Sunday, February 03, 2002 2:46 PM (no subject) Dear Mr. Ashcroft, I am writing to you to let you know that I OBJECT to the Victim's Compensation Fund for the following reasons: There are many of us victims who feel the fund is WOEFULLY INADEQUATE as it stands now. The DOJ has ignored the fundamental mandate of the act to provide FULL and FAIR compensation to victims and their families, and instead created a formulaic federal program based on irrelevant concepts more familiar to the bureaucracy. The DOJ's proposed awards for noneconomic damages are only 1/10th the level paid in comparable cases such as Lockerbie. Congress explicitly enumerated a broad range of non-economic damages for which the victims and their families shall be compensated. The DOJ ignored this, and based its presumed awards on a military gropu life insurance program (SGLI) with a maximum of 250K, and a federal statue providing 250K to families of fallen public safetly officers - on top of other amounts they may receive. The DOJ's approach assumes that Congress intended the non-economic damages to be illusory, because a 250K SGLI payment would, for a serviceman killed at the Pentagon, would wipe out those damages under the collateral offset requirements. The DOJ's proposed awards for economic damages GROSSLY undersetimates the actual losses. Forensic economists have discovered other SERIOUS flaws in the DOJ's methodology. The DOJ underestimates promotions and other increases in earnings for victims. It relied on federal civil service and military retirement system boards that track federal worker incomes and pensions requirements, not the higher-paying private sector career paths. My husband was a CIVILIAN not a federal employee and this should not be used to calculate my ACTUAL losses!! The DOJ's reliance on past 3 years of income, looks SUSPICIOUSLY like a federal pension approach, rather than considering the likely income earning potential of the decedent, as is routinely done in wrongful death cases. The regulations ARBITRARLIY cap the victim's income, potentially cutting the comnpensation amount by 50%. As a result, many widows will have to sell their homes, deplete their children's college savings accounts, and give up their plans of being full-time parents while their children are young. I seriously doubt this is what Congress intended! The low level of presumtive awards will result in MANY families receiving little or nothing from the fund, once the collateral source deductions are made. Please note in a court case this "rule" would not apply! A families award may be increased above the "presumptive" award only by a showing of "extraordinary circumstances, beyond those suffered by other victims or their families. This makes the hearing or appeal to the Special Master a mere CHARADE! The DOJ should fulfill, rather than flout, the act's INTENT by REVISING its rules to compensate victims and their families for the types of damages SPECIFIED by CONGRESS, at levels comparable to those provided in the tort system the fund was designed to replace. Mr. Ashcroft, I fully support and appreciate the War on Terrorism. I am imploring you to do the right thing by the families, all 2800+ of us, who lost their husbands, fathers, sons, daughters and plans for their families future on September 11, 2001. Please do me one favor and put yourself in my place for one minute. Suppose it was your wife, son or daughter who was murdered in the terrorist attacks, would you be pleased with the DOJ's implimentation of Congress' airline bailout act? This act gave the airlines 15 billion dollars of taxpayers' money and capped the airlines liability at the limits of their insurance coverage. It set up the fund so the airlines' bailout would not come at the expense of the victims' families. Why are we so quick to help the airlines and yet try to nickle and dime the American people, who are taxpayers and voters? Please do the RIGHT THING and stop victimizing us with this charade of a fund called the Victim's Compensation Fund, it really should be called the Victim's NON-Compensation Fund, as I a mother of 5 young children ages 9,8,6,5 and 2 will wind up with little or NOTHING if the rules are not changed. In your role as Special Master charged with overseeing the Victim Compensation Fund, I hope that the following revisions will be reflected in the final regulations: Allow all injured victims to file claims for benefits, including those who continued to work despite their injuries. Ensure that all eligible victims and their families receive, at a minimum, some basic level of award from the fund. Eliminate the requirements for contemporaneous medical records and that injured victims were required to seek medical care within 24 hours. Prohibit the Immigration and Naturalization Service from using claim information against undocumented workers or their families in deportation proceedings. Ensure that domestic partners of victims are eligible for compensation. Compensation should not be based on a pre-determined amount, but instead based on individual circumstances of the victims and their families, and allow them to prove their individualized losses. Charitable contributions will not reduce the amount of compensation. Advise claimants of their expected award before requiring a waiver of legal rights, so they can make informed decisions about whether to waive the right to sue. Ensure that compensation is provided for economic and non-economic losses. Pension benefits, life insurance, and other "collateral source" payments are intended to only cover economic losses, and should not be used to reduce the non-economic portion of the award. As a society, we will never be able to fully address the financial, emotional, and physical pain that the victims of the heinous attacks of September 11th and family members will face, however we can and must ensure that they have every opportunity to apply for the benefits of the Victim Compensation Fund as Congress envisioned, and, as important, receive full and fair compensation from the fund. I hope that you will address these issues in an effort to more accurately reflect the will of Congress and to provide for all of the victims and their families, many of who are residents of my community, in an equitable and expeditious manner. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. The tragedy of 9-11 effected everyone in the World Trade Center, the Pentagon and Flight 93. The terrorists had little concern as to whether their victims were gay or straight. Why should our government have such concern? I understand that illegal aliens will be able to come forward to gain their just compensation. I have no complaint on that front-they are just as injured as anyone else. It is strange, however, that their path to restitution has been smoothed, while gay and lesbian Americans have had barriers placed in their way. Surely similar accomodation to that granted to the illegals can be found. Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. He worked in the private sector as did the majority of the people who worked in the Twin Towers. The DOJ, however, elected to use outdated and obsolete military and civil service data and has applied it to the private sector. We have become painfully aware that the interim rules of the plan are fraught with many deficiencies which need to be amended. The most egregious of which are: 1) underestimating the earnings of civilians in the private sector (2) using inappropriate data that underestimate earnings growth in the private sector (3) not allowing for recovery for lost household services (4) penalizing families who exercised good financial planning and (5) signing away our rights. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Thursday, January 17, 2002 10:26 AM victims' compentsation fund My 31 year old husband was killed in the World Trade Center on September 11th and I am writing to express my extreme dissatisfaction and disappointment with the compensation fund's regulations as currently set forth. To begin with, there should at least be a minimum award given to every victim's family, regardless of what other collateral assets they have. It is absurd that a victim's life insurance is being deducted from the award for many reasons--if we were to sue in court, this would not happen, and this fund is supposed to be a viable alternative to suing; life insurance is an investment like many others, why is this one being singled out as one to "count" against the award; why are families being punished for being responsible? The families hit the hardest by this decision are those that have children, since these are the people that generally have life insurance, and these are the families that need the money most (though the fund was never intended to be need based--it was supposed to compensate families for economic loss). My husband didn't have life insurance and so this doesn't affect me personally, but I am very concerned about the many people I know who will be in a horrible situation if the current regulations aren't changed. However, it is clear that the deduction of life insurance is not likely to be taken out of the staute. So at the very least, a minimum award should be set forth so that every family receives some compensation. Secondly, it is bad enough that life insurance is going to be deducted from the award--but no other voluntary contributions should be deducted. My husband was an employee at &nbsp&nbsp&nbsp&nbsp . The surviving partners have decided to donate 25% of the company's profits out of concern for their former co-workers' families. It is absurd if this money is then deducted from the families' awards. Why should the &nbsp&nbsp&nbsp&nbsp partners be giving money to the government when they made a private decision to give it to the families? And lastly, the earnings chart as set forth by the currrent regulations are ludicrous. Why is Mr. Feinberg using national economic statistics rather than New York statisitics to cap the earning potential of our loved ones (though Mr. Feinberg told a room full of &nbsp&nbsp&nbsp&nbsp families that there would be no cap). It makes no sense that salaries are capped at the 98th percentile--to all of us it is very clear that the government is simply trying to give us as little money as possible. But if the 98th percentile is going to be selected, it should at least be the 98th percentile of salaries from New York City. Our loved ones were targeted because they were successful, high wage earners who worked in the World Trade Center. It is therefore completely unfair to talk about national averages. In response to this issue, we are told that once we sign up for the fund, we can "plead our case" as to why we deserve more money. But none of us should have to sign up for the fund and waive our right to sue without having a much clearer idea of the type of award we can expect to receive. Therefore, the earning chart should go well above $231,000. In the statute, it clearly says that families will be compensated for economic loss. There is one very straightforward to calculate this loss--to mulitply their projected earnings and the projected amount of years they would have worked until retirement. This statute was passed because the government failed to protect our loved ones while they were at work. Of course, it was also passed as a bail-out to the airline and insurance companies. At the present moment, the latter is all that this bill seems to focus on. Our right to sue has been crippled and we are being asked to accept these unfair regulations. Given everything we have gone through, are still going through, and will continue to go through for years to come, the least that can be done is to adjust these regulations so that we can be more adequately compensated for economic and non-economic loss. The latter of which we can never really be compensated for--our loved ones are dead and our lives are changed forever. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Many Americans lost their lives on September 11, each of whom left behind loved ones.
