Dear Mr. Zwick:

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

While I know these citizens are considered by the current administration and 
Atty. Gen. to be second class citizens and hated because of the rampart right 
wing religion beliefs of the Administration, they are by law, citizens of the 
USA and entitled to all benefits, etc., guaranteed them by the constitution 
of the United States.  Any attempt by the DOJ to exclude all and any victims 
effected by the Sept. 11 attack will only become a stain upon this nations 
history.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Crisis relief


December  19, 2001

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

RIGHT IS RIGHT

I am outraged, and greatly saddened, at the news of our government's
failure to acknowledge the millions of homosexuals in this country as
equal and able persons. If a man can be such a great hero, shouldn't
that be it? He's a HERO, saving many many lives by giving his own. Now
that it is known that a hero is GAY, he is somewhat less of a hero than
others who helped save lives on that fateful day, a day we will not
soon forget. 

I am outraged, as a person living in this country, where our freedoms
and rights are garunteed (if you fit the mold, apparently), and I am
also outraged a person living in this country who happens to be
homosexual, to know that acts of courage and sefllessness are to be
judged and torn apart and devalued on the basis of someone's sexual
orientation. 

The families of those who were killed on September 11 will never get
their loved ones back. And it will no doubt take a long time for the
lives of these people, as well as millions of other Americans, to
return to a somewhat normal existence. The least that this country can
do is compensate all those deserving of it in the same manner, equally
and fairly. LOVE is LOVE and FAMILY is FAMILY. IT DOES NOT KNOW
BOUNDARIES SUCH AS THOSE PLACED ON IT BY THE LAWS OF A FEW MEN. 

TREAT THOSE FAMILIES EQUALLY. Have you thought about how those heroic
people's actions have affected your lives? Must an individual's
personal life come into the picture when determining the value of that
person's actions, for that matter the value of his or her life????

The right thing must be done.

Help all victims of terrorist attack


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11
terrorist attacks must include all relatives of all the victims.

This importantly should include the partners and children of same
sex unions.  They suffer just as grievously for their deceased
loved ones as do other survivors, and their need for assistance is
just as great.

Please do not give in to the importuning of callous homophobic
groups and individuals who would have the Department of Justice
limit compensation to survivors of heterosexual unions.  They are
interested in a political victory, not humane assistance.

This Fund is intended for humane purposes; it is not a political
statement, Mr. Zwick.

I have given a considerable amount of money for the families of the WTC. I 
was under the intention that this money would be divided equally among them. 
How can you base giving money to families by how much they earned and size of 
their family? I know of a case, where the husband died and the wife has quite 
a bit of her own money..should she get more cause her husband made a lot of 
money?? She doesn't need it as much as the poor guy who made little. It needs 
to be divided equally amongst all!! I'm almost sorry now that I donated, if I 
had known this BS was going to happen..I may have looked for other methods to 
support these poor souls. EQUAL DIVISION IS THE ONLY FAIR GAME HERE!! It 
doesn't take a rocket scientist to figure this out....These poor people have 
suffered enough..this is like putting salt in their wounds, and now you are 
protecting the insurance companies (The poor things) too. We need a human 
being in charge of this disbursement...not a machine!!

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.

I write this letter because I feel deeply about many things and feel I 
compelled to respond to the Department's request for public comments 
regarding the forthcoming regulations for implementing and administering the 
"September 11 Victim Compensation Fund." 

It is better to express my feelings than to keep them bottled up inside.  To 
remain silent is to be part of the evil in the world.  I cannot change the 
world, but I can call out in complaint and praise for what I see and hear.

If I back down from what I believe, then either I have lived a lie... or I'll 
be living one from now on.  I do not think I have been wrong, so I have to go 
ahead.

I am disgusted by the actions of the charitable organizations that are 
dealing with the families of the dead and their survivors.  A great deal of 
money has been collected and very little has been given out.  The Red Cross 
even tried to transfer funds for other purposes, then why the money was 
given. I should not be surprised the charged GIs during WW II for the coffee 
and donuts they supplied to them.

Tremendous amounts will go the families of the uniformed services that were 
KIA at the World Trade Center.  It is sad that these families will get a 
great deal of more money than other families of the uniformed services that 
were KIA in past emergencies are forgotten. It is as if their deaths do not 
count as much as the individuals killed at the World Trade Center.

I strongly urge the Department to draft regulations that ensure compensation 
is available to all victims' families and survivors of the attack, including 
the committed partners and the non-biological children of gay and lesbian 
victims.

