values, which reduce the risk portion of the coverage. Since other assets are not being considered as Collateral Sources, it seems unfair to include the Cash Value of such Life Insurance policies. Another question would be the ownership of the Life Insurance. It is quite common for a policy to be purchased by a person other than the insured, and such Life Insurance would not be considered as part of the insured's estate for tax purposes. Would such Life Insurance be excluded from the Collateral Sources, as well?. While I understand the objective of the Fund, I am concerned about certain details which may not have been arranged with the complications mentioned above. I hope these can be explored as soon as possible, and I will appreciate your comments. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Saturday, January 19, 2002 10:45 AM Federal Victims Compenstaion Program The proposed Federal Victims Compensation Program (FVCP) is a disgrace. Is this the way our country wants to pay back it's heroes. My husband was a firefighter lost at the WTC. By the time you deduct pension, life insurance and charitable donations I will be granted $0 by the FVCP. Why should we be penalized because my husband sacrificed to make sure he provided for his family in the event of his death. did you ever take into account the high premiums my husband had paid over decades to provide us with insurance. Did you ever consider the fact that firefighters are paid paltry wages. Like many other firefighters my husband worked 2 to 3 jobs to make ends meet. If you think a firefighter widow can get by on our pension you are sorely mistaken. Correct a wrong. Take care of the people who have sacrificed for the good of this country.
