An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. It has become a way for ANYONE RELATED to those who died to be compensated. I do not find the US gov't nor the airlines responsible for a "planned attack." What we did for the 9/11 victims was to try to show them our support in this unprecedented event. Monday, January 21, 2002 6:07 PM Federal Victims Compensation Program Obviously, changes must be made to the Federal Victims Compensation Program so that the families of the 911 heroes are properly compensated by the government. The complete and total amount allocated by Congress must be given to the families. Anything less is a complete and total disgrace. It's is obvious to all sane people that the victims families have beyond any shadow of a doubt the right to sue many of the parties involved with the 911 disaster. (see paragraphs below). And, furthermore, never in the history of the U.S. has a person with a legitimate cause to sue been told that they cannot receive compensation because they have other means such as life insurance and pension funds I know that you cannot name one single case like this in the history of the U.S. If you apply these rules to the victims' families, not only is it a disgrace, but then the exact same rules must apply to all plaintiffs in the future. Do I have to spell it out -- if you do not change the rules and give the money to the victims' families, then every single individual and corporation with a legitimate case who also has "means" must not ever receive a "red cent" from any ligiation in the future. Listed here are the parties that should be sued because of the 911 disaster. Here's the first one. Can the government explain how in the world the governor of Massachusettes had the audicity to appoint his former chauffer to head security at Logan Airport in Boston? When I heard this on TV, I began to fell like I was living in the "twilight zone." It's it obvous to Congress that the governor must be fired and put behind bars as he has the blood of the victims on his hands. How dare he appoint his former chauffer to head security at Logan when the chauffer had "zippo" experience. Certainly there can be no doubt that Logan Airport and the governor should be sued. They are guilty. Secondly, the airlines and the FAA have proved that they don't have a clue as to how to run airports. The fact that the cockpit doors were not locked it a sin. I expected to hear that top executives at the FAA and airlines were fired immediately the day of the disaster. I am appalled that this has not been the case. Certainly, unless every cent allocated by Congress is given to the victims' families, they have an extremly strong case against both of these parties. Thirdly, where was security at the WTC on 911? I was watching TV with my co-workers and we saw the first WTC Tower in flames. Immediately, everyone said this must be terrorism. Why weren't people evacuated immediatley. Was security too stupid that it had to be spelled out for them with the second plane going into the other WTC Tower. Obviously, this building should have had one of the most up-to-date evacuation plans; however, it appears obvious that it had no plan whatsoever!!! Here's my last point. My cousin, a fireman, died at the 911 disaster. How do you think I felt and his family felt when we read in the newspapers and heard on TV that the fireman's radios were not working. Do you realize that the rescue workers were ordered out of the WTC Towers? However, the firemens' radios weren't working. Certainly, the City of NY should not try to cut expenses by providing substandard radios to its rescue workers. The City of NY is another party that quite frankly deserves to be sued. Again, you must give the victims' families the money that they are entitled to. Friends and families of the 911 heroes are a united and growing group who fully intend to stay united and fight for what is the right and proper conduct by government. Government officials work for the people. Don't forget that. If you do, we won't forget on election day. Also, I'd like to know what the government is doing about awarding the Congressional Medal of Honor to the 911 Heros. There was much talk about this award in September, what is happending? Why haven't we heard more about it? Certainly the Award would help explain to the children who lost their parents what heroes their parents were. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Tuesday, March 19, 2002 5:29 PM Comments on fund distribution To whom it may concern - In recent interviews, the head of the September 11 Victim Compensation Fund has made clear that the partners of gay and lesbian heroes of September 11 will not necessarily receive the same benefits as the spouses of heterosexual victims of the horrible terror attacks. Even fetuses and illegal aliens will be receiving benefits under this problem, they've even promised to overlook federal law and NOT arrest and kick out the families of illegal aliens, nor will they punish American companies that hired illegals in violation of federal labor laws. This is ridiculous, even without the following discrimination facts. But when it comes to gay and lesbian heroes of the day - who