The victim's extend beyond those who perished on September 11, 2001. All American's are victim's and we most take care to use this money for the greater good rather than for selfish gain. Unfortunately we most go forward in this endeavor with the high possibility that this will not be the last terrorist attack that will be waged on our homeland. If we spend with no regard to what the future holds there will be no compensation for the families of future attacks because we will have tapped all our sources dry. Obviously there will be some services or donations from charities to families that will not be traceable and would create for the government more work and paperwork then the monetary withhold from the family for those services and thus should be excluded in a nominal "cap". Charitable contributions should be considered a collateral source thus reducing the amount the" victim's family" receives from the Victim's Fund with exception of services/funds received that fall under the "cap". The cap should be defined by a monetary amount and by certain types of services. Those services that fall under the cap should be those that were oof immediate need such as immediate crisis and grief counseling. I have recommendations on the process, and who should run it. I recommend that you establish a needs based system for distribution of funds. The first tier is evaluation of individual economic need, wherein you establish a victim profile based on mortgage and home costs, an education cost per child by age assuming a 4 year public institution degree, fixed health costs including costs for existing illnesses and conditions, and a general cost of living factor by family. The next tier should be collateral source, evaluating life insurance recoveries, other insurance recoveries, existing financial assets and projected future revenue from sale of businesses or other assets. After compiling this data, develop a tiered system for categorizing victims, set a fixed amount per family, use a multiplier based on number of children and other factors. Then, rather than paying fixed amounts, buy annuities to ensure stable ongoing income and funds available for future expenses such as college. This will also maximize each dollar paid. Finally, set up a catastrophic medical cost fund. This is a separate fund that will be used to pay for future large unexpected and currently undiagnosed medical expenses resulting from injury or illness to victims. You could back this up with the purchase of a health insurance policy. One last comment. Do not let trial lawyers determine who receives what. Lawyers interests are in maximizing recoveries for individual clients, in part to capture the largest fee possible. Although lawyers have agreed not to take a fee, on an individual basis, conceptually, they have limited ability to objectively consider the needs of the victims as a whole. Further, there is a component of self-interest; they are involved to expand their practice, image and for further client development. This will breed competition among lawyers, which is not healthy for the process or the victims. Claims managers such as myself are responsible for determining the value of claims based on objective criteria, known facts and with no consideration for anything other than indemnification of the claiming party. The mindset is different from that of personal injury lawyers. It is process driven, and ensures equitable distribution across a large group of claimants. Therefore, I recommend you set up a team of experienced claims managers and professionals to manage the distribution process. I would gladly volunteer my available time to participate. I assume all biological children will be considered as dependents (for example, if victim was single and had 2 biological children, filed taxes, but the kids weren't claimed as dependents, each of the kids would still get $50K). Economic: For single deceased victims, the default should be that there is zero economic loss. I am a 44 years old, single (widow), no kids, have worked for 20 years, and there would be no economic loss to my parents/sister/anyone if I dropped dead. They would inherit my estate (house, IRAs, personal property, etc.), and would no longer get presents at Christmas/etc., but would not "lose" anything because I was no longer around collecting a paycheck. This is also true for these deceased victims. The ONLY economic compensation pertaining to singles should be a) Child support the deceased was legally required to pay (as ordered by a court or other legally binding document). This payment would be made/adjusted/discontinued just as the child support payment would have been - no special considerations. There may be other situations other than child support that the deceased was legally required to pay, and they could follow their respective court orders/legal documents (like alimony, or if the deceased maimed someone, whatever). b) Dependents the deceased victim supported but was NOT legally obligated to support - for example, they might have been providing support for an elderly parent, a niece/nephew, an orphaned child. In this type of case I would use the tax filings (where the dependent was claimed) and supporting documentation to show how much the dependent was receiving. These should be considered on a case-by-case basis and a reasonable determination made (yes - we will continue to support the orphaned child or elderly parent; yes-and-no - we will continue to support your freeloader buddy only for 2 years). These economic losses should only be paid if they are not already taken care of in the deceased's will/estate (there may already be a trust or something set up). So the economic portion could potentially go back down to zero. The sum of any non-economic plus economic would still be subject to reduction based on 'other source compensation'. For married deceased victims, I would use the same non-economic numbers as above ($250K + $50K per spouse/dependent). Economic: For dependents, I would use the same approach as I outlined above, the difference being that instead of using a legally ordered child support amount you would use a consumption factor based on the salary. This would continue until a time similar to that for child support (graduates high school or college complete (if attending) or whatever). Other dependents could be handled as described above. This would be similar to that expected in a divorce settlement, which frankly a lot of marriages would probably hit anyway (lets be realistic here!). The economic portion for the surviving spouse SHOULD NOT assume they will never have to work or cannot be expected to support themselves. They will have access to the support provided for children/dependents, so it is only their support that is at issue. I would give them 4 years of the lost paycheck (no real need for projections or inflation adjustments, etc.). That gives them enough time to 'grieve' and figure out how they are going to support themselves. It also insures that kids are in or getting close to school age. These economic portions (dependents and spouse) would only be paid if not already taken care of by the deceased's will/estate. Same as above. And, like for singles, this non-economic plus economic sum would still be subject to reduction based on 'other source compensation'. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died.
