Bush in particular--for piling tradedy on tragedy by failing to honor and respect ALL the victims of Sept. 11. I would like to believe that lesbian and gay Americans are full citizens of this country, but apparently not so in this case. The rhetoric of 'whatever the law is in your state will apply' is a ridiculous cop-out and a pitiful attempt to shift any blame for such a policy from the governing bodies directly involved to the State of the victim. Many gay and lesbian firefighters, police officers, rescue workers, pilots, and citizens showed their courage and patriotism on and as a result of Sept. 11. Some died in doing so. Where is my government's courage now in fighting for their rights?! The many gay and lesbian victims, heroes, and their families and loved ones are no less affected by this tragedy than their heterosexual counterparts. To call ourselves the UNITED States is blasphemy in this case: apparently we are only "united" when it is convenient. Tuesday, February 05, 2002 11:35 AM Comments Good morning Director Zwick ! I believe it is obvious that the hearts of most Americans, have been deeply touched by the Terrorist attack of 9-11. It is apparent that ten's of thousands of American's have given to numerous funds, in support of those that have been touched personally by this tragedy. It does grieve my Heart thought, to see the discord that has and is being viewed in the news, from those that are not satisfied with the help, that they are getting from both the Govt. and the private sector. It is also apparent from the frivolous law suits, the Enron scandal and outrageous salaries of this day, that man / woman is greedy and lacks a spirit of being grateful. I doubt seriously that many of these individuals will be satisfied with whatever the commission decides to do. My suggestion would be to set up a program similar to Social Security, where- as an equal amount would be paid out to these individuals on a monthly basis. The individual would be given this option or a lump sum payment that they can invest or spend as they wish. I am sure that the range of salaries of those working in the Twin Tower's buildings, ranges vastly from low to outrageous. With such a spread, it will be impossible to please everyone. The prudent individual plans not only for difficult times but also death And so most of these individuals should have fairly decent amounts of monies coming in from Ins. etc. As for Soc. Sec., I don't believe these individuals should be treated any different than any other individual that has lost a loved one. I am writing to you to explain that as the victims compensation fund now stands it will not help me at all. After deducting my collateral assets, I would not benefit with the plan. Please understand that social security now pays half my bills and investing our other assets i.e.: Life insurance and my husbands self-funded 401K plan I will not be able to make up the difference. I do not understand why congress has made the statutes for this plan to subtract these collateral assets made by prudent, caring husbands and fathers like actually count against us and leave us netting nothing from the plan. Why would I and many like me sign away all our rights so that we can walk away with what Ken Feinberg is now saying is the floor of $250,000? Is this fair? I feel that the plan must be revised by the special master to increase the $250,000 on the non-economic side and to use up-to-date New York tables on the economic side. I also feel the congress and senate should revise the statutes to remove life insurance and social security as a collateral asset since it is never deducted from settlements in tort law suits. It is also extremely unfair for us to have to go into this fund blind, not knowing what our exact compensation is until we have signed away all our rights and then find out we would not benefit and have no other recourse. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I understand that there is currently a proposal to allow common law spouses to collect compensation from the September 11th Victim Compensation Fund of 2001. I am writing to voice my opposition to those proposed changes. I oppose the proposed changes for two reasons. First, while marriage is a big step, it is a simple procedure. That a legal marriage did not occur should suggest that at least one of the two did not want to get married. My second reason for opposing this is that my father lived for his children. Should this woman be able to collect as a "wife" that would significantly reduce the compensation my father's children would receive. I know in my heart that my father would not want his children to suffer further. Please do what is best for the children of the victims of this painful event. Keep in mind that we can never replace our father or mother, sister or brother, son or daughter. DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." As an American taxpayer I am overwhelmed by the six billion-dollar estimate you have dedicated to the fund and by the arrogant act of cloaking it as consensual "compassion." While my heart goes out to the victims of this terrible tragedy and I wish it had never happened, it disturbs me that our government has devised a formula to calculate the dollar value of life. Further, I am distressed to learn that you, a government representative, have full discretion to determine the amount each family receives. Not only do I question the ethical motivation and implementation of this program, I am sickened to learn retribution has been withheld from those who are not married or are homosexual. I wonder if this program intended to show government kindness or were other motives at play. Why are some compensated and others denied because of sexual preference? Why are some victims of September 11th receiving restitution when society has been the victim of heinous crimes in the past? As Special Master you determine and adjust final payments, life and its value are left to your discernment. You may perceive this a fair act; yet it appears you are acting with godlike authority disguised as human compassion. Sadly, your compassion is at the expense of me, a taxpayer, who was given no say. I did my part to help families; my compassion is represented in 1.6 billion-dollars raised by charities. Still this is not enough for the government, they want to do more. What I find most unethical is the worthiness factor our government utilizes in reference to this tragedy. Settlements of 1.6 million were not given to the families at Columbine. The IRS would turn a deaf ear to the cries of those who could not pay their income taxes, yet this year if they lost a loved one in the terrorist attacks they receive a ten thousand- dollar credit. I doubt those who lost savings in the Enron debacle will be eligible for waivers on estate taxes for property values up to 8.5 million dollars. The problem is no consistency, no standard regulating government intervention. Government has stood by in tragic times before and offered only their condolences. Why now have you come bearing large settlements? Just as distressing is the fact our government has hesitated to include life partners, be they homosexual, heterosexual, or transgender. You have even questioned whether children of these relationships fall within disbursement guidelines. Where lies your compassion? Again, your worthiness factor is further victimization in and of itself. I was aware that suffering was reserved for those involved in heterosexual marriages. To subject gays, lesbians and life partners to more extensive scrutiny defeats the purpose of charity. The Bush administration has called upon America to treat one another with dignity and respect regardless of perceived differences. This is your opportunity as a government representative, to heed the call of our President and help all those who lost someone they loved. The notion that tragedy and suffering know no bounds takes on new meaning when our government acts no less heinous than the terrorists. The terrorist attacked all of America regardless of race, creed, sexual orientation or economic standing, yet you are choosing to compensate with regard to. Because acts of terror and crime affect us all equally, I would like my government to take a more equitable and progressive stance on compensation. This bill was passed twelve days after the terror attacks, a time of great uncertainty. Now that we have had time to collect ourselves I would like to see Congress develop an absolute and ethical system of retribution. Whether abstaining from victim compensation or developing a program extending payments to victims of all crime, there needs to be consistency. The function of government is to provide those public goods and services the private sector overlooks. Selectively compensating victims of certain crimes is wrong and not the business of government. We can not let raw emotion and terror cost taxpayers billions of dollars in deficit spending. In a time when we are scrambling for social security benefits I am perplexed as to how Congress accessed funds in excess of forty billion dollars in a matter of days. The tragedy of September 11th jarred our sense of security. This is no excuse for government to lose sight of their function or purpose. Now is the time to unify and rebuild as a nation. Calculating what a life was worth and deeming people worthy of retribution reduces life and all it could be to dollar signs. I ask you, now who has committed the greater crime against humanity? Government is the formation of elected represenatives whom people deem worthy. I implore you not to shamefully establish selective precedence for victim compensation at the arbitrary discretion of government. We pay a dear price for living "in the land of the free." Freedom has always had a cost and sometimes that cost is enduring suffering. America is no exception. Allow us to move forward with dignity do not fortify our enemies belief that Americans are heartless and only care about money.
