I think in light of the assistance the airlines have received and the president's desire for an economic stimulus package primarily for businesses that this program should err on the side of generosity. These are not businesses, these are people and their loss has been great. Regardless of whether or not collateral source compensation is available, every attempt should be made to minimize the effort a victims family must expend to receive compensation. Whenever I, members of my family, or friends have donated to a relief entity for the victims families we have never done so with stipulations or restrictions in mind, the sole factor being that the aid should go directly to support of these individuals. Certainly some of the people in the World Trade Center, the airliners and perhaps the Pentagon were well off, adequately insured etc. but this compensation should also be a statement by this country of our concern and compassion. Time will pass for most of us and our lives will become ever more normal, not for these people however. Their loss is permanent and lifelong. Certainly there are children who's education can be looked after through this compensation- I don't think any orphan of these attacks should have to be concerned about a college education. There are spouses and parents who have endured the sudden tragic loss of a loved that no amount of compensation can replace- we should be concerned above all that they do not have to beg for relief from their very real pain and suffering. I know if I were in their shoes and was presented with a half-hearted, bureaucratic attempt to compensate couched in the usual form of "well, if you REALLY need this then just fill out these forms" I would, out of pride and respect for my loved one, opt out of the program. This shouldn't happen. We should be the first to show our pride and respect and make this offer unflinchingly and with true generosity. I also believe that compensations should remain private and sealed, away from the analyses and critique of the media- too often it is the media's slant that provokes consternation where none exists. I don't care if there are a few who receive inordinate compensation relative to their need or loss if, in the main, everyone receives a just and fair award. Perhaps those who feel they have been personally overcompensated will contribute the excess in their own way- who knows? We shouldn't care. We are a great nation, we have been attacked by cowardly murderers who struck at the innocent and peaceful- our message in this instance should be clear. We are strong, we are compassionate and we take care of those who are in need and depend on us. Not all the victims of the terrible attacks were American, our generosity or lack of it will be scrutinized throughout the world and discussed via the friends and families of all who were lost. It is far better for those discussions to reflect the compassionate largess of a great nation rather the piddling minutiae gathering of obsessed bureaucrats. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. A government give-away in return for a lawsuit waiver is just another BAILOUT for the airlines. I am furious enough about the previous ones without having to pay for yet another one. If the courts feel that the airlines are culpable in the terrorist attack and that lawsuits against them are viable, then the justice system should be allowed to work and the airlines should suffer through it like the rest of us. That's why we have a court system. Buying off potential lawsuit plaintffs is highly unethical. Big Business is always screaming about "letting the market forces work without government intervention". Well, LET'S DO JUST THAT. b.. The airlines were warned long and hard about HUGE security failures which they