It is unquestionable that the devastating grief and economic losses suffered 
by the families of gay and lesbian victims are no less than that of other 
families. Just as the terrorists drew no lines in choosing their victims, our 
country must draw no lines in compensating those who suffered the most 
personal of losses from these horrific attacks.

I am disturbed to learn that my union had to collect money to help the 
families of workers at the Center. Just because you are, a cook or a window 
washer does not mean you do not need help.  One man who was to sick to go to 
work that day lost his job as a result of the destruction of the towers.  He 
has not been able to find a job since then and now may be loosing his home. 
Others who lost their loved ones are also in great need because they do not 
have the resources of others that earn a great deal more

Many Americans lost their lives on September 11, each of whom left behind, 
loved ones. I urge the Department to honor these bonds by treating the 
families of poor, gay and lesbian victims as you would any other.

Equal Access to Crisis Relief Benefits for Surviving Gay and
Lesbian Partners

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Unacceptable discrimination

It is unconscionable that the September 11 Victims Compensation Fund has
adopted regulations that discriminate against the life partners of gay and
lesbian victims of the attack.   Many gay men and women lost their lives and
lost loved ones.  Their lives were disrupted as horrifically as those of
every other victim.  They paid the same price  as every other victim.  How
can you possibly see fit to denigrate them now in this sordid manner.
Illegal aliens, fetuses, common law heterosexual unions -- all are
recognized, and rightly so.   But where is the justice for our gay brothers
and sisters, sons and daughters?   This is a shameful step that must be
reconsidered and altered.

Protect Traditional Marriage

Dear Mr. Zwick:

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have?Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist &amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
&amp;nbsp&amp;nbsp&amp;nbsp&amp;nbsp accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution." 
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

I am outraged that the gay and lesbian partners of victims of Sept. 11 will not automatically receive the same benefits as spouses and children of victims.  This policy needs to be changed!

Fairness

First of all, it was politics to create such a fund when victims of
terrorists in other disasters were not compensated. Furthermore these
victims did not volunteer so even tho it was a terrible thing, they were
not all heroes because they were there.
If the fund is a "done deal" then certainly gay spouses should not be
excluded if it can be proven they were a "couple" . You are being
generous with my money and I say all or none.

I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund." 
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.

It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families.  Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.

Many Americans lost their lives on September 11, each of whom
left behind loved ones.  I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

Compensation for all 9/11 victims

I'm appalled at the stance that the government seems to be taking in regards to extending compensation to gay and lesbian partners of those died in the 9/11 terrorist attacks.  The hypocrisy inherent in such a proposition--that only heterosexual relatives and partners of the dead are worthy of compensation--is an outrage.

Regardless of states' laws, all families and partners of the victims of 9/11 should be compensated equally.  To exclude gays and lesbians while including illegal immigrants is morally reprehensible.

having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Fair Treatment for all Victim Families

Sir,

The attack on the World Trade Center and Pentagon on September 11th
was an attack on the United States.  The attackers didn't disciminate in 
choosing their victims.

The victim compensation for those affected by the attacks should also be 
non-discriminatory.  It is with great distress that I've learned that the 
families of gay and lesbian citizens are being threatened with exclusion 
from compensation by certain politicians and their constituencies.

Speaking as a veteran and businessperson I find the exclusion of any victim 
or their families and loved ones, whether for sexual orientation or any 
other reason, to be nearly as reprehensible as the attacks themselves.  The 
threat of exclusion finds its source in the same festering hatred that bred 
the fundamentalist extremism underlying the attack.

When considering this issue I hope that the Justice Department will commend 
to itself the final four words of the Pledge of Allegiance taken by all 
Americans, "and justice for all".

Thank you for taking the time to solicit comments on the fund rules.
My main concern is when families review the chart to see the "award" then deduct
"collateral" sources,  it leaves nothing for many of the families.

Families who had life insurance &amp; pension plans should not be "punished" by the
fund. A court of law would never deduct life insurance &amp; pensions from any
settlements, so the fund shouldn't either!
   I suggest that you go back to congress &amp; have them amend the law to deduct
   collateral sources from the awards.
   I also suggest that you set up a guaranteed minimum for all families who will
   receive nothing after deducting collateral sources.


I calculated my families award, then deducted life insurance &amp; pensions and it
left my family with ZERO. As a result, I am getting the paperwork ready to file
a lawsuit against the airlines. This is a prime example of the aggravation that
the fund has caused my family. Either we accept ZERO from the fund or file a
very winnable lawsuit against the airlines.

Unless the law to deduct collateral sources is amended, I feel that many
families will also file lawsuits.

Isn't this what you were trying to stop in the first place?
