Friday, January 18, 2002 12:01 PM comments Payment for victims pain and suffering should be uniform and limited as proposed by Mr. Feinberg. There is no adequate compensation for pain and suffering, and no way to measure these damages. The only fair and workable method of compensation is a set sum, which in no case will be adequate compensation to the physically injured and deceased. This category of payment should not be an award to survivors. Similarly, payment for economic losses should be appropriately offset by collateral sources. Individuals who were prudent and had life insurance, or fortunate to have other forms of compensation, are in a better position that those who did not. It is not a penalty to offset federal victims' compensation by those resources. The fund should assist those who have need, not serve as a bonus for those who do not. While recognizing the heroism of firefighters, police officers, EMS personnel, and others similarly employed, the fact remains that they chose hazardous professions. To the extent they are compensated by professional funds, employee benefits, life insurance policies, and other victims funds, their economic losses should not be doubly compensated. It takes nothing away from our appreciation for their sacrifices to provide compensation for others who lack these resources. As a taxpayer, I favor providing compensation for economic loss to those who have an actual need. My sympathy for the victims is boundless, but common sense and a recognition of fiscal constraints and equity must be used to determine what payments will be made. Thursday, March 21, 2002 12:15 PM Unfair treatment of homosexual partners I feel outraged that gay and lesbian partners of those who died on September 11 are not automatically going to receive the same benefits as heterosexual spouses will. If September 11 has taught us anything, it's that our patriotism and love of country transcends our differences and unites us all. We were told that September 11 was the day that "hyphenated-Americans" were no more, and rather than being Italian-Americans, African-Americans or gay-Americans, we were now simply Americans, all of us together as one American family. Apparently, that family just got a divorce. The hyphens seem not to matter when our government wants to use our heroism to inspire others, but when it comes time to actually aid the families of those heroes, the hyphens come back with a vengeance, and it seems that some American heroes are now unequal with others. Even fetuses and illegal aliens will be receiving benefits, they've even promised to overlook federal law and NOT arrest and kick out the families of illegal aliens, nor will they punish American companies that hired illegals in violation of federal labor laws. But when it comes to gay and lesbian heroes of the day - who helped bring down the flight in Pennsylvania, who died in the line of duty when the first tower fell, and who was of the plane that crashed into the (there are many more) - we are told the law is the law and no exceptions can be made. This is not right and I strongly urge you to correct this unfair treatment of my fellow Americans. Gays and lesbian families are discriminated against financially in every possible way in this country, not being allowed the benefits that "married" people have. I have spent countless hours at home, watching her young children while she wrestled with agencies in an endless, continuing quagmire of beaurocracy trying to obtain funds. While she tries to nurse newborn twins, a phone is often attached to her ear. While some benefits have arrived, she has the daunting task of providing for these three children and herself for the rest of their lives. She is only 34 years old; her husband was 32. I implore you to expedite in the swiftest manner possible monies in the Sept. 11th Victim Compensation Fund. Further, I beg you to minimize the beaurocracy and forms that will be required of her and the thousands of others in the same position. Their heartache is enormous. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayers money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Wednesday, March 20, 2002 5:50 PM I am appalled that the Victim's Compensation Fund for victims of 9/11 is excluding the survivors of gay and lesbian victims. To use the excuse that "state laws don't authorize this" is hypocritical to say the least. State law doesn't authorize payments to fetuses, either, but that doesn't seem to be a problem. And no law authorizes the payment to illegal aliens, with a guarantee that they won't find themselves in trouble with INS as a result. I don't disagree with the payments to illegal aliens. I do disagree strongly with the payments to fetuses. But most of all, I find it shameful that gay and lesbian victims, some of whom were even in the "hero" category, are to be denied recognition and their survivors left to do without. This is a sad commentary on our "democracy" and those who are devising the rules for this compensation. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. Saturday, March 16, 2002 1:43 PM A complaint I am writing to express my disappointment and disbelief with the revelation that benefits may not be extended to gay and lesbian partners who lost loved ones in the events of 9/11. I think it is completely unthinkable to not extend the same same support to everyone who needs it, regardless of their sexual orientation. Sexual orientation has no affect on the level of loss these people have experienced, it does not change their grief or need for compassion. The fact that the government will extend the benefits to illegal aliens by over looking their status shows a great level of understanding, but why is this not extended to the same sex partners? While it can be argued that same sex partners do not have the luxury of enjoying the same rights heterosexual couples do in the eyes of the legal system, illegal aliens also do not enjoy the governmental protected right to assistance. How can the system accommodate one set of victims without extending this coverage to all? I would have thought that the events of 9/11 would have showed everyone that we as a country feel the same pain and are all deeply touched by the loses. We need to do all we can for everyone who has lost a love one, regardless of sexual orientation, race, immigration status and ethnicity. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks.
