Two aspects of this fund concern me. First, the urge to reward benefits to illegal aliens. Second, the urge to reward benefits to unmarried loved ones, including homosexual partners. First, the illegal aliens who lost loved ones certainly deserve human compassion and sympathy. However, as a question of public policy, such compassion isn't the role of the government, but of individuals. The government must make it plain that its first duty is to uphold the law. Otherwise, the government undermines the rule of law, which undergirds its position of legitimate authority. If the government winks and nods and overlooks the fact the aliens are living in a state of lawbreaking, and thus issues financial compensation to those lawbreakers, then our government slaps in the face every person who obeys the law. It is the duty of the government and of government officials to uphold the law. Illegal aliens, even those who suffer personal losses, including in such a tragedy as Sept. 11th, must suffer the consequences of their willingness to break our nation's laws. Their continued callous disregard for our laws must be the defining issue here. Had they not broken our immigration laws, they would not have been exposed to the danger. Had they obeyed the law and immigrated lawfully, they would then deserve government recognition of their loss. However, to overlook their lawbreaking on the one hand and to reward it on the other would be to commit a wrong against every lawful person who suffered the same loss. During the War Between the States, General Stonewall Jackson had to punish a young soldier who had deserted his ranks. The soldier's family came to plead for the boy. The General, with tears in his eyes, said he would be not be showing mercy toward the boy but harm toward the rest of his soldiers if he excused the offense without punishment. In the present instance, the government would be doing grave harm to the rest of the victims (and the nation's citizens) if it turned a blind eye to the eager willingness of the illegal aliens in question to exploit our nation by breaking our laws. This loss should properly be a consequence of their wrongdoing. Second, to compensate unmarried loved ones of victims would do violence to the sanctity of marriage. This institution from time immemorial has fundamentally set apart one personal relationship from another. To reward those who have not committed themselves to one another, morally and legally, through marriage does the same violence to this unique state as would overlooking the breaking of immigration laws. In the case of homosexuals, the loss is to be sympathized, but not compensated through this fund. Homosexual relationships should not be equated with heterosexual, monogamous marriage. Marriage is recognized for its uniqueness and is exclusively reserved for male and female in virtually every culture over the course of history. Only hetersexual couples can procreate, and one of marriage's unique characteristics its its procreative ability and provision of the optimal environment for childrearing. Virtually every social scientific study confirms that the family, defined as one man and one woman united in marriage, provides the balanced influence upon children from the feminine and masculine. Furthermore, social science research overwhelmingly confirms that children reared in a male-female marital environment face much greater odds of avoiding social ills such as teen pregnancy, dropping out of school, etc. Though homosexuals may have lost a partner, they did not lose a spouse -- legal or otherwise. The government must not undermine the institution of marriage as traditionally defined be compensating unmarried partners. By affirming marriage, the government obeys the Defense of Marriage Act, stands on the firm foundation of social scientific evidence, and on the side of the vast majority of the American people. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. January 15, 2002 Dear Mr. Zwick: Before the Victim's Compensation Fund Rules are made final, I feel compelled to put some of my thoughts, regarding those rules, on paper and send them on to you. I will endeavor to set my thoughts down clearly and concisely. But first I need to tell you that my year-old son, , is among the lost. He was an Equities Trader at and had been employed there for the last 5 years. He had started at the lowest rung of the ladder and by diligence, a bright mind and much hard work, had just started to hit his stride in his chosen field. 1. I ask you to please reconsider the amount currently being considered for pain and suffering(Non-Economic Loss), Please realize that many, many people located in offices on floors above the point of impact were alive for at least one hour, and in some cases, even longer. It is very apparent because "911" calls were being received well beyond one hour after impact and almost right up until 1 WTC collapsed. This is a matter of public record contained in the logs of the "911" calls received by the NYC Police Department on September 11. 2001. Portions of those logs were published in the NY Daily News on Sunday, September 30, 2001, as well as in other publications since. Our "trapped" loved ones spent that time fully realizing that they could go neither up nor down to save themselves. They also knew that no one was going to be able to reach them to save them. There are records of phone conversations they made wherein they state the conditions around them-- heavy smoke, sections of floors collapsing around them, difficulty breathing, people falling sick and passing out, etc. They were begging help. And they were terrified. The hour or more that they lived until 1 WTC collapsed was more than an eternity of "suffering" for them. A mere $250,000 trivializes that agony and minimizes their pain and suffering. 100 times $250,000 would still not be enough to compensate our loved ones for the pain and suffering they endured. We cannot simply "blow off" the enormity and horror of how they suffered. True, there is no amount of money that can equal their pain and suffering. But does that mean that since there is no number than can compensate them for their pain and suffering, that to only give them a minimum is fair? Does that not minimize the horror they endured? We can not lose sight of the fact that these people were civilians. To be put into this type of danger "on the job" was certainly not on their job descriptions. So please increase the Non-Economic award to reflect the true pain and suffering that our loved ones endured. It was simply unimaginable. 2. Please use the wages earned for 1999, 2000 and an annualized income for 2001(We were already three-quarters of the way into the year so please do not disregard the earnings of that year.) when computing awards for the victims. Many of these victims worked very hard to make huge strides in their salaries from year to year, so please do not demean that ambition and their hard work by totally disregarding 2001's earnings. 