Tuesday, January 22, 2002 9:30 AM Disappointment with deduction of collateral resources from potential awards Dear Mr.Zwick: I am writing to express my disappointment with the rules outlined for the Federal Victims Compensation Fund, particularly the rules which would deduct collateral resources from any award amount. I was told that the purpose of this fund was to provide victims with an alternative to the long and costly litigation process. After reviewing the rules outlined by Mr. Feinberg, I determined that the fund would clearly not provide ANY financial assistance to my family. By deducting collateral resources from the calculated award, my family would receive NOTHING from the fund. This cannot have been the intention of the authors of the statute. Regarding these collateral deductions Mr. Feinberg stated: ??after we compute economic loss and non-economic loss, that gross number must then result in a deduction for collateral offsets. ?Why? The statute requires it. The statute states that certain -- certain awards, certain compensation, certain benefits to victims must be offset -- such as life insurance or other death-benefit programs.? Feinberg weasels out of this by stating that he is only doing what the statute requires. The answer to his dilemma is simple ? CHANGE THE STATUTE. Legislation like this has never been passed in our country before. It was written in a hurry and everyone agrees there are flaws. It is imperative that the statute be changed now, before great injustices are committed and terrible precedents are set. He refers to private life insurance as a ?death benefit program?, as if it is something sponsored by the federal government. Private life insurance is an individual choice and not something that the government should penalize some for having (while rewarding others for not having it). It is not as if the federal government would be paying these families twice. The amount the families have been compensated by private insurance companies should have no effect on the award from the Federal Victims Compensation Fund. The United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Many lesbian and gay people were killed in the September 11th attacks. The events of September 11th affected all families equally. I am amazed that anyone would consider a time of grief an opportunity to get up on a soapbox and try to divide an already "hurting" community. I am fine with the inclusion of illegal aliens as a compassionate measure to those who have no way to recover after such a devastating loss, but since when do illegal aliens take precedence over American citizens? Do not gay and lesbian victims and partners of those victims deserve the same compassion? Many of these persons would be legally married if they had the opportunity to do so. They have been BARRED from doing so by the same government which is now saying that they will be penalized because they are NOT legally married? What cruel irony is this? Besides the fact that the government should grant some form of civil recognition to people who wish to marry, or couple together legally and share the same benefits and responsibilities of a "married" couple, it should also grant the same services to those who for all intents and purposes are married in all but the civil piece of paper. \n If you have religious or other objections to the term marriage, fine. Call it a civil union if you like. But grant us the same pursuit of happiness you afford yourselves. Many GLBT unions last much longer than heterosexual unions. But that isnt the point. The point is people do bond together, whether considered legal or moral by others, because they love. And when they lose that love, they are as devastated as anyone else. And if they are financially dependent or interdependent on their partner, they are also just as harmed and made destitute as anyone else. We dont ask if people are gay when they collect unemployment, or food stamps, and we dont ask if they are gay if they contribute to our campaign or make large donations to charity. It is all immaterial. We are all humans, and we are all American citizens. Those are the things that should matter when disbursing American funds. If you are going to waive the need to be an American citizen to collect those funds, fine. That is a generous move and one based on compassionate motives, but if that is the case, how dare you deny an American citizen, just because they are gay? I dont buy your State's law argument. This is about federal obligation, not individual state's laws. The federal government has passed laws before which conflict with state legislation. If you have to pass a new federal law to give these victims their due, then go ahead and do it. Dont deny responsibility in such a shameful manner. Live up to the true American ideal. Why should they have a cap if the rest of us are looking at retirement now starting at age 70. b) There should be no deductions for any charity received by the victim's dependants. They are ENTITLED to their share REGARDLESS of any gifts they may have received. c) Life insurance was PAID for by the Victim and should not have any bearing on what the family has a right to. d) The right to appeal should not be denied to those who are suffering due to the tragic losses inflicted on them by this horrific event. Wednesday, March 13, 2002 4:08 PM stop discrimination I'm writing to say that I am shocked to hear that partners of gay and lesbian victims of the September 11th tragedy will not recieve the same compensation as straight people and as illegal aliens will recieve. In a country which is supposedly founded on the separation of church and state, this is a strange circumstance indeed. It appears that the government is taking the kind of stance that did in those days immediately following the tragedy....making it clear that fundamentalist prejudice is still very alive in the U.S., just as it is in many fundamentalist Islamic countries. The fact that it is Christians doing the discrimination is no comfort to those affected by this discrimination. Please realize that history will one day recognize the legitimate human rights of Gay, Lesbian and Bisexual people, who have always been a part of building this nation, and of defending it, as (a gay man on United flight 93) did on September 11th, 2001.
