December 22, 2001 Dear Kenneth Feinberg: It is wonderful that the civilian victims families will be helped. Their uniforms; of a jacket and tie, are every bit as important and worthy as a fireman or policeman's uniform. Each chose their jobs. It seems appropriate the way monies are being figured out EXCEPT the reduction of the amounts by the life insurance being paid. This is wrong because those families paid money out of their salaries for life insurance by deducting that amount from the total you are making the sums equal. For a family that paid thousands in premiums (bringing home less money), over the years to those that did not pay for extra insurance. Those that paid into life insurance should get that above the federal money. If it is deducted from the total, the insurance paid for will not be received, as it will be deducted from total. My cousin was 55, married with 3 college age sons, making $108,000/year. He paid for life insurance for his wife & son. Compare that to someone of the same age and family situation, who did not pay for a policy. why should they get the same amount. It urge you not to deduct private life insurance from the federal pay out. Those families paid for the policies and their monies should show it. Without changing the rule, you are making it irrelevant to have life insurance. Friday, November 09, 2001 6:41 AM Victims Compensation Fund I am a resident of Battery Park City. I was diplaced from my home for tw2o months. Although I was recently able to return, my life is not the same. I have asthma and to prevent flare-ups, I need to run three air purifiers, which makes me feel like I'm living in an airplane because of the constant noise, and my doctor has increase my medication to five-times what it was before 9/11. Every day I leave my apartment I have to figure out the best way to leave the neighborhood, because of all of the changes to transportation access. I have to walk past makeshift memorials of teddybears and flowers that is a constant reminder of the deaths that occurred across the street. Yesterday, I was laid off from a job that I had worked at for over nine years, due to the company's economic losses, in part, after 9/11. I will eventually lose my medical insurance coverage, which I need more than ever because of the increase in my medication, and because two days ago I learned that my sister has advanced ovarian cancer. Since my mother already had it, I now have a 50 percent chance of getting it also, and I will need to have genetic testing and preventive surgery. I can longer plan to move out of the neighborhood because I can't afford another apartment, and I will no longer qualify for a mortgage. I still have virtually no food in my refrigerator because of the unavailability of stores in the neighborhood. I can't use the garbage chute on my floor because of the constant overflow of discarded furnishings from other people's apartments. I am repeatedly requested to show ID in order to get to my home. I am most certainly a victim. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I would like to object to the proposed compensation formula presented by Special Master Feinberg. In order for the compensation fund to work, it needs to provide compensation in line with comparable wrongful death actions. By requiring offsets for collateral funds, this fund is unable to come even close. Under the provisions, my family would stand to receive $0, even though Mr. Feinberg would have the public believe that most families would receive substantial compensation. Why should the insurance companies and pension funds bear the responsibility for the failure of so many parties to protect the tenants in the World Trade Center? Following are some of our concerns regarding the regulations that are to be written on the Victim's Compensation Fund: We feel that the government should be held to the 120 day limit they have self imposed regarding handling the cases. However, if the claimant's need additional time to gather their evidence regarding losses incurred, they should be able to request an extension. Dealing with the personal loss, financial concerns, endless paperwork, and everyday life may make it difficult for some claimant's to prepare properly for their hearing. We are hopeful that when the regulations are published on December 21, 2001, there will be sufficient information for the claimants to ascertain approximately how much their settlement would be. This is only fair, as they are giving up all rights to pursue private lawsuits for their loss. The formula that will be used to determine economic loss should be clearly stated. In addition, we request an approach such as that used in personal injury actions with a retirement age set at 68 years. Regarding non-economic losses, again the regulations should clearly stipulate how this will be evaluated in order the claimants to make an informed decision regarding filing a claim or pursuing a lawsuit. Each person's situations should be evaluated individually. Pain and suffering for all affected family members should be taken into consideration. Children over the age of 18 have still lost a parent because of this crime and are suffering greatly from that loss. We are very concerned about the use of collateral sources to offset any amount recovered from the fund. Donations made by the American public to charities to assist these families should not be deducted from the settlement. They were made to show compassion and patriotism and to help the families with the immediate financial hurdles as they begin to deal with their new situation. Further the act of deducting these donations from the settlement may deter future donations to charities in the even of another disaster. Claimants should be given the right to appeal the decision of the Special Master regarding their settlement. We, the undersigned, thank you for allowing us the opportunity to voice our feelings regarding the regulations to be written for the Victim's Compensation Fund. Although we cannot make up to these families for the losses they have suffered, we do ask your help in giving them a fair settlement. Publish the regulations so that they will be easy for all to understand, and make filing the claims as simple as possible, while giving each claimant the opportunity to a full hearing on their situation. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Thursday, March 21, 2002 7:09 PM Give me a break! The amount of money that these people are getting is beyond ridiculous. I DON'T think people should be super wealthy off the cost of taxpayers! Normally a person should have ten times their income in life insurance. I feel most victims had life insurance. An average of $1.6 million! GIVE ME A BREAK! I'm so sorry it happened but people die everyday! What about the soldier that lost his life due to friendly fire? should the Government give the family a million or maybe two million? what about OK city victims? People should not PROFIT from this! Yes they are PROFITING! Some families are getting filthy rich off this tragedy! Then some people have the NERVE to say it's not enough! It should be ok to get funds from private sources but I don't think it's the Government place to pay this money. It wasn't the governments fault this happened! Then the Government needs to compensate those families that lost loved ones to drunk drivers, war efforts, robberies, random shootings and what about shootings in the schools? Compensate those also! Monday, March 18, 2002 9:11 PM Disbursement of the 9-11 Fund I am an American, I am a brother, an uncle, a friend, a business associate, a human being, a tax payer and I also happen to be Gay. I am not ashamed of any of these BUT I am very disgusted with Mr. Kenneth Feinberg, Head of the September 11 Victim's Compensation Fund that is planning on limiting the kind of compensation that will be given to gay and lesbian victims of the September 11 attacks. Is this the first step? Will non-Christians be excluded? Will non-whites be next? Why include NON Americans but not us? Am I less than these NON Americans? We are no different than anyone else; hurt us and we cry, cut us and we bleed as we did in New York on 9-11 and we do in Afghanistan today. We don't ask for anything special, we ask for the same things allowed to other Americans. I hope Mr. Feinberg will reconsider his stand and I hope that President Bush will insist that we are treated as Americans PERIOD. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. Wednesday, December 19, 2001 12:32 PM September 11 Victims Relief Fund December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. One of the paramount responsibilities of the Federal Government is to protect the civil rights of its minority citizens. Basing the decision of whether to extend the same civil rights to a minority, on a poll or a vote of the majority in a given community is wrong. Its a lesson we most recently learned again in the 60s.
