Dear Mr. Zwick:
On September 11th. my husband, woke up at 5:00 AM as
he did every morning. He said his prayers, went out for his run then
proceeded to drive to work. I am proud to say he was a successful man in
his own right. At 41 years old and he was
at in One World Trade Center. He did not return home to his family that evening and never had a chance to get a call out.
He leaves behind a wife of 18 years, three children, parents,
brothers, sisters, in-laws, friends...the ripple effect goes on.
The pain we now must live with is indescribable.
I am writing you today Sir simple to ask you not to forget these men
and their families.
As you know, in the immediate aftermath of this tragic attack, our
Congress enacted unprecedented legislation to bail out the airlines by
imposing a caps on their liability thus restricting, (and for all intense
purposes eliminating), victim's constitutional right to pursue legal action
against the airline who at this point they hold primarily responsible.
Congress at the same time set up the Victim Compensation Fund in order for
families to receive full and fair compensation for economic and
non-economic damages. Of course that was after all families had to endure a
"collateral source deduction" something completely unheard of in any
state's civil court system.
The DOJ has decided to further add insult to injury by imposing
arbitrary "interim rules."
These rules require families to blindly sign up, thereby giving up
all their rights without knowing what their outcome will be. They are
being forced to accept a hearing process lasting on average 2 hours and
their only right to appeal would be under "extraordinary circumstances,"
which are not defined and left to open interpretation.
Moreover, the DOJ has imposed arbitrary income limits which severely
penalizes the very people who were victimize by this heinous attack, namely
those who work with in the financial industry.
I thought that I lived through it all after September 11th, but
these interim rules have so hurt the very people they were designed to
help, that they have left this American truly shocked and disheartened.
As a leader of strenght through out these dark days, I ask of you
Sir to please intervene on behalf of these families and insist that the
income caps be removed and the final rules please live up to the full
spirit of the legislation so that ALL who opt into the fund will be treated
in a fair and equitable manner.
The families of the victims ask for nothing more or less than what
these good people deserve. If our government turns it's back on these
families now in their time of need, then Osama Bin Laden and the terrorist
have won.

To our Elected Officials:
In the immediate aftermath of the tragic attack of September 11th upon our nation,
Congress enacted the Victims' Compensation Fund of 2001 P.L. 107-42, to compensate
the relatives of the victims of that brutal attack. As you know, this Fund was enacted as
part of a comprehensive package which bailed out the airlines industry and imposed
restrictions on the rights of the victims' relatives to sue the airlines in court. We implore
upon you, as our elected officials, to demand changes to the interim rules issued by
Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules
fail to satisfy the letter or the spirit of the legislation which was enacted.
Specifically, we request that you act on our behalf and demand the following
changes to the interim rules:
1. The arbitrary income limits imposed by the Special Master are not only unfair
but also inconsistent with the letter and the spirit of the law. Those victims from
the financial industry are specifically harmed by this limit. They were targeted and
murdered precisely because of the jobs they held, and where they worked-the World
Trade Center, the Financial Capital of the world, the embodiment of financial success.
Those who achieved such success should see that reflected in their awards. They
personified American Business and commerce, democracy and freedom. We ask that
you demand that Mr. Feinberg lift the arbitrary income limits so that each family can
be treated fairly, commensurate with the support they provided their families before
their death.
2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and
suffering, no matter what the extent of the pain and suffering. This is unacceptable.
In the words of Rep. Peter King, "...every death is tragic, A murder is particularly
tragic. But to have your loved one murdered in a burning building in full view of the
world - in a scene which will be repeated in the media for decades to come-is a
horror these families will never escape from... The Special Master cannot take it
upon himself to restrict the rights of the families." Therefore, we request that the
interim rules be amended to more appropriately compensate the victims' families for
the immeasurable pain and suffering endured by our loved ones.
As Mayor Giuliani stated in his farewell address: "we have an obligation to the
people who did die... Their families need to be protected just as if they had been alive,
financially and every other way that we can help and assist their families...There should
be no compromise about that ever..."We request that the interim rules be amended and
redefined to the extent that income caps be removed when computing economic loss and
that compensation for pain and suffering more accurately reflect that horror which was
suffered. Justice demands no less.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars
per year might receive thousands of times as much compensation as the survivors of a dishwasher in
one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent
worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It
would be a double blow to the survivors to first lose their loved one and then watch as most of the
taxpayer money went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

important issues.

