Thank you, Attachment 1: Dear Mr. Feinberg, This letter is to convey to you my concerns over the current format of the Victim Compensation Fund I lost my husband and my two young girls lost their father on September 11th at the World Trade Center. While I am grateful for our governments immediate response to this horrific event, upon closer scrutiny I am troubled by the current rules of the compensation proposal. Essentially, certain aspects of this proposal cause one to wonder if this proposal was created to truly compensate victims or to protect the airline industry. The conflict between these two very divergent goals is causing the families of victims considerable anguish in addition to the enormous grief which has taken up residence in every minute of our lives. This is because of the appearance that the government is trying to buy off families such as mine without giving fair and equitable compensation that respects our birthright as Americans to exercise our lawful prerogative to pursue our tremendous grievance in a court of law. For example, the funds compensation offset for life insurance, pensions, and government benefits is patently unfair. It is perhaps the main element in this fund that appears to illustrate how this fund was created to protect the liability of the airline industry rather than to genuinely compensate the victims of this national tragedy. I especially object to the reduction of compensation for life insurance or pensions. To suggest that families of victims should be penalized because their lost loved one exercised wise planning and financial responsibly is profoundly unjust. In bold stark terms, the purpose of the fund is to compensate people who are victims of a tragedy that has its origins in the failure of both private industry (the airlines and their private security firms) and various agencies of our federal government to protect us from terrorist treats that could well have been predicted and avoided. What you are proposing is that we accept your compensation package in replacement of the normal lawful method of compensation by filing a civil suit in a court of law. But the current proposal doesnt equitably replace one form of compensation with another. In reality, this proposal, which is designed with the interests of the airline industry in mind, proposes to the families of victims an option that denies us the right under law to reasonable compensation and punishes the heirs of my husband and many others who made financial and insurance decisions wisely, thoughtfully, and responsibly to protect their families. Therefore, I respectfully request that the offset provisions in the legislation be eliminated which are inequitable and unfairly penalize some families and not others. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. My family is spending countless hours trying to help the widow and her children pull her life together.just after the event I told my friend that the outpouring of financial support seem to promise that at least that part would be taken care of . Now, two months later, the financial worries persist. Why? Because all the charitable foundations are not sending the money to the people the donors intended. Further , the government is considering limiting the assistance given the victims. Claims Dear Mr Zwick I am writing in regard to what appears to be a wonderful offer set up by the government to help the victims of September 11th. First let me tell you something about the life that was lost to me and to my two little boys on that day, that being the life of my husband &nbsp&nbsp&nbsp&nbsp , whom I had been with since I was 14 years old. As I'm 39 now, I feel to say' a life time' would be appropriate. He was a good and kind man. A wonderful husband, a fun and caring dad, an excellent money broker and most importantly, the love of my life. In loosing &nbsp&nbsp&nbsp&nbsp my life and that of our two sons, &nbsp&nbsp&nbsp&nbsp and &nbsp&nbsp&nbsp&nbsp will never be the same again. I feel a need to write that as so many people fail to realize it. So whats my point. My family has suffered more than most people will every suffer in a life time and we do need help in many ways to be able to start to pick up the pieces of our lives and with our bread winners gone, our financial needs are unfortunately the most worrying. The amounts that will be paid out to myself and other families needs to be fairly implemented. I feel that the amount should be based on a life times salary and most important the amount should with out a doubt be made known to myself and the families before we are asked to sign away any writes. If the intention of the government to is to be just, then there should be no problem with an amount being offered prior to a waver form. Tuesday, January 22, 2002 6:38 PM comments on interim rule Dear Mr. Feinberg - I lost my brother, &nbsp&nbsp&nbsp&nbsp , in the WTC attacks. I am urgently requesting you to reconsider that portion of the fund distribution plan which deducts collateral sources such as life insurance and pension/social security benefits from the amount awarded. My preference is for a straight amount for each person lost - regardless of age, sex, number of children, or other sources of income - this fairly compensates each for the true value of their loss - the person not the paycheck. My sister in law will be raising two small children without a father for the rest of their lives. To deduct for life insurance, pension, and other benefits my brother worked for is to doubly punish them for my brother's prudence. The purpose of the plan was to prevent lawsuits against the airline industry and others (the city of Boston, New York, the airports, the security companies, etc.) if the amount under the settlement is too low, there will be no incentive to settle and lawsuits will be the inevitable result. Wednesday, December 19, 2001 9:18 AM Please allow equal access to funds December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Since then nothing has gotten me more infuriated than hearing that gay partners will not be receiving the same benefits as heterosexual partners. How can we overlook the fact we are providing for everyone else besides homosexual individuals? i understand that victims of tragedy are not always entitled to compensation for their losses. this fund was created out of the generosity of many individuals in this country. homosexuals are also a part of this country. why should they be discriminated against. Dear Mr. Zwick: I am writing in response to the Department's request for public comments regarding the forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund." I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Many Americans lost their lives on September 11, each of whom left behind loved ones. I urge the Department to honor these bonds by treating the families of gay and lesbian victims as you would any other.
