The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Washington, DC 20530 Dear Attorney General Ashcroft: As a result of constituents who have lost family members in the events of September 11th having contacted me and shared with me their concerns regarding the interim final rule for September 11th Victim Compensation Fund of 2001, I have introduced a resolution in the House of Representatives, H.Con.Res. 302, which I would like to bring to your attention. H.Con.Res.302 urges the Department of Justice to seek subrogation, as authorized in section 409 of the Air Transportation Safety and System Stabilization Act, from Osama Bin Laden, other members of Al-Qaeda, and any other individual or organization determined to be responsible for the terrorist-related aircraft crashes of September 11, 2001, with respect to claims paid under the September 11th Victim Compensation Fund of 2001. Also, it calls upon the President to liquidate the assets of those responsible for the terrorist-related aircraft crashes of September 11, 2001, which have been blocked or confiscated by the United States, as authorized in section 106 of the USA PATRIOT ACT, and to use the amounts from liquidation to pay claims or reimburse the Government for claims paid under the September 11th Victim Compensation Fund. As I discussed in my written comment to Special Master Kenneth R. Feinberg regarding the interim final rule for the September 11th Victim Compensation Fund of 2001, the purpose of the September 11th Victim Compensation Fund of 2001 is to provide expedited, fair, financial relief for those most devastated by the events of September 11th, sparing these individuals from having to go to court to litigate for years at excessive cost and constantly having to relive the horrible events of that day. This financial relief, though, comes from the generosity of the American taxpayers, who were not the wrongdoers in the events of September 11th. I believe that it is, therefore, only appropriate that those who committed the evil act of September 11th forfeit their assets to pay the claims of the victims. Additionally, it is my hope that if Special Master Feinberg knew that ultimately, the funding for the September 11th Victim Compensation Fund would be coming from those who committed the evil acts of September 11th, then he would re-evaluate the amounts the interim final rule for the September 11th Victim compensation Fund of 2001 plans to award the victims' families. While no amount of money will ever compensate for the loss of a loved one, we must provide these families with the financial support that will help them as much as possible. Saturday, March 16, 2002 2:44 PM September 11 Fund discriminating against gays Dear Sir or Madam: I have been following, in the gay press, the evolving story of how the September 11 Victim Compensation Fund will not provide benefits to the surviving partners of gay and lesbian Americans lost in the September 11 attacks on our country. This troubles me deeply. The purpose of this fund is to provide assistance to those who have suffered financial losses as a result of losing a spouse in the attacks. Is it possible that anyone really believes that committed same-sex couples in long-term relationships do not contribute to each other's financial wellbeing, and that surviving same-sex partners of September 11 victims are not suffering the same financial difficulties as widowed heterosexuals? I sincerely hope that America's leaders -- the people we should be able to look up to -- are not suffering from such a profound lack of common sense. I also hope that our leaders really believe that we are all Americans first, and members of one group or another second, and that this sentiment, so often repeated since September 11, has not been intended merely to manipulate the public into supporting the war on terrorism. If you mean it, prove it. Provide compensation to ALL Americans who have lost partners. Don't let the relatively small number of vocal, anti-gay extremists in our country bully you into making a morally wrong and un-American decision. The Fund is for Americans who need the help. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I am not just a member of the public, but one of the victim's family members. My husband, worked in Tower One of the World Trade Center and was killed on September 11, leaving behind me, his wife of 7 ½ years and two young sons, age (as of Nov. 8) and - only days old at the time of the attack. My husband should have been home bonding with his new baby; instead, he was at work since 7 that morning. He was such a dedicated and hard-working young man. Look where it got him. I know that you have received hundreds, if not thousands of individual comments regarding the Fund; however, I'd like to emphasize a few points that are important to me and many other victims' families. COLLATERAL SOURCES First, life insurance should NOT be deducted from any fund payments. My husband and many others were responsible estate planners and had the foresight to purchase additional life insurance in an effort to plan for their heirs. These men and women sacrificed and used their hard earned money to provide for their families. That money could have been used towards buying another car or to take a much deserved vacation; instead, our spouses chose to prepare for the future and take care of their families. Please do not lose sight of that fact. Second, money donated by our fellow Americans to the various charities for the vicitms' families should NOT be deducted from any fund payments. These charitable contributions were generously made as a goodwill gesture and provided a form of healing for both donor and recipient - it was the only way many people across the country knew how to help their fellow brothers and sisters. What a beautiful gesture - please don't denigrate this wonderful symbol of patriotism and love. In addition, those legally responsible for this disaster should not benefit from the charity of the American public. OPPORTUNITY TO BE HEARD Each family deserves the right to be heard on an individual basis. Every family's situation is different and we should not be lumped into one group. Please give us the opportunity to present evidence through our own testimony and the testimony of expert witnesses. RIGHT TO APPEAL AND FORM OF PAYMENT Any and all fund payments should be distributed as one lump sum which we will be able to invest in a manner suggested by our professional financial advisors. In addition, we should also have the opportunity to appeal a decision which we think to be unjust. The payment we receive from the fund will significantly affect us for the rest of our lives. By choosing to forgo separate litigation against the airlines, we are placing our lives in the hands of the special magistrate who should not have powers greater than a trial level judge, whose decisions are appealable. YEARS TO BE CONSIDERED Individuals of my husband's age would be required to work until at least age 68 in order to receive full Social Security benefits. Moreover, since most individuals are no longer covered by defined benefit plans by their employers, it is necessary for them to work longer in order to save the funds necessary to provide an adequate income in their retirement. Accordingly, it is important that the award be determined by the earnings of the deceased over his entire working life to age 68 as it would have been had he survived. Mr. Zwick, thank you for giving us the opportunity to be heard. We are living through the most horrific time of our lives and this at least gives us some form of comort, or control over our future - the ability to have some input on a bill that will affect us for the rest of our lives. I am writing to express my outrage at the hypocritical statement of Kenneth Feinberg, the head of the September 11th Victim's Fund, on "Meet The Press" this weekend which stated that lesbian and gay survivors of victims of the September 11 attacks would be "left out of my program to the extent that their own state does not include them." Feinberg is willing to compensate the families of illegal aliens, effectively saying that simply because they are not US citizens does not mean that these people didn't lose a precious family member in this tragedy. But in the same breath, he excludes lesbian and gay US citizens from the same compassion. Lesbian and gay people are full citizens of this country and deserve to be treated as such. One of our own, , has been lionized as a hero for his role in the crash of the jet in western Pennsylvania. Zwick, Director Office of Management Programs, Civil Division U.S. Department of Justice Dear Mr. Zwick: Thank you for the opportunity to be heard. I am writing in response to the Department's request for public comments regarding the forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund." I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. I know that this administration in general has a strong Christian conservative philosophy guiding it, but I honestly believe that God or Christ or Mary would see the need for compassion and understanding and want these children and family members to have the same benefit that other families have. As a former Methodist and current Taoist, my tradition is compassion. I am a citizen and should feel that my government represents my views equally. This is a time for coming together, not establishing artificial barriers based on prejudice and narrow religious conviction. Many Americans lost their lives on September 11, each of whom left behind loved ones. I urge the Department to honor these bonds by treating the families of gay and lesbian victims as you would any other.