Dear Mr. Zwick:
On September 11, 2001 my sister, , died in Two World Trade Center. I worked a block away and witnessed first hand the terrible death she suffered. We lived together, commuted together and most importantly cared for my 93 year old, very
dependent father together. She was the best sister in every way and I was honored to
have her for the years that we had together!
I understand that there are Advocacy groups forming to help the families of victims. We
are not looking to sue any organization, government or person. However, many are left
with people to care for without the assistance, both financial and emotional, of the victims. On a personal note, my father has a very small pension and social security. Because he cannot be left alone, and I paid women to come during our hours at work and take care of my father. This is solely my responsibility now as well as our mortgage and other living expenses that and I shared. Yes, she had insurance but will it cover the long term needs of my father? I would like to think so except I know that means shorter life for Dad.
I simply ask you to do the right thing for all the victims' families, especially those with
young children! If appeals are necessary for needs to be taken care of please allow room
for appeal. Thank you!

If Atty. Gen. Ashcroft can discriminate against the documented partners

basis of what their home states have for law, does that mean the Atty.

Leaving gays and lesbians are left out of the 911 compensation program to the extent that their own state doesn't include them is outrageous and cowardly. No state includes us (except some as state employees) and you know it. What a convenient excuse. I hope our future gay heroes remember your ingratitude and injustice.
If state law had discriminated against a minority, would you use take the same action? I have never been prouder of my community, and more ashamed of my government, than this moment. You are all cowards.

teacher, September 11th brings back horrible memories and images--- I am sure you can imagine.
During a time of such severe tragedy, it is up to us to make sure that all people are provided
for.
As a member of Amnesty International I ask that the Justice Department is consistent with
international human rights standards, and all victims including gay and lesbians families are
eligible for compensation. Real justice is served when all types of victims' families are

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination and a friend of a couple in this situation, in
support of equal access to benefits under the September 11 Victims Relief
Fund for all victims, regardless of sexual orientation or marital status.
As you know, the United States has committed to uphold international human
rights standards, including the Universal Declaration of Human Rights and
the International Covenant on Civil and Political Rights, which prohibit
arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

September 11th Victim Compensation Fund of 2001
Below are my comments in response to the Department of Justice website
soliciting comments and opinions regarding the proposed regulations and
processes for implementing the Victim Compensation Fund.
My understanding is that victims of the September 11th tragedy are defined
as families of those who perished as well as individuals who are now
unemployed (or whose businesses sustained prolonged closures) as a result of
the attacks. Without a doubt these people have suffered the most, and will
continue to suffer for a significant period of time.
However, there is a population of individuals who I do not believe qualify
under the accepted definition of victims... but these are people whose lives
have been turned upside down since September 11th. These "non-victims" live
in the immediate vicinity of Ground Zero. I speak from personal experience.
My apartment is in a complex directly across the street from the World Trade
Center. While my apartment sustained only minor damage, it is
never-the-less contaminated with dust and debris which had to be removed by
a company specializing in handling Hazardous Materials. I was lucky. Many
of my neighbors found that their apartments caught on fire when flaming
debris was jettisoned across the street from the World Trade Center.
For a variety of reasons, everyone in the neighborhood was prohibited from
re-occupying their apartments for a period of time FBI and police
designated the area a crime scene. Emergency and rescue workers
commandeered buildings and streets. For a time, the area belonged to the
authorities... and rightly so.
In the past month or so, many buildings have been readied for re-occupation,
but many in the neighborhood cannot yet return because particulate matter in
the air (emanating from the still-buring fires) causes respiratory distress,
nosebleeds, asthma, headaches, etc. While we have been assured by the EPA
that the air poses no long-term health risks, residents are suffering from
symptoms that make the area a short-term health nightmare.
While some downtown residents were smart enough to purchase homeowners or
renters insurance, many, many were uninsured. Every uninsured person has
had significant out-of-pocket expenses: temporary housing,
HazMat decontamination, the cost of HEPA air filters (recommended by the
Department of Health, OSHA and the EPA), extraordinary meal charges, dry
cleaning, etc., etc. A subset of the population have incurred (or will
incur) additional expenditures: moving and storage costs, medical (and
psycological) bills, charges to replace damaged property and the like.
Although there are serious financial considerations for downtown residents,
the emotional toll is hard to quantify. Many have been so traumatized that
their professional performance and personal relationships have suffered.
Our once tranquil neighborhood has suffered too. Transportation options are
significantly reduced (and will be for years to come). Goods and services
are greatly diminished (many stores have permanently abandoned the area
because they relied heavily on the patronage of those who worked and visited
the World Trade Center complex). Air quality is compromised (we've been
told that our children should not exert themselves when playing outdoors.)
Many have chosen to move to other parts of the City. Others have chosen to
stay and rebuild the neighborhood. All have suffered.
We are victims too, and the residents of Battery Park City on September 11,
2001 deserve compensation for what we had to go through.