3. Please do not average those 3 years when computing the awards. Instead please make note that most of the incomes of employees tended to increase yearly by many more percentage points than the national average of 5.5%-6.0% as noted on statistics produced by the Bureau of Standards. It was common for salaries of young, up and coming Traders and Brokers at to increase by $20,000 to $30,000 and possibly even more per year until a very substantial salary level was reached. Please take into consideration the way salaries rise in the brokerage industry when computing the award for a young, rising star in the brokerage industry. The salary escalation for a middle management executive in corporate America would differ greatly from the salary escalation of a young up an coming trader or broker in the financial services industry. And lest we forget they were targeted simply because they worked in the financial services industry. They sacrificed their lives for their country and their country cannot think so little of them as to demean the value of those lives. 4. Please configure your charts to show the typical award for a high wage earner. Please bear in mind that many of the employees (both traders and stockbrokers) earned more than your present cap of $231,000. They should not be penalized because they earned salaries higher than 98% of the country. These people worked hard to provide for their families and had they been allowed to lived out their lives, in many cases, would have provided very substantially for their families well into the future. Their awards should reflect that. One very important last thought that I must leave you with is that our loved ones worked at jobs that were not in the military or law enforcement fields. They were ordinary, everyday citizens, just like you and me, who went to work every day to put food on their tables and a roof over their heads. They were doing their jobs to the best of their ability in order to provide for their families. Saturday, March 16, 2002 1:01 PM Sept 11 Victims' Compensation Func Sir I am utterly stunned and outraged that the Victims Compensation fund includes fetuses and illegal immigrants but excludes gays and lesbians. The last time I checked, fetuses and illegal immigrants pay no taxes (from which this fund is taken), yet I, as a legally single man (despite being partnered for four years) pay the highest percentage of my income to the Federal government and people like me who lost loved ones in the attacks get nothing. I demand an immediate and acceptable expanation for this. Deferring to the States' laws is a huge "cop-out." The States are not paying for this, the federal government is, so the States have nothing to say about it. If it were up to the States, would it not make sense to disburse the funds to the States in proportion to the number of people each State lost? If it were up to the States, would illegal immigrants from California not be excluded because of ballot propositions over the past few years (as shameful as that is)? If this "public commentary" actually has any effect, I'm sure I won't be the last you hear from on this. Change your mind. It's not up to the States. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. As that Act makes clear, the purpose of the Fund is to provide compensation to any persons who were physically injured in the September 11 terrorist attacks as well as to the surviving "relatives" of those who died. I strongly urge the Department to promulgate regulations ensuring that compensation is available to all surviving family members of those killed, including the committed partners and the non-biological children of gay and lesbian victims. Just as the terrorists drew no lines in killing people, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific deaths. In promulgating its regulations, the Department should look not to legal formalisms that may define relatives or families for purposes of other laws, but rather to the realities of the lives of those who were killed and those who loved and were dependent on them. Indeed, it is clear from the Act that this is precisely the approach the Department must take in administering the Fund. The Act specifically identifies a number of "economic" and "non-economic" losses for which compensation is to be awarded from the Fund. These include burial costs, loss of earnings, physical and emotional pain, suffering, mental anguish, and loss of society and companionship. See §§ 402(5) and 402(7). It is unquestionable that the survivors of those killed on September 11 suffered these types of losses regardless of their sexual orientation or marital status or their formal legal relationship to the deceased. Indeed, grief and economic loss know no such boundaries. The emotional devastation and economic loss caused by the death of one's partner is not any less because that person was of the same sex as the survivor. A child's anguishing loss of a parent is not any less because there was no biologic tie. Since the purpose of the Fund is to compensate survivors precisely for the types of losses suffered by family members of those killed, the Department's regulations should not and indeed cannot properly exclude anyone who was a family member in fact. In the immediate aftermath of the September 11 tragedies, as various victim-relief funds were being established, some on the extreme radical right criticized relief agencies that had made clear their intent to make funds available to assist not only surviving married spouses of persons killed in the attacks but also the surviving partners of gay men and lesbians who had been killed. These cruel and reprehensible calls for the exclusion of gay and lesbian families from relief efforts have been accompanied by claims that the effort to provide relief to all who have suffered is somehow a push for a so-called "gay agenda." However, the determination of who was actually victimized by the September 11 attacks, of who actually suffered loss, of who actually is grieving, is not about advancing some alleged political "agenda." What is at issue here is a human tragedy of unimaginable horror and dimension, and about the fair and humane treatment of all who have personally suffered from the acts of the terrorists. Many gay and lesbian Americans lost their lives on September 11. Many of them left behind loved ones, including partners and children whose lives were intertwined with theirs and who were dependent on them for financial as well as emotional support. A number of them are known to have engaged in heroic acts that day, and they have been praised as national heroes. It would be an insult not only to those heroes, but to all who died on that tragic day, for the Department to draw artificial lines defining loss and grief. In fact, it would be unconscionable. I my opinion the railroad shooting in Long Island was an act of terror. Where the survivors of this compensated? Did they sue the railroad. Seems the lawyers are the winners in many cases. That fact that the survivors are not allowed to sue airlines over this is prudent. Greediness has taken over either on the part of the victims or the lawyers. Lets put a stop to this. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
