Washington, D.C. 20530 Dear Director Zwick: On behalf of the Association of Flight Attendants (AFA), representing 50,000 flight attendants at 26 airlines, we are writing to comment on the Department of Justice's November 5 Notice of Inquiry and Advanced Notice of Rulemaking regarding the September 11th Victim Compensating Fund of 2001. AFA represents some of the flight attendants lost onboard aircraft during the attacks of September 11th. The purpose of the notice is to ask for public comment in the development of any rules established under the program "including, but not limited to, potential beneficiaries of the program, their employers, the legal community, and all those who have come forward to help those impacted." The September 11th Victim Compensation Fund is an important program in helping victims and their families recover from the attacks. However, we have concerns that the current proposed statute does not clearly identify that domestic partners in same-sex relationships or non-biological children are eligible to receive compensation from the Fund. We believe that when Congress approved the Fund it was for the purpose of helping all families to recover their economic security and ease the economic difficulties of all survivors. Compensation delivered through the fund must assist all individuals adversely affected by the September 11th attacks without regard to sexual orientation or biological relationship. At some carriers represented by AFA, domestic partners are included in benefit and survivor packages. Clearly, companies have recognized the reality of family structures and relationships in today's society. It is important that when implementing the Fund, the Department must also recognize these relationships and provide compensation to individuals that were economically and emotionally dependent on the victim. In conclusion, while we support the September 11th victim compensation Fund, we believe it is crucial that all surviving family, members, including same-sex partners and non-biological children of those who lost their lives, have access to compensation from the Fund. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I was dismayed and outraged to hear that Kenneth Feinberg, the special master in charge of the federal victims' compensation fund, has decided to let bigotry and discrimination be his watchwords when it comes to recognizing the families and partners of gay and lesbian victims of 9-11. As its name indicates, the federal victims' compensation fund is federal money, not state money. ALL people should be treated fairly, equally, under the blanket of federal jurisdiction regardless of which state they happen to call home. The Bush administration has been getting a lot of mileage out of the rallying mantra of a United America, expecting support from all yet refusing to give fair treatment to all. There were gay and lesbian victims and heroes on 9-11--there was no discrimination based on sexual orientation in those terrorist acts. There continue to be gay and lesbian people working at ground zero and risking their lives in this war on terrorism. Their loved ones deserve the same honor and recognition as all other beloved survivors. Anything less is a shameful example of the hypocrisy of Feinberg's position--he will compensate illegal aliens but not gay American citizens. He will compensate fetuses but not the children of gay families torn apart by 9-11. It is outrageous! As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions of the rights of the victims" relatives to recover damages from court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. Remove arbitrary income limits. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held and where they worked-the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Congressman Peter King,"Severy death is tragic. A murder is particularly tragic. But to have your love one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come - is a horror these families will never escape fromSThe Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families' for the immeasurable pain and suffering endured by our loved ones. December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Innumerable 'gay' men and women have died for America; have died so that others may be free, gay or straigt- that we Americans would be free. The partners of gays and lesbians who died in the 911 terrorist attacks experience the pain and loss of a loved one the same if not more than, 'straight' Americans whose spouses or family members died. I do believe it is important and fair to compensate the victims based on past income for 3 to 5 yrs. Insurance etc should not be taken into account because this is a subjective issue. We are deeply concerned to learn of the blatant discrimination being practiced by "our" government in determining which heroes of 9/11 are worthy of having their bereaved loved ones shown respect.  In the aftermath of that horrible tragedy it is incomprehensible to us that heroes such as ( part of the valiant team that brought down the flight in Pennsylvania), , killed in the line of duty at the time of the collapse of the first tower),  and ( of the plane that crashed into the ) are summarily discounted by the Victim Compensation Fund.  We are sure there are probably others whose heroic deeds you dismiss simply because of their sexual orientation.  How does that make their sacrifice any less than that of anyone else? The life partners of lesbian and gays love just as dearly, grieve just as deeply as those of us who are honored simply because we happen to have been born heterosexual and are not denied the privilege of marriage.  Why should they not be given the same compassion, the same respect, and yes, the same benefits as any other spouse?  In our shock and dismay at the time of the attack, Americans seemed to unite in our shared loss and vulnerability, recognizing the worth of each citizen.  It was a hopeful sign in the midst of a world gone amok.  Now  our old and tired prejudices and separation have apparently returned, more venomous than ever.  What a sorry state. Dear Mr. Zwick: We represent , , and , three victims of the terrorist bombing of the U.S. Embassy in Kenya on August 7, 1998. The September 11th Victim Compensation Fund of 2001 is an appropriate measure to provide compensation for individuals who were killed or physically injured as a result of the September 11th terrorist attacks on America. The scope of the legislation, however, should be broadened to include the handful of other Americans who have been directly harmed by similar strikes by the same foreign terrorists on what is commonly understood to be American soil. Just three years before the September 11th attacks, the U.S. Embassies in Kenya and Tanzania were the targets of other terrorist bombings - this time by truck instead of aircraft. The attacks killed 22 Americans and seriously injured 26 more. Ms. Bomer was left blind, and Mr. Pressley has endured seven surgeries and remains permanently disabled. The survivors, as well as the families of the deceased, continue to grieve and to seek ways to deal with their losses. These Americans were employees of the U.S. Department of State and were doing America's work - building peace, supporting justice, and promoting America's interests and foreign policy. However, because of the United States' role in promoting democracy worldwide, and because of the symbolic value of their office buildings, the embassies were targeted by those who oppose our principles. As President George W. Bush confirmed in his address to Congress on September 20, 2001, the same terrorist organization is responsible for the bombings of the World Trade Center in New York, the Pentagon in Washington D.C., and the U.S. Embassies in Kenya and Tanzania. There is no rational basis for treating the victims of these attacks differently. Our government must provide equal treatment to all Americans who have been killed or injured by these same foreign terrorists. The Bush Administration should seek an expansion of the September 11th Victim Compensation Fund of 2001 to include the American victims of the August 7, 1998, terrorist attacks on the U.S. Embassies in Kenya and Tanzania. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. For example, the fund has indicated that compensation will be paid to illegal aliens and that immigration violations will be overlooked. Yet the fund seems to maintain that, when it comes to gays and lesbians, State laws will not be similarly overlooked. This discrimination is a travesty and must be rectified. Friday, January 04, 2002 10:44 PM Protest to the proposed regulations for the Victims' Compensation Fund I am writing this to protest the proposed regulations for the Victims' Compensation Fund. The settlement is inadequate in all regards. It is minimal in economic damage and heartless in compassion for the extraordinary pain and suffering and loss of companionship the 9-11 WTC destruction caused. Rather than being a Solomon, the Special Master is more like a Judas Iscariot selling out to the interests of the Airlines. The reason there are such gross disparities in the projected settlements is that the proposed regulations include so little compensation for loss of human life! It is instructive to realize that Bill Gates is worth more than 180 thousand human beings using the Master's logic. There are no provisions for extended families and loss of non-remunerative services. I will take the option of trying my case in court , thank you.
