As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. It does not matter if your are a bond trader or a janior, 20 years old or 80 years old no mathmatical formula could ever equate to the loss of a loved one. Its not the size of your wallet but the size of your heart that should determine your standing in life as well as in death. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Many people seem to think that only homosexuals, themselves, care about laws that our country makes that discriminate against gays and lesbians. We are a happily married traditional couple with strong religious and ethical values. Lesbians and gays have served our country in all the ways that it is possible for human beings to serve: in the military, regardless of what they are permitted to tell; in the protective civil forces, such as the police and firefighters; in the rescue and health care professions, and more personally, as beloved spouses, sons, daughters, sisters, brothers, and even adoptive parents. Regardless of anyone's approval or disapproval of their desires, or their lifestyle, gays and lesbians are human beings with just as much right to life, liberty, and the pursuit of happiness as any other person. All Americans are supposed to have those rights, not just the Americans that ultra-conservatives approve of. Excluding their grieving families from the help offered to other American families, when they have suffered exactly the same losses, is a slap in the face to them, and an act that we, as part of the majority of fair-minded people in this country, would find deeply shameful. Many Americans lost their lives on September 11, each of whom left behind loved ones. I urge the Department to honor these bonds by treating the families of gay and lesbian victims as you would any other. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Tuesday, November 06, 2001 10:20 AM Victim Compensation While I realize that there is a staggering burden in deciding how best to distribute the funds to the victims of the World Trade Center disaster, and there most likely is the need for some federal control over the disbursement of funds; I do not feel that the victims should have to literally "beg" for a fair share of the funds. For instance: for those who were lucky enough to have been able to HAVE a funeral for a family member, it was most likely paid for by friends, savings, or some other means. Life insurance had not been paid (due to the red tape required). Why not include burial expenses to these families from the donated funds? It was an expense they surely hadn't planned on before that fateful day. Perhaps some of them had to "borrow" the funds for these expenses. To have lost your "significant other" in such a tragic manner, and most having children to tend to, mortgages & bills that are piling up.... these people need some money NOW, not after the questions have been put forth before what will appear to be 50 committees to best decide who gets what and when..... But the proposal that victims of Sept. 11 should be compensated twice -- once from private charity, again from a government fund -- while victims of so many other tragedies generally receive no compensation at all, goes against all notions of fairness. Once is right, but once is enough. Charitable awards that victims receive should be considered when deciding how much they get from the government fund.