9/11 compensation fund excluding gays and lesbians
I am shocked and appalled that the surviving partners of gay and lesbian
victims of the 9/11 attacks will not be receiving federal compensation.
Hiding behind the laws of states as an excuse doesn't cut it when illegal
aliens will be receiving aid from the fund in violation of the law. If it's
okay and acceptable to bend the rules for illegals then how can it not be
okay and acceptable to compensate those gay and lesbian American citizens
who lost a partner?
Discrimination is a horrible thing. Discrimination by your own government
is appalling.

Homosexuals are full citizens
Yesterday on Meet the Press, Kenneth Feinberg basically said homosexuals who were victims of September 11ths tragedy are not perceived as full citizens when it comes to the distribution of your fund. I sat there in absolute disbelief listening to this man say that we are willing to bend the law for illegal aliens but not for American citizens who happen to be homosexual. Such an outrage! Such an injustice! What more pain could we possibly inflict on their families?
Please let me know what I can do to right this terrible wrong.

9-11 fund and "ALL" Americans
I would like to first say to Mr. John McCain: Thank you for having the
courage and compassion to look beyond the bigotry and prejudice of the many
by at least making a personal stand on decency, when speaking about      and Gay's alike.
Having said that and after reading what Mr. Ashcroft's views on the use of
the 9-11 funds which exclude gays and their loved ones, I am saddened but
nonetheless not surprised, at this latest attempt to stand in judgment over
others.
It was a terrible day in America on September the 11th, 2001 as I sat in
horror as our/my country was attacked. I sobbed for my fellow Americans as I
would any member of my own family. But today it isn't sadness that fills my
heart, it is anger at the leadership of the greatest country this world has
ever known. To think that my money (gay money) will go to anyone and
everyone, except those who Mr. Ashcroft has decided are not as deserving,
sickens me. How righteous and noble of this administration to allow the
illegal who are breaking the law to be compensated for their lose; and
rightfully so, but not the legal gay tax paying citizens. I'm sure that God
will think this act to be quite admirable.
Regardless what ones views on another's life style, we are all Gods
creatures. We all bleed RED, hurt when victimized, and see RED when
brutalized.
How quick we forget what our country has done to our African American and
Indian Americans. Haven't we all seen what prejudice can cause? And then we
have the nerve to ask "why do they hate us so much?".
My mother, a single women who raised three boys, use to tell me; "Treat
others as you would want to be treated yourself". I'm sure your mothers said
the same sort of thing. At what age do we forget that?
I just hope that the next time you need a hero to save your life, and he/she
happens to be gay, that they will have forgotten this decision or at least
remember those words my mother use to say!
