I am outraged that gay and lesbian partners of those who died on September 11 are not automatically going to receive the same benefits as heterosexual spouses. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Saturday, January 19, 2002 5:42 PM Dear Mr.Anthony Weiner I lost my sister and brother-in-law and on Flight 77 which was crashed into the Pentagon, they were on there way to Kauai, Hawaii with my father's remains to be buried next to my mother, my father's remains were also lost. I am writing to express my serious concerns and objections to the Department of Justice's (DOJ) "Interim Final Regulations Governing Payments Under the September 11th Victim Compensation Fund." The airline bailout act gave the airlines $15 billion in cash and loan guarantees and capped the airlines' liability for the September 11 crashes at the limits of their insurance coverage. Because of this cap, the damage caused by the crashes greatly exceeds the private fund available to compensate victims and their families. Thus for the vast majority of victims and families, the cap has the effect of eliminating the right that they would otherwise have to sue the airlines. Congress set up the fund to ensure that the airline bailout would not come at the expense of the victims' families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. DOJ has ignored this mandate and instead has written arbitrary regulations that will result in compensation levels far below the losses actual suffered by the victims and their families. In fact, many families' total compensation from the fund and all collateral sources combined will not even fully replace lost income. In effect, these families will not receive any of the non-economic compensation required by the statute. After collateral sources are deducted, as required by the statute, some families would receive nothing from the fund under the interim final regulations. DOJ's formula allows for non-economic awards at only one-tenth the level paid in comparable cases, even though Congress explicitly enumerated a broader range of non-economic damages than could be recovered in any single jurisdiction. DOJ's formula for non-economic damages is $250,000 for the person killed and $50,000 for the spouse and each dependent. In a wide variety of air crash and terrorism cases, however, judges, juries, and mediators commonly have provided non-economic damage awards well into the seven-figure range. Independent economists have found serious flaws in DOJ's method of calculating economic damages, including use of outdated and inapplicable worklife and life-cycle earnings data. DOJ greatly underestimates promotions and other increases in earnings for victims. It relies on civil service and military retirement system actuarial data that track federal worker incomes and pension requirements, not the higher-paying private sector career paths followed by the vast majority of the victims. The interim final regulations also arbitrarily cap a victim's income at $231,000 a year. Combined with the faulty methodology described above, the income cap would result in some families receiving compensation for less than 25% of their actual economic losses. Under DOJ's rules, a family's award may be increased above the "presumptive" award only by a showing of "extraordinary circumstances" -- beyond those suffered by other victims or victims' families. This high burden of proof makes a charade of the right to a hearing provided by the statute. DOJ should fulfill the act's intent by revising the rules to compensate victims and their families for the types of damages specified by Congress, at levels comparable to those provided in the tort system the fund was designed to replace. While DOJ has shown flexibility on some aspects of the rules, it is resisting the victims' and families' requests for significant changes. If the proposed regulations are not changed significantly, victims' widows will have to sell their homes, deplete their children's college funds, and give up their plans of being full-time parents while their children are young. Many families, anticipating little relief from the fund, will decide to sue the airlines and others, despite the handicap of the liability limits. We do not believe these are the outcomes Congress intended. Please contact Attorney General John D. Ashcroft and Special Master Kenneth R. Feinberg and tell them of your concern that the interim final regulations fail to conform to the language and intent of the act. With the regulations soon to become final, I believe that only the swift and strong support of Congress can avert unnecessary financial and emotional damage. People all over the country cope all of the time with the loss of the breadwinner in their families and with insufficient life insurance. If families planned well, and they have life insurance coming if they have lost a loved one their need may be less than those who didn't plan ahead. Does that mean they don't deserve to receive some of the money that other Americans have given through the goodness of their hearts? Of course not, and I don't think any of us who have donated believe that. But the money wasn't meant to make anyone wealthy. The money can never compensate for the loss of a loved one. If someone was injured they may need more money than the families who lost a loved one. Children should not have to worry about paying for their education when they've lost a parent in this tragedy. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I write too as an educator. I am a straight woman of color; and I teach college English courses. In my classes we discuss the various histories of oppression that have been suffered in different and similar ways by people of color, poor people, women, and gays and lesbians in the U.S., and look at the ways in which people have used literature to combat and / or critique those histories. I hope that I will be able to discuss with my students the important strides for gay rights made now - you have an opportunity that will make history, so sad of late, take a turn for the better. