Tuesday, December 18, 2001 8:29 AM Military Unique Issues (Public Law 107-42) I recommend that the Department of Justice exempt these unique military payments from the category off "collateral source compensation". (1) Any burial benefit or gratuity awarded by the Veterans Administration ("VA") or any death gratuity paid to a uniformed service member by their respective service. Eligibility for VA benefits is contingent upon service in the Armed Forces of the United States. Although they are called "gratuities" they should be viewed as "deferred compensation" and exempted from consideration as "collateral compensation". (2) Servicemen's Group Life Insurance (SGLI) Payments. Under this act insurance payments reduce the amount of compensation. It is necessary to note some critical differences between civilian insurance and SGLI. Unlike civilian insurance policies SGLI has legal restrictions on who can obtain coverage, is neither term or whole life and has no cash value. Additionally, separating or retiring service members cannot retain SGLI coverage after they separate from their respective component. Unlike the vast majority of civilian policies SGLI benefits are paid when death occurs as a result of combat, acts of God or acts of war. These differences clearly distinguish the SGLI program from civilian policies. It may be more accurate to view SGLI as "risk sharing among a closed population" than as a traditional civilian "insurance" policy. (3) Survivor Benefits Plan (SBP)- Under some circumstances the survivors of some uniformed service members may be eligible for SBP. Any benefits collected under SBP should NOT be considered collateral source compensation. If SBP is paid it is an indicator that the service member was eligible to receive retirement pay which is not considered to be a pension. If the qualifying factor is retirement eligibility than SBP payments should not be treated as a "pension" since retirement pay is treated as reduced compensation rather than a pension. (4) If SBP is considered "collateral compensation" then the special master should be compelled to pay the difference between the current calculated values and the SBP value at mandatory retirement. [which is by either time in service or age) Military peculiar losses: (1) When calculating economic loss the special master should be required to calculate and compensate for the economic value of VA pensions or disability payments being paid to any veteran. The value of that economic loss should take into account the difference between the projected life span of the veteran minus their age multiplied by the monthly payment. If the surviving family qualifies for a pension based upon the death of the veteran the economic loss would be the difference between the two values. This value should account for projected annual inflation over the projected life of the veteran. (2) Insert language that acknowledges service members have second careers when we retire. Federal law limits the length of our careers and imposes a maximum age limit. This means there are two components that must be calculated to accurately identify the value of a service member. A. Military compensation to a retirement date + military retirement pay. B. The value of a second career. Recommend you insert language that (1) allows DoD to submit a statement that identifies the compensation the service member would have been paid and an annual value for the retirement pay the individual would have drawn after achieving retirement eligibility. This value must allow for promotion. Just because a victim dies as an E4 it doesn't mean their value should be determined using the actuary age for their sex minus their age times E4 base pay. Wednesday, November 07, 2001 7:22 PM Displaced Resident of 600 Bldg Gateway Plaza I lived in the 600 building in Gateway Plaza and although I am receiving rental assistance from FEMA, FEMA does not help with damaged personal items. My apartment was not on fire (I face the river), but apartments across the hall from me were either on fire or 'bombed-out' by WTC debris. Therefore, smoke odors are thick in my apartment and on my personal items. What was worse, is that my windows were left wide open that day (even my FEMA rep. who surveyed my apartment seemed surprised at the amount of ash on most of everything I owned.) I have had to throw away all my rugs, my bed & boxspring, bedding (pillows, blankets, sheets), a couch (will likely have to throw away another couch if despite having it cleaned..the stench is still in it), all of my food, and other personal belongings. I am running up dry-cleaning bills of my clothes (closets were left open that day) in the hundreds of dollars. I have no insurance and need to replace much of what I used to own. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. We were told that September 11 was the day that "hyphenated-Americans" were no more; rather being Italian-Americans, African-Americans or gay-Americans, we were now simply Americans, all of us together as one American family. It is with this in mind that I ask you to extend equal benefits to same-sex partners and families of September 11th victims as opposite-sex partners and families. You have offered benefits to the families of illegal, undocumented workers. I think that this is right and I commend you for it. I also feel that you should go one step further, and extend the same compassionate hand to same-sex partners and families. The hyphens seem not to matter when our government wants to use heroism to inspire others, but when it comes time to actually aid the families of those heroes, the hyphens come back with a vengeance, and it seems that some American heroes are now more equal than others. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Fri Jan 18 2002, 1:18 PM PST show headers My comments to "Federal Victims (Heroes) Compensation Program" My comments regarding the Federal Victims(Heroes) Compensation Fund are as follows: 1) The $250,000 non-economic payout is way too low. My sister was only 31 years old and was the mother of a 10-month old little boy. He will never get the chance to even know his mother. 