We live in a multi-faceted nation where not everyone fits neatly in the a Judo-Christian model. Many of those who died had established loving relationships without the benefit of marriage. The partners of these people have suffered as grave a lose as those who formalized their love in a marriage ceremony. To now deny financial support to these grieving people would be immoral. I do not have to agree with someone's lifestyle to understand that their love is held just as dear as mine. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Such discrimination is un-American. If September 11 has taught us anything, it's that our patriotism and love of country transcend our differences and unite us all. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. To Whom it May Concern: I am a survivor of the tragic attack on the World Trade Towers on September 11th and have just been made aware of the unfair exclusion of same-sex partners of compensation for their losses. This is the saddest and most embarrassing issue that has come out of this tragic event. Especially when you consider the first victim of these attacks was &nbsp (Death Certificate &nbsp ) who was a gay man. The rest of the country recognizes &nbsp , a gay man, as a hero for sacrificing his life to fight the terrorist on the airliner that crashed in Pennsylvania. Just last week I saw an interview with his mother who appeared on national television to say how proud she was of her son, no matter his sexual orientation. Your department must take another look at how insensitive and completely homophobic your decision appears to the world. We are living in the twenty-first century. Join the rest of the nation and recognize human beings as individuals without prejudice. When I was on the World Trade Center Plaza and saw the tragic results of the first attack I thought I had seen the worst sight of my life; people leaping to their deaths to escape the fire. I never imagined I would be standing under an explosion and a ball of fire that left flying debris, body parts and fire all around me when the South Tower was hit. I ran for my life. My only thought was to return to the comfort of my apartment and to the one I love; my boyfriend of seven years. Had it not been for his continued support, financial and otherwise, I could not have achieved the status of a bank officer for an international bank in only five years. As an artist it was difficult for him to support two people on his income but he did because he believed in me. Friday, December 21, 2001 1:43 PM Comment on Interim Rule December 21, 2001 Special Master Kenneth Feinberg U.S. Department of Justice Main Building, Room 3140 950 Pennsylvania Avenue NW Washington, DC 20530 Comment on the Interim Final Rule of the September 11th Victim Compensation Fund The interim rules issued by the Special Master appear to violate the law passed by Congress in setting up the September 11th Victim Compensation Fund. Specifically Section 405(b)(1)(B)(i) of the Act, requires the Special Master to determine the "extent" of both of the economic and non-economic harm suffered by the claimant. The rules of statutory interpretation indicate that in determining the congressional intent, the language of the statute should be construed according to its ordinary meaning. The ordinary meaning of the word "extent," as given by Webster's Collegiate Dictionary, is "the range over which something extends to its fullest length." By its very terms, capping consideration of the economic loss suffered at the 98th percentile of individual income is not considering the full range of the economic loss of those who earned more than this sum. Second by establishing a single uniform amount of compensation for non-economic harm, the Special Master has again violated Section 405(b)(1)(B)(i) by failing to consider the "extent" of non-economic loss. Congress specifically instructed the Special Master in Section 405(b)(1)(B)(ii) to award compensation based on "the harm to the claimant, the facts of the claim and the individual circumstances of the claimant." Presuming a single uniform amount of compensation for non-economic loss does not fulfill Congresses mandate to consider the "individual circumstances of the claimant." Moreover the Special Master's proposed process for considering "extraordinary circumstances," falls short of the Congressional language of "individual circumstances." Nothing in the Act indicates that victims should be required to demonstrate that their individual losses are extraordinary. The Special Master, Mr. Feinberg, has said publicly in this regard that "I cannot make those distinctions, I will not make those distinctions." Yet the law clearly requires him to make such distinctions. If Mr. Feinberg publicly refuses to follow the explicit instructions of the law, then perhaps Mr. Feinberg should find other employment. Finally, the Special Master's determination that the total non-economic harm suffered by a child whose parent was murdered on September 11th is to be valued at $50,000 is nothing more than a sick joke upon these children. There is nothing in the Act that requires the Special Master to play a tight fisted Scrooge to these victims. Quite the contrary, Congress's gift of $15,000,000,000 to airline stockholders contained in the Act, demonstrates the generous mood which animated Congress when passing this law. A generosity that is obviously lost upon Mr. Feinberg who values the lost love and guidance of a parent to be worth a mere pittance. Bah Humbug to you Mr. Feinberg. A Merry Christmas indeed! The September 11th Victim Compensation Fund of 2001 has been hijacked by the Justice Department for its own ends while preparing to give perhaps half of the intended recipients of the fund no money at all. I do not know if one of the hidden objectives is to simply discourage participation in the Fund, especially by those who would be the most costly to the Fund. How else can one explain the enormous number of material objections to the Final Interim Regulations which at every turn pick and choose the lowest possible entitlement and the lowest possible payout. This can't be explained by sheer incompetence alone, for just by chance the plan would have missed some ways of making a reduction or left a reasonable award alone, but no, each and every opportunity has been seized! In order to carry out this fraud the victims of the act have to be neutralized -- hence the Victims and the Heroes 9/11 are being slandered in a disinformation campaign authored by Mr. Feinberg. I bring up a case in point : In an unsigned editorial of the 10th of February, the Chicago Tribune published a PR piece that might as well have come straight from the desk of Kenneth Feinberg. He claims to be appalled by the cry of greed on the part of the uninformed public, while still repeating the deceptive "$1.65 million average award" figure, this time not even adding the fine print "before deductions." The article states that some of us [ the victims] have said that this is not enough, but what I hear is that many say that the $1.65 million figure is meaningless. A significant number of families will get zero ("$0") under the final interim rules. From a show of hands it appears that about half of the families in one meeting which I have attended, expect to receive nothing from the Fund, myself included. Are we wrong to complain? The headline of the piece is "Putting a price on a life" but the reader has to wait for the closing punch line for the answer that "There is no dollar value of a human life" but $250,000 is the best we can come up with. We are told to believe it makes no sense to look at the history of "tort" law where slip and fall injuries routinely run past that figure, major surgical procedures and rehabilitation can exceed this and today the cost of raising and educating one child through college exceeds $300,000. The government's position is like saying the value of a Van Gogh masterpiece is a little less than the cost of the canvas, turpentine and oil paint used to produce it. The article alleges that " that Congress clearly intended the fund as a safety net for those who did not have substantial life insurance or other assets" but I can not find any language in the law or implementing instructions that corroborates this assertion; the law does state, however, that its purpose is "to provide compensation to any individual ... who was physically injured or killed" This is not a welfare program. In fact, if the intent of the law were to narrow the gap between the have and have nots, this peculiar implementation by the Special Master exacerbates the gap by artificially capping all non-economic losses which include the extraordinary pain and suffering of being incinerated alive, to the cost of painting supplies, if you will. We are reminded that "[o]f course, no one is forcing the families to take the money and forfeit the right to sue" but, the Special Master spends 15 minuets of his presentation telling us that the government has stacked the deck by capping the liability of the airlines and giving itself the option of being first to recoup from the airlines insurance any payments made from the Victims' Fund. Under the present final interim rules, the government payout is estimated to be as low as $2 billion after deductions and that the entire sum could be recovered from the airlines insurance. So much for the Special Master's "generosity argument." Perhaps most disappointing is the way the Special Master promotes his pillaging of the victims in these airy PR pieces distorting the truth. He considers his job as "10 percent lawyer, 40 percent rabbi, 50 percent shrink." Friday, December 21, 2001 9:33 AM Victim's of War I may not be understanding correctly when reading the article by &nbsp&nbsp&nbsp&nbsp in the Associated Press titled 'Victim's Fund Met with Mixed Response' but if I am understanding correctly, I'm very disappointed with how we have turned out, as Americans. The first sentence says it all. "NEW YORK (AP) - The government announced an aid program that would give families of victims of the terrorist attacks an average of $1.65 million - a plan that some families say doesn't go far enough." Were the 9-11 victims not victims of war? Why do people think that they "deserve" more that what is being offered. I don't get it. Why does it always boil down to money. For God's sake, these people lost their lives and we will never see them again. What does that have to do with money. Suffering, grieving, pain, depression, all of that is a very important and normal part of loosing someone that we love. Never in a million life times will anyone be able to pay enough to make that pain go away. "What we are going to get out of it? Who is going to support me now? Who is going to take care of my kids?" These questions all sound like they are the American self centered greed. I have a suggestion, how about your families. Can't they help take care of the loved ones of their lost loved one? I'm not saying that we shouldn't help but AMERICA stepped up to the plate to help these people and we donated a lot of money. OUR MONEY to help support these people in their time of trouble and to help make their suffering a little easier. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airlines industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died.