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Enclosed is a recap of my understanding of the 'Victims Compensation' Legislation as well as my comments and questions that arise from that legislation. Sincerely, The September 11th Victims Compensation Fund PL107-42 (2001) A victim or his estate may seek no-fault compensation from the program or may bring a tort action against an airline or any other party, but may not do both. To be eligible to recover, a claimant will have to waive his right to sue anyone for damages caused by the terrorist attacks, except to recover collateral source obligations Amount of Recovery Determined by the Special Master based on: (i) the extent of the harm to the claimant, including any economic and non-economic losses (ii) the amount of compensation to which the claimant is entitled based on the harm to the claimant, the facts of the claim, and the individual circumstances of the claimant. The Special Master shall reduce the amount of compensation .. . by the amount of the collateral source compensation the claimant has received or is entitled to receive .. Collateral source compensation, as noted above, includes life insurance, pension funds, death benefit programs and payments by Federal, State, or local governments related to the terrorist-related aircraft crashes of September 11, 2001. Several questions arise from this legislation: 1) Who has standing to file a claim? Either the victim, someone injured by the aircraft related events of 9/11/01 Or In the case of a deceased victim, the personal representative on behalf of the estate. The legislation specifically prohibits family members and others from filing a claim under this legislation on their own behalf. This narrow construction of who has standing to file a claim under this legislation has two effects: 1) to require the waiver of all rights to sue anybody on the part of the person filing the claim 2) at the same time specifically failing to extend this same prohibition to others, presumably family members, to bring a tort action against the airlines or any other defendant to recover losses as a result of 9/11. If we accept that Congress clearly intended to specifically limit claimants rights as well as standing under this statute then I would suggest that Congress also intended to equally narrowly construct what constitutes Collateral source compensation as it applies to recovery. Thus any Life Insurance, Pension or other compensation payable upon death to a named beneficiary OTHER THAN THE ESTATE should not be considered as collateral source compensation as these are not, in the language of the act compensation the claimant (e.g. the Estate) has received or is entitled to receive. This line of reasoning carries even more weight when considering payments from charitable organizations. Again in the case of a decedent claimant it would seem clear that these payments do not qualify for consideration of award reduction as they are not, in the language of the act compensation the claimant (e.g. the Estate) has received or is entitled to receive. The question then becomes In the case of a decedent claimant, what should be included in collateral source compensation? Should a 401(k) POD to the Estate be included? Should a 401(k) POD to a named party other than the Estate be included? Should a Life Insurance Policy covering the decedent and payable to the Estate be included? Should a Life Insurance Policy covering the decedent and payable to a named beneficiary other than the estate be included? Should a Life Insurance Policy covering a third party, which is owned by the decedent and the decedent is the named beneficiary, and the third party dies after the decedent and unrelated to 9/11 events, be included? Finally there remains much confusion about the provision in the law that the determination of the Special Master shall be final and not subject to judicial review. Was it congressional intent to prohibit the appeal of the amount of an award granted by the Special Master? Or was it the intent of Congress to prohibit all judicial review even in the case of procedural error, malfeasance and fraud? Will the Federal Courts uphold the constitutionality of a Congressional provision that bars all judical review? Wouldn't this provision effectively abridge the rights of a citizen to due process? Can a claimant seek judicial review of a determination by the Special Master where the claimant can reasonable assert that the Special Master failed to follow the established procedure and as a result brought harm to the claimant? - - - - - - - - - - - Some additional comments: I attended an 'information session' hosted by the law firm of on November 16th, in Woodbridge, New Jersey. This 'event' was apparently put together with the assistance of several widows of Cantor Fitzgerald employees/victims. Essentially the event was a shameless 'infomerical' for participating in 'the Fund' and endorsing the position of Trial Lawyers Care (TLC). I do not support the positions contained in the letter drafted by these widows (in conjunction with ) and sent to you as comments under the signature of "Families of September 11th Victims". I also take issue with some of the positions / issues that were offered during this event, including: 1) One of the widows responding to a question from the audience indicating that " . . . DOJ was only interested in hearing comments from victims families (not the general public) because we have the power to shape these regulations . . ." 2) The attorney who spoke for who suggested this legislation allows for compensation of victims spouses and other family members for 'pain and suffering'. I believe the language of this bill is quite clear and that Congress did NOT intend to include compensation for 'pain and suffering' for anyone other than the actual victim. 3) The attorney who spoke for describing NJ State Law that currently does not allow for a spouse to recover 'pain and suffering' on their own behalf in a wrongful death case. This attorney went on to suggest that the audience should support the efforts of in January 2002 to lobby the NJ State Legislature to change the provisions of NJ's Wrongful Death Statutes to allow for spousal compensation for 'pain and suffering'. The clear implication was that such a change would benefit Sept. 11 victims spouses should they decide to file a civil action. However, I am under the impression that our Constitution prohibts Ex-Post Facto legislation and that any such change in the statue would have no impact on litigation arising from the September 11th tragedy. We are citizens too. Partners of those GLBT who were killed that tragic day deserve EQUAL treatment alongside fetuses and illegal alliens. Anything less is discrimination and bigotry.