2) The charts that are being used to calculate the economic payout are extremely outdated. Today, women work much longer then they did when these charts were formulated. Also, work performed in the home needs to be calculated into the formula as well. 3) The fact that payments such as Life Insurance and Social Security Survivor's benefits are subtracted from the total is insane. In reference to the Social Security Benefits, it's like the government is giving with one hand and taking back with the other! In reference to the Life Insurance, why should people be penalized for the foresight of their loved ones? 4) Also, the fact that you have know way of knowing what your financial payment will be until after you sign up for the program, thereby, giving up your right to sue if the total is too low is ridiculous. You should know exactly what your options are so that you can make an educated decision. You're talking about people's lives here! I attended the rally in the Park Avenue Armory last night and everyone in attendance, and I'm sure many people0 who were not able to attend, have many of the same grievances. In fact, Governor Pataki, Mayor Bloomberg and many other government officials voiced the same concerns. Monday, March 18, 2002 12:55 AM Protest 9/11 Fund Exclusion I have been given to understand that the surviving partners of gay victims of the September 11th attacks upon my country will not be honored in the compensation to survivors. I have also waited for the "dust" of confusion to clear before making any sort of a contribution to any 9/11 funds. I feel that this has been a wise choice on my part, for I have seen the greed that this has caused. I am sorry that, if true, decisions like this could be made. I remember the strongest words of rebuke that were made in the past by a living icon of American culture when minorities in our society chose to ridicule him. He said simply, "Shame on you." I am happy to say that even in death that same icon of American culture is revered more than ever. That was Louis Armstrong. To be shamed is perhaps the lowest that one can sink in a society. Shaming maybe old fashioned today; however, people turn their backs as if the shamed person no longer exists. Denial of one's existence is still extremely strong in my eyes. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Zwick Director Office of Management Programs Civil Division United States Department of Justice main Building, Room 3140 950 Pennsylvania Avenue Washington, D.C. 20530 Dear Mr. Zwick: I write to comment on the Interim Final Rule Governing the administration of the September 11th Victim Compensation Fund of 2001, Title IV of Public Law 107-42, the Air Transportation Safety and System Stabilization Act (the "Act"). It is my understanding, and indeed Special Master Kenneth Feinberg noted in his statement which accompanies the Interim Final Rule, that the purpose of the Act, "is not simply to examine economic and noneconomic harm, but also to provide compensation that is just and appropriate in light of claimants' individual circumstances." (Emphasis added.) It is my further understanding that an additional purpose of the Act is to provide stability in the airline industry by encouraging victims' families to seek relief through the fund rather that in protracted litigation with the airlines and others. After reviewing the Interim Final Rule and considering numerous comments I have received from victims' families, it is my belief that the Interim Final Rule does not serve those purposes. Moreover, I believe that the "collateral source" provisions of the Act are inconsistent with these purposes, and should be re-examined by Congress before final rules for the distribution of funds are adopted. As Borough President of Staten Island, I represent the borough of New York City that was hardest hit by the September 11th attacks. Chief among the complaints I have heard from my collateral sources to be deducted from awards from the fund. Clearly, deducting such benefits from fund awards is not "just and appropriate in light of claimants' individual circumstances." If taking "individual circumstances" into account is to mean anything, it must mean that victims who provided for the welfare of their families should not have their plans frustrated by the Act. Penalizing the survivors of responsible individuals who have sacrificed financially to provide for their retirements and their families in the event of their untimely deaths is unjust and inappropriate, and will ultimately achieve the perverse effect of discouraging settlements. Another area of great dissatisfaction is the amount of the awards that are to be made under the Interim Final Rule for presumed non-economic loss. Based upon the many comments I have received, the general consensus among victims' families is that the presumed non-economic loss is far too low. Indeed, it has been widely noted that settlements of less grievous personal injury claims frequently exceed the amount of the award fixed by the Interim Final Rule. In view of the fact that the number of victims has fallen significantly since the Act became law, funding for increased awards should be readily available. To promote the purposes of the Act of providing "just and appropriate" relief and encouraging settlement, the Special Master should increase significantly the presumed non-economic loss award. I believe that the very small number of claimants who have filed for compensation from the fund is clear evidence that the issues outlined in this letter are in fact impeding the purposes of the Act. The lives of many of my constituents will be affected dramatically by rules that are ultimately adopted by the Special Master, and on their behalf I urge Mr. Feinberg to give serious consideration to the issues raised herein.
