Saturday, January 19, 2002 9:45 PM I am the mother of , a 25yr. old single FDNY Firefighter, who gave his life to save others in the Twin Towers on 9/11. I am very upset with the U.S. for letting this happen. Many of the people in the U.S. who had the job of protecting it's citizens have been asleep for much to long. It is for this reason that my son and so many others lost their lives that day. Now I hear that he may not be included in the Victims Compensation Fund because he was single. How insane is that. My husband and I, his parents and beneficiary to him, feel that there is no amount of money that will take his place. We also strongly feel that he should be awarded something for giving his life for a country where so many people were not doing there job were he was so heroically performing his. There seems to be no problem sending our tax dollars to rebuild Afghanistan but we, in the middle of our grief need to beg the US to do what is right for its own people. The fact that entire family has been shattered and changed forever does not seem to matter to you. We, like the people of Afghanistan need to rebuild our lives. Please look into your heart and see that each one of the poor victims deserve equal compensation for giving their lives that day. A victim is a victim regardless of whether they are a parent, wife, child, or sibling and should all be treated as such. Be honest and fair and do the right thing. Please don't let my son's death be in vane simply because he was young and not married. Because he was busy serving his city unselfishly, his dream of marrying and starting a family of his own was put on hold. There is only one thing that was more important to than the FDNY and that was his family. Do not dishonor this brave, selfless and heroic person by not including his family as victims. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Wednesday, January 09, 2002 12:24 PM Comments Dear Victim Compensation Fund: I am family friend of , one of the thousands that worked in the World Trade Center and was killed in the tragedy on September 11, 2001. I am greatly concerned with the Interim Final Rules you have set for the Victim Compensation Fund at this time. I certainly understand the federal governments interest in protecting the airlines and the airline industry as a whole and thereby setting up this Victim Compensation Fund as an alternative to filing suit in this matter. However, the guidelines as they are presently configured do not, in my opinion, represent the concept of fairness, much less justice in the death of or any of the other thousands who died. First, review must be on a case by case basis working within some framework that you have set. In the case of , this was a young man, age 32, with a wife and 14 month old daughter. He had worked for for four years and in that time had shot up the ladder. His salary increased dramatically over those four years to a base salary of $105,000.00 (before bonus and benefits factored in) in 2001. However, average pre-tax earnings for the three year period 1998-2000 were far less (as much as $25,000.00 less) than his 2001 total would have been. One can only assume based upon his last four years that was headed for much bigger salaries in the future. Your method of basing the economic loss calculation on the period between 1998-2000 does Jason and other young risers like him a disservice and will result in a significantly lesser award from this Fund. Next, your non-economic loss numbers are simply too low. This is supposed to be an alternative to bringing suit and was intended to reflect what one might expect to recieve from a jury award. These numbers do not reflect that reality and these families, instead of feeling that the federal government has stepped in to ease their pain and made things easier in this time of tragedy, feel insulted by this non-economic loss calculation table. Third, reduction of any award by a "consumption factor" is a terrible idea. The point here is that these victims will not get to personally consume any of the income they would have realized throughout their life and therefore those benefits should accrue to the families. Finally, reduction of the award by "collateral source income" is also a terrible idea. The federal government has decided to bear the responsibility in this matter for the airlines in order to protect the economy. No defendant gets to set the parameters of a potential jury award and therefore the federal government should not now be doing so. The fund should pay these families economic losses on a case by case basis to reflect the reality of their situation. In case, it should be based upon his expected 2001 pre-tax earnings (including benefits and bonus) with an inflation and wage increase factor calculated in. Non-econom ic loss should be based upon a number that more accurately reflects a jury award aiming toward just compensation. This personal tragedy was played out in front of the nation and world and the families will never be able to escape the images that haunt them. The event will continue to be on television and a part of our national history for ever. Your non-economic award simply is not right. Finally, there should be no reductions in the award for "consumption" or for "collateral source income." Friday, November 09, 2001 8:37 AM Terrorism Attachment 1: To The United States Justice Department November 8, 2001 An article appeared in our local newspaper requesting public comment on a government program that will provide money to the relatives of those who died or were injured in the September 11 terrorist attacks. Over $1 billion was collected for the victims of the World Trade Towers and the Pentagon and less than 20% has been distributed to the victims. Last night I read where the American Red Cross will only release approximately 20% of the total monies collected to the victims and will use the remaining 80% for future use and programs. This is an outrage. The money collected was for victims of this disaster and not to increase the coffers of the American Red Cross and the over 200 nonprofit organizations that collected money specifically to assist the victims. To assume this terrorist attack is the governments fault is ludicrous and I do not believe the taxpayers should feel an obligation to pay the victims families. Yes, my heart goes out to them for their loss and yes, I definitely feel they should be assisted, but not by taxpayer funds. Our government is expending money for our military and the war on terrorism which I applaud but the "nonprofit" organizations which collected over $1 billion should be the source of assisting the victims families. Many victims of this tragedy were, I am sure, heavily insured via personal and company sponsored life insurance policies and therefore will receive substantial amounts of money. While not a replacement for loved ones lost, these funds should nevertheless cover many immediate and long-term financial needs. Those less fortunate will of course require monetary assistance but I feel the survivors should receive assistance elsewhere and the individuals organizations in New York City, especially the American Red Cross, should be forced to pay out the entire amount of funding received from average Americans who wanted to help. The idea of compensating victims lawyers and whether people who are not satisfied with their payment can appeal is ridiculous. They should be thankful for any assistance and the lawyers should not in any way be involved. Who are they suing anyway? And what part of any monies collected are the attorneys receiving?
