I am ashamed that my government would see fit to so openly discriminate against Gays and Lesbians, people who were equally devastated by the events of September 11. I rejoice over the new found freedoms of the women of Afghanistan, but wonder how we can call other governments discriminatory when we won't even acknowledge such a large, politically active, community-oriented group in our own country. Is there something that tells you that gays and lesbians grieve less, sacrifice less, or in any way are less affected than other U.S. Citizens by these events? How can you in good conscience say that you will forgive immigration violations to compensate illegal immigrants, yet ignore and marginalize a group of citizens who were legally employed? How can you look into the faces of the loved ones of those who died - people who loved and cared for the victims as much as any spouse - and tell them that they don't count simply because of their sexual orientation? I think the obvious answer is that you decline to look at them at all. Nevertheless, under the laws of the State of New York, will not have a right to receive any portion of her fianc's estate, and, under the interim regulations of the Victim Compensation Fund, because distributions must be made "in a manner consistent with the law of the decedent's domicile", she will not have a right to any portion of the benefits from the program. I respectfully submit that this result is neither equitable nor morally correct. As you are no doubt aware, the plight of the nearly wed was movingly exposed in an article printed on the front page of today's The New York Times. While the Special Master has the authority to "appropriately compensate the victim's spouse, children or other relatives" regardless of state law, a fiancee of a victim, who is not related by law, has no such discretionary right. In addition, there is no procedure under the regulations to ensure that the fianc or fiancee's claim will be heard. It seems inconsistent with the intent of Congress that the person who was perhaps the closest to the victim should be denied all right to compensation. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Friday, March 15, 2002 5:56 PM Benefits for partners of gay 9/11 victims I have just read of the decision not to bestow benefits on the survivor partners of 9/11 gay victims unless the victim's state of residence recognizes such unions. Since no such distinction is being made with illegal aliens whose residential legitimacy goes against the law of their home states, it can only be concluded that this decision is a case of selective discrimination directed against gays. Friday, February 08, 2002 12:38 PM Disbelief To whom it may concern: After listening to comments about the compensation program, I am saddened to hear and read about victims who are upset by the outcome of the program. If, as happens everyday, a spouse or parent had been lost under many other very dreadful and horrific situations (fire, murder, DWI wreck, earthquake, etc.), the family may or may not receive any compensation. Are these "everyday" victims less important, are the ramifications to their families less devastating, are their needs less? I would venture to guess the vast majority of families who lose their caregiver would not receive $1.6 million. If families were well prepared, good for them for being farsighted to provide for their loved ones in case of an "everyday" death. I applaud the government for reaching out to these families, however, I feel it should be viewed as a privilege, not a right, to receive such compensation. Tuesday, March 12, 2002 9:00 PM Re: September 11th fund for Victims I am appalled at the comments made by Kenneth Feinberg on NBC's "Meet the Press," March 10, 2002 with respect to allowing or should I say preventing benefits for the life partners of gay men and lesbians who died in the September 11th attacks. To take the stand "to refer to state law" is a down right cop out and blatant bigotry on the part of those in power over the funds. Had I known that Gay men and Lesbian partners of those who died in the attacks would be excluded (once again) I would have thought twice about giving the donations I have given and would have encouraged an organization like HRC (Human Rights Campaign) to start a Gay partner fund.
