As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. I would like to first express my appreciation that such efforts have been initiated and that public comment has been requested. Unfortunately, these issues are very dear to me, because I lost my father, , who was working at One World Trade Center on September 11th. I read the proposed regulations quite closely and feel that much of the plan for the Victims? Compensation Fund is fair to the victims and their families. I am quite concerned, however, with one of the specific clauses in the proposal: I believe that families? compensation should not be reduced by the amount of supplemental life insurance received. Such a reduction would punish those victims who sacrificed some of their earlier earnings to offer their family some extra security. Certainly, we do not want these earlier sacrifices by the victims to result in less funds being obtained by their family members. In addition, we do not want to discourage others from planning in the future for their heirs. I hope you consider my suggestion when you develop the final rules for the Fund. PREPOSTEROUS!!! As a retired firefighter, I was aware of a federally funded $50,000 death benefit for my survivors in case of a line-of-duty death. I am shocked and dismayed at the Federal governments million-dollar settlements for the families of vicitims of WTC. The median income for a family in the U.S. is $42148 according to the 2000 census. The average settlement of $1.6 million, tax free dollars for WTC survivors is outrageous, and unprecedented! NEVER AGAIN will I send a private donation to those suffering disaster, as I did this time, along with millions of other caring Americans who did the same thing. Why should I, now that I know that the U.S. Government will make all the survivors millionaires? Many unlucky Americans are left to endure killings in their families without Federal help. Attachment 1, January 18, 2002 Elected Official: I wish to state my disagreement with the interim rules issued by Kenneth Feinberg, the Special Master, regarding the Victims Compensation Fund of 2001, P.L. 107-42, to compensate the relatives of the victims of the brutal attacks on September 11, 2001. Mr. Feinberg took the fiduciary responsibility to act on behalf of the relatives of the victims and, as it stands, the rules fail to satisfy the letter and the spirit of the legislation. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. Collateral Sources: The victims relatives are being asked to give uninformed consent to something that has no certainty - a fund that may provide little or no compensation to some of the victims families. The deduction of insurance proceeds, pension funds, 401K proceeds and other collateral sources could eliminate awards to some families and, therefore, should be eliminated from the terms of the fund. To penalize a victim for acting with responsibility and compassion for their loved ones is unjust. 2. Consistency: The arbitrary income limits and the calculation of award amounts imposed by the Special Master are inconsistent. 3. Non-economic rewards: Mr. Feinberg has arbitrarily restricted the award for pain and suffering. In the words of Rep. Peter King every death is tragic. A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world in a scene which will be repeated in the media for decades to come is a horror these families will never escape from…The Special Master cannot take it upon himself too restrict the rights of the families. Therefore, we request that the interim rules be amended to more appropriately compensate the victims families for the immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani stated in his farewell address: we have an obligation to the people who did die. Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families. There should be no compromise about that ever. We request that the interim rules be amended and redefined to the extent that collateral sources are not deducted from the recovery; arbitrary income caps are not imposed; compensation for pain and suffering more accurately reflect the unimaginable horror which was suffered by the victims. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I am a volunteer fire fighter. My granddaughter is a lesbian. If she were in this situation, I would want her treated equally and fairly. Our nation was founded on the principle of separation of church and state. Some churches seem to get favored. I have to tell you that my church deems praying out loud as highly offensive and sinful. As you know, the United States has committed to uphold international human rights standards including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families- and all types of families- impacted by the human rights tragedy of September 11 are treated with dignity and equality.
