Bias
I am concerned about potential bias in awarding compensation to the survivors of the 9/11 attacks. According to statements made by Mr. Kenneth Feinberg on Sunday, March 10 on NBC's "Meet the Press," it appears that partners of gay and lesbian victims will not be compensated. Mr. Feinberg must realize that most states do not provide benefits to gay and lesbian partners. This is not an appropriate standard to decide who is to be compensated and who will not be compensated. Survivors of ALL victims should be compensated.

Dear Mr. Kenneth L. Zwick,
I am writing in response to the Department's request
for public comments regarding the forthcoming, regulations
for implementing and administering the "September 11"
Victim Compensation Fund." I strongly urge that the Department
to draft regulations that ensure compensation is available
to ALL VICTIMS of the attack, including the committed
partners and non-biological children of gay and lesbian
victims.
It is unquestionable that the devasting grief and
economic losses suffered by the families of gay and lesbian
victims are no less than that of other families. Just as
the terrorists drew NO LINES in choosing their victims,
our country must draw NO LINES in compensating those who
suffered the most personal of losses from these HORRIFIC
ATTACKS.
MANY AMERICANS lost their lives on september 11, each
of whom left behind loved ones. I urge the Justice Depart-
ment to honor these bonds by treating the families of gay
and lesbian VICTIMS as you would ANY OTHER..

Protect Traditional Marriage

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have?Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist      , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
     accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution."
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

Equal Access for 9/11 victims

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

to whom it may concern,
i recently learned that the domestic partners of those heroes who fell in
september 11 will not be receiving the same benefits as others, based soley
on the fact that they are homosexual. it terrifies me to know that had i
lost my life on that day, my partner would not receive a thing. it is not
the compensation of benefits, etc. that is pertinent here. it is the
realization of a total lack of acknowledgement--as if to say--everyone else,
and that is EVERYONE, even an illegal alien is considered "worth it," and
their family deserving of benefits--but not the homosexuals! this is
completely heartbreaking.

Families become victims of the compensation fund.
Mr Feinberg,
and I were upset today at what you put in place for victims
compensation. We were victimized on Sept. 11th when we lost our 23 year old
daughter, , on American Airlines flight 11 to a group of terrorists.
Today we became your victims. graduated from in
December of 2000 with honors and started working for
as in . Her mother and I were very proud of
her. The US Congress started out with very good intentions to compensate
the families in place of suing the airlines and to help the airlines
economically, you have accomplished neither. had life insurance and
was flying on business so we also received insurance from the credit card
insurance. With payments from the insurance companies and other government
payments we will receive $803,000 of which one third goes to
brother. Using the tables that you, Mr. Feinberg, published today we are
eligible for a settlement of approximately $840,000. We are not looking for
a large settlement as money will not replace our daughter, but the $37,000
net settlement from your fund, is a slap in the face - victims still. You
were trying to get people not to sue the Airlines and I believe that what
you did today will force many of us to initiate lawsuits which many of us
would prefer not to do. Mr. Feinberg, you should have put a minimum
settlement in place so that each family would receive something reasonable.
As it stands now, many will receive little to nothing. Mr. Feinberg, your
table does not accurately reflect the potential future earnings of each
individual. The $250,000 doesn't come close to reflecting the pain and
suffering that families are experiencing. Please consider a minimum amount
so that each family would get something from this fund. You know very well
that many of the people in the towers and on the planes were business
people with life insurance and pension plans.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

important issues.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.

Distribution of September 11th Funds
I was saddened when I heard that my government is planning to exclude a
group of individuals based on their sexual orientation.
Like all other Americans, September 11th was a pivotal point in my life. I
began to look at my family, friends, career, and personal goals and
reevaluate their significances and reprioritize. I began to love my family
more, although we have had our disagreements and although we do not always
see eye to eye. I realized that whether I agree with everything they say or
do, I still love and cherish them.
I am lucky, I didn't loose anyone that day. My family is from Manhattan
and my employer is headquartered in Washington, DC. I heard stories, from
the people who's lives I share, about their experiences. One woman shared
with me the fear of not knowing if she to her husband will make it home and
the dreaded call they had to make to relatives to arrange for their
children's care and well-being. I cried for everyone who lived through and
died on September 11th.
I have seen our country grow and heal with each major event. I was born
during the Vietnam War and grew up watching TV and hearing stories of how
our soldiers were treated. I saw our heroes then heal during the Gulf War,
when we "supported our troops". Inconsequential of our belief in the war, we
did what was right. I am seeing it now as our country pulls together in
order not to make judgments on Arab-Americans and repeat a dark time in our
history. I saw the media being used to spread the word of healing and
tolerance in order to keep Americans together and not create civil upheaval.
All of us are trying to keep it together, and it is taking every ounce of
energy.
That is why I am so shocked that our Federal government is hiding behind
State Laws. Choosing not to rock the boat, not to do the right thing. I am
still healing though this terrible time. My life has changed. I cannot
imagine the pain of those who did loose a loved one. Life does "go on," but
not without help. Family and community support are so important after such
a catastrophic event. Same Sex Partners, whether acknowledged by their
State of residency, deserve the same respect and tolerance as all Americans
and non-Americans receiving distributions from this fund.
Dr. Martin Lutheran King, Jr. said:
"Cowardice asks the question - is it safe?
Expediency asks the question - is it politic?
Vanity asks the question - is it popular?
But conscience asks the question - is it right?
And there comes a time when one must take a position that is neither safe,
nor politic, nor popular; but one must take it BECAUSE it is right."
There were once State laws against his people, which it took the Federal
government's intervention to force a change. Over time, our hearts grew
though tolerance and acceptance and include them as full Americans. Now,
racism against African- Americans is not tolerated and laws are there to
protect them. Now is our time, to show that we are a nation undivided, that
all our citizens are counted and important, and that we a leaders of the
Free World.
As a Christians, we pray for our leaders to help them make the right
decision. I have been praying for our country's leaders since 9/11, and
today I will pray for you. Do what is right, not what is safe.