helped bring down the flight in Pennsylvania, who died in the line of duty when the first tower fell, and who was of the plane that crashed into the (there are many more) - we are told the law is the law and no exceptions can be made. If September 11 has taught us anything, it's that our patriotism and love of country transcend our differences and unite us all. We were told that September 11 was the day that "hyphenated-Americans" were no more, and rather than being Italian-Americans, African-Americans or gay-Americans, we were now simply Americans, all of us together as one American family. Apparently, that family just got a divorce. The hyphens seem not to matter when our government wants to use our heroism to inspire others, but when it comes time to actually aid the families of those heroes, the hyphens come back with a vengeance, and it seems that some American heroes are now more equal than others. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I've learned that people that were in a same sex relationship and die in the 9/11 terrorist attacks are not being consider to receive the help they deserve. Zwick, Director Office of Management Programs U.S. Department of Justice I am writing today to ask you to stop the discrimination being done to the gay and lesbian people by our government. In the aftermath of the September 11 terrorist attacks, the U.S. Justice Department established the "September 11 Victim Compensation Fund." The purpose of this fund is to provide assistance to persons who were injured as a result of the attacks and to compensate the relatives of those who were killed. The U.S. Department of Justice wants to know how the funds should be administered and distributed. I strongly encourage you to let them know to listen to all the voices of the people who were affected by the loss of their loved ones. Whether, that voice is straight or someone of an alternative lifestyle. These voices still need to be heard. I would like to remind the U.S. Justice Department officials that justice is only served only when all families be straight or not, who were impacted by September 11 are treated with equality, justice and respect and compensated for the loss of their loved one. Once again I ask the Justice Department to include among relatives eligible for compensation those who lost their life partners as well as defacto parents or children, without regard to sexual orientation or marital status. A great example for you all to follow is already set forth by New York Governor Pataki who is granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day-to-day activities and the emotional bonds of family deserve this help in this time of need." Wednesday, March 13, 2002 9:10 PM providing funds failure Dear Mr. Feinberg, I am dismayed and angered that you and the Sept. 11 Fund are excluding gays and lesbians who might otherwise be eligible from receiving funds if they lost a loved one in the attacks. It's amazing to me that you include a variety of people -- including illegal aliens, who violate US Federal law by being here illegally, will be eligible to receive money from the Fund. Yet you refuse to allow funds for gay and lesbian victims of Sept. 11--people who are citizens and who contribute to our country in numerous positive ways. You state that this is due to State laws, yet, as stated before, you're willing to make funds available to illegal aliens, who are violating Federal laws. This is simply a matter of discrimination against citizens of our country. I urge you to change your policy, and make funds available to those lesbians and gay men who are eligible for funds. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. And our access to justice and equality in the aftermath of the September 11 crisis must be no less. I am writing today to ask you to invest a few minutes in the cause of justice and equality. In the aftermath of the September 11 terrorist attacks, the U.S. Justice Department established the "September 11 Victim Compensation Fund." The purpose of this fund is to provide assistance to persons who were injured as a result of the attacks and to compensate the relatives of those who were killed. I want to remind you, the U.S. Justice Department that justice is only served when all families -- and ALL TYPES OF FAMILIES -- impacted by September 11 are treated with equality. From the brave young gay man who lost his life on the plane attempting to save the lives of innocent people... to the gay priest who lost his life while ministering at Ground Zero... to the many lesbian and gay and transgendered employees working in the World Trade Center... it is vitally important that we demand that our government treat all of our families with dignity and respect and equality. We ask the Justice Department to include among relatives eligible for compensation those who lost their life partners as well as de facto parents or children, without regard to sexual orientation or marital status. We ask the U.S. Government to follow the example already set by New York Governor Pataki in granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day-to-day activities and the emotional bonds of family deserves help in this time of need."
