A number of my constituents lost family members in the attacks of September 11th. As we all know, no amount of money can truly compensate for these losses. However, the Federal Government, in Title IV of Public Law 107-42, has sought to establish a system by which reasonable payments can be made both to provide survivors with quick relief and to avoid lengthy, costly, and potentially unsuccessful litigation against the airlines, among others. However, the system proposed in the interim final rule, particularly when applied to victims who were both low-wage-earners and older than many of the World Trade Center victims, as is the case for constituents of mine, does not appear to adequately address the magnitude of their pain and suffering or their economic losses. I would urge amendments either to raise the "cap" on compensation for pain and suffering to a substantially higher dollar amount or to give the Special Master flexibility to fully consider the individual cases of claimants, and to adjust the formula for compensation for economic losses to increase the amounts for survivors of older and low-income victims, who are surely the most vulnerable of all the survivors of the catastrophe of September 11 th. The Federal Government, in Title IV of Public Law 107-42, has sought to establish a system by which reasonable payments can be made both to provide victims with quick relief and to avoid lengthy, costly, and potentially unsuccessful litigation against the airlines, among others. However, I am informed by affected individuals that the interim final rule defines "physical harm" in a way that effectively denies compensation to persons who were injured, sometimes severely, in the attacks but who were unable to seek medical treatment within 24 hours. A number of New Yorkers were seriously injured in the attacks on the World Trade Center but for various reasons, ranging from lack of care for very upset children, to lack of regular medical providers, to the severe emotional toll of experiencing the attacks in person, were unable to seek and receive treatment until the 24 hour period specified in the rule had passed. I would urge that the rule be amended to provide compensation for expenses of medical care without regard to when an injured victim sought treatment. At the very least, the Special Master should be given the flexibility to consider the individual circumstances of persons injured but not seeking treatment within 24 hours. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Money can only serve to hopefully replace the income lost or provide some other non emotional needs for the material things. It seems that the notion that lots of money will soothe my pain and make someone else pay, is a popular thought, however it is erroneous! We can only look to our Maker and ask for healing direction for the new course set before us, and the strength to go on that way. I do not think we should provide money for the "victims" to sue. I don't think there should be double dipping into the government and the charities, unless there is not enough money to provide for the true needs. Many people gave very generously to the charity programs, and I for one want to know that that money was used, all of it, for its intended purpose. I would be most unhappy to find that my generosity was taken advantage of, or squandered on lawyers. I have seen enough greed. To exclude this group, the partners of gay and lesbian heroes of September 1, from always receiving the same benefits as the spouses of heterosexual victims of the horrible terror attacks is a blatant INJUSTICE. Wednesday, December 19, 2001 6:49 PM Crisis Relief Benefit Equity December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. The presumptive award as stated by the regulations narrows down to a concept of signing a contract without receiving adequate and accurate information beforehand it accounts to an uninformed consent. It seems to us that families of the victims of September 11, 2001 terrorist attacks were not only robbed of their love one's lives, but now your regulations are robbing our rights. Criminals, robbers and others belonging to obscure business have Miranda Rights, right to free counsel, and unrestricted right to sue when done wrong. Healthcare patients have Bill of Rights, informed consent, and other protections such as unrestricted right to sue when done wrong. Where are we cataloged 2. Your regulations lack consistency with the rule of law. You treat us different from anyone else. These regulations are clearly inconsistent and contrary to the statutes for compensating victims' families. 3. Our Government failed to protect its citizens at home. The responsibility for this massive failure not only includes the airline industry, but the FAA, FBI, CIA Port Authority of New York/Fire Department for failing to have adequate evacuation plans to rescue workers in the upper floors in extreme cases of emergency and/or fire. Many families received calls from their love ones (who worked at 1 WTC 101st floor and higher, or 2 WTC), these workers were alive and well after the first plane hit Tower One and were trying to find exits. The obstacle was that the stairs were blocked, and these unwilling victims were unable to safely reach their way out. Notwithstanding these facts, (that failed t protect our families in the first place) has placed restrictions/limitations on our ability to sue when done wrong. 4. Congress and President Bush intended to compensate families for the harm done to each family (economic and non-economic damages). The deceased's families are entitled to receive full and fair compensation for pain and suffering, loss of companionship, loss of benefit to have the victims live their life to the fullest. Yet, your regulations arbitrarily limit the term relatives and minimize the financial aspect of economic losses. Its language limits the term relatives and minimize to wives and children. What about the victims who were single, yet responsible for other relatives Many victims provided services and assistance to their families, and these families should be unrestricted in receiving the full value of these services. Regarding the financial aspect of your regulations, the growth path of earnings must accurately represent this group. Most victims were highly successful and financially independent. Their path of earnings and their rate of salary increases were well above the national average. But not only the Special Master does not consider this crucial point, he goes one step further and lowers the base of the financial award by computing a mean based on last 3 year earnings. Remember, Osama Bin Laden attacked the symbols of success and capitalism. 5. Furthermore, your regulations treat the victims as statistical budgetary burden by using economic tables that are flawed and low. Additionally, Professor &nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp, Forensic Economist, of &nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp University stated that the calculation of your work- life tables uses old statistics from 1979 and 1980 and that these numbers are lower for women.. The number of women and their rate of success and working years has greatly increased since then. 6. The presumptive award should not be reduced by the amount of contribution victim's estates have received from pension plans, 401k, life insurance, voluntary contributions from employers, social security, etc. Our love ones earned these monies throughout their working years it is rightfully theirs. 7. Our family has a question that we would like to be answered: Is the unconditional generosity of the people of this nation greater than the Federal Government's conditional liability/failure to protect its citizens in their own homeland whose only "fault " was to go the morning of September 11, 2001 8.