September 11th Victim Compensation Fund
I am writing to express my overwhelming disappointment in the decision
made by Kenneth Feinberg and the September 11th Victim Compensation Fund
committee. The decision regarding compensation eligibility of gay
partners who lost their loved ones in the September 11 tragedy is
mean-spirited and narrow-minded. This blatent discrimination of an
identifiable minority group of Americans is UN-American, bigoted, and
downright embarrassing. For a country that professes the desire to heal
with honor, pride, and integrity, a louder voice reigns true. This voice
is full of hypocrisy, prejudice, and injustice. People are people and
loss is loss- you all ought to be ashamed.

Equal Access to Crisis Relief Benefits for Surviving Gay and
Lesbian Partners

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

COMMENTS REGARDING THE FEDERAL VICTIMS COMP. PROGRAM
To whom it may concern:
I sorry for the late e-mail, but over the weekend I spent some time reading
the information provided at the January 20th meeting.
I would like to join with the many voices in expressing my disappointment
and outrage at the Federal Government's compensation program. To put a
limit on what a person worth in life, is a horrible thing. Every family has
the right to be well compensated. In regards to ECONOMIC LOSS...According
to the State Law on the economic loss---there is no limit to what an
individual can be compensated. " The statute does not permit economic
losses to be limited in the manner prescribed in the regulations and as such
the regulations contradict the statue. Moreover the regulations must be
rewritten to allow for the recovery of full economic loss based upon the
actual earnings of the decedent. The Act requires that the analysis for
economic losses be determined by the individual circumstances of the
claimant. The publication of pre-determined and presumed guidelines, do not
take into account the individual circumstance of a claimant. As a result,
the pre-determined presumptive awards for economic losses must be eliminated
and the regulations rewritten to permit economic losses to be calculated in
each individual case based upon the facts of the claim. Also in regards to
NON-ECONOMIC LOSSES... the Act does not limit or cap the recovery of
non-economic losses to a pre-determined or presumptive amount. The Act
requires that the award for such losses shall be based on individual
circumstances of the claimant. Congress did not limit the non-economic
recovery as is contained in the regulations.
BURDEN OF PROOF: What is "extraordinary circumstances"? What is the
stature in which the Special Master is determining "extraordinary
circumstances"? THE LOST OF MY FATHER IS AN EXTRAORDINARY CIRCUMSTANCE!
Nowhere in the Act does Congress state that awards should be based upon any
limiting factor.
DEPENDENTS: I believe that the term dependency should not be limited to
those individuals identified on the tax return, but rather, should include
anyone who was financially or emotionally dependent upon the decedent.
Although I am twenty-five years old, I was very much dependent on my father.
I still live at home and am still attending college. My father paid for
everything. What if I wasn't claimed because I was working in 1998? What
then? My brother is also in his late twenties and still lives at home. My
brother suffers from severe mental depression which has left him fully
dependent on my parents. With the lost of my father, my mother has now
taken full responsibility which is very difficult. What if my brother was
not file on my father 1998? What then? I believe that Special Master
Feinberg should take into consideration each individual's family
circumstances. My brother and I may be adults but we are still very much
dependent on my mother and father.
Why is it that my family is being penalized for having insurance and pension
plans. The regulations should make it clear that there shall be no
collateral source deduction for payments made to victims and their families
outside of a contractual agreement.
Again, I am sorry for the delay in my response, but I still hope it can be
forwarded to the particular parties.

September 11 Fund
I am very saddened to once again see my gay, lesbian and transgendered
brothers and sisters be discriminated against. It was said that the Director
stated that gay and lesbian partners were not likely to be compensated as
well as heterosexuals. Did die in vain? Did die in vain? Do we not now realize that life is too short for discrimination. You don't have to like what we do to respect us. You don't
have to espouse our ideals to give us space and the freedom to live and
love.
As a gay man in Dallas, Texas with a partner of 25 years I proudly lift my
head and say" Shame on You, Kenneth Feinberg". I hope you repent of your
bigoted Republican ways and make a fair compensation offering for ALL
people.

The Department of Justice received more than 11,000 e-mails in response to the agency's public solicitation for comments upon its plans to distribute the September 11th Victim Compensation Fund of 2001 established by Congress to benefit the victims of September 11 and their families. To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.
