I know that one argument is that "we are following the state law". I feel this should not even be considered. If the government is looking the other way for illegal immigrants then how can it not do the same here? Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." The pain my family has experienced in this tragedy is difficult to communicate. The interim rule/regulation increases that pain to an intense level. Please help bring some fairness and balance to our lives. Please give me a reason to participate in the Fund. Please adjust the interim rule/regulation to provide economic and noneconomic amounts at fair, balanced and acceptable levels. Please do not require worker's compensation payments be given to the government while being taken away as collateral offsets. Finally, please include the specific calculation formulas, statistics and assumptions within the rule/regulation. The Fund, if administered under the interim rule/regulation, is structured in a way to provide a disincentive to the victims of September 11, 2001. The Interim Rule/Regulation provides little incentive for participation because it provides little compensation for our losses. Consequently, the Interim Rule/Regulation will defeat the intent of Public Law 107-42 because it understates our losses and therefore discourages participation. When Congress passed the Air Transportation Safety And System Stabilization Bill on September 21, 2001, it severely restricted our right to sue the airlines, which were responsible for our loved one's deaths because of lax security procedures. In exchange for denying Family Members this right, they provided the September 11th Victim Compensation Fund of 2001. The Fund is supposed to compensate the victims' families for the types of losses that would have been recoverable in a lawsuit. This includes economic losses such as lost income and non-economic losses. Non economic losses described in the law are very broad and inclusive. They are described as losses for: physical and emotional pain, suffering, inconvenience, physical impairment, mental anguish, disfigurement, loss of enjoyment of life, loss of society and companionship, loss of consortium, hedonic damages, injury to reputation, and all other nonpecuniary losses of any kind or nature. The statute says that "collateral payments," such as life insurance and pension plans, must be deducted from the awards. The Interim Rule/Regulation also describes the intention of the law: "The Fund is designed to provide a no-fault alternative to tort litigation for individuals who were physically injured or killed as a result of the aircraft hijackings and crashes on September 11, 2001" {Interim Rule/Regulation, Summary Paragraph A.1.}. "The attached regulations have two objectives: (1) To provide fair, predictable and consistent compensation to the victims of September 11 and their families throughout the life of the program; and (2) to do so in an expedited, efficient manner without unnecessary bureaucracy and needless demands on the victims." {Interim Rule/Regulation, Supplementary Information.}. The Interim Rule/Regulation issued by the Department of Justice (DOJ) does not comply with the statute passed by Congress because it grossly understates our losses and therefore discourage participation: a) Under the Interim Rule/Regulation, my daughter-in-law and granddaughter would receive only one-tenth the amount of non-economic losses recovered in other air crash and terrorism cases, which commonly result in awards of between $2 million and $5 million. b) The Interim Rule/Regulation understates economic losses in two ways: It caps the salaries of high-income victims and underestimates the lifetime earning potential of victims at all income levels. Noted economists at a meeting of the National Association of Forensic Economists showed on Friday January 4, 2002 that the interim rule/regulation uses outdated statistics and inappropriate methods to arrive at low estimates of our loved one's future earning. An analysis done by one of these economists showed that the actual earnings growth for firefighters is 27% higher than the DOJ estimate and actual earnings growth for financial professionals is more than 100% higher than the DOJ estimate. Because the initial award amounts are so low, many families will receive little compensation from the Fund after the collateral payment deductions have been subtracted. There will be little reason to participate. In addition the proposed compensation to the spouses, children and other innocent victims of the attacks is out of balance when compared to the generous compensation to the airlines. The airlines will be generously compensated from the same governmental appropriations as the victims. They will be paid far more than the innocent victims - up to $10 Billion Dollars as described in the law below: From Public Law 107-42 SEC. 101. AVIATION DISASTER RELIEF. (a) IN GENERAL.-Notwithstanding any other provision of law, the President shall take the following actions to compensate air carriers for losses incurred by the air carriers as a result of the terrorist attacks on the United States that occurred on September 11, 2001: (1) Subject to such terms and conditions as the President deems necessary, issue Federal credit instruments to air carriers that do not, in the aggregate, exceed $10,000,000,000 and provide the subsidy amounts necessary for such instruments in accordance with the provisions of the Federal Credit Reform Act of 1990 (2 U.S.C. 661 et seq.). The underpayments to the spouses, children and other loved ones suffering from this attack will shift the cost of subsidizing airline payments to the innocent victims of the attacks. Friday, March 22, 2002 2:16 PM exclusion gay/lesbian partner in Victim Compensation Fund While I am so glad to hear of all that is being done to assist families of Sept. 11 victims, I am outraged to learn that partners of gay and lesbian victims will not be assisted in the same way as family members of heterosexual victims. A victim is a victim, and grief is grief. Though there may be no legal bond between two partners of the same sex who have chosen to love and support one another and spend the rest of their lives together, that is only because current laws do not allow them to create the same legal bond as a man and a woman. Gay couples support one another in every way heterosexual couples support one another, and one of those ways is financially. In fact, as many gay people have been alienated by family members, their partner and other friends, often fuction as their only family. In short, I feel this causes a great sadness, that, in many ways, still America refuses to be "united" and to agreed that "all men [and woman] are created equal." Dear 911 Victims Fund: I've recently become aware* of the fact that your fund will not be recognizing same sex partnerships in the same what it will be recognizing heterosexual partnerships. I understand that Mr. Fein berg is willing to overlook federal laws regarding illegal aliens and their unlawful employers. Yet when it comes to recognizing same sex partnerships Mr. Fein berg tries to lay blame on the lack of consistent recognition of same sex partnerships by the states and their laws. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayers money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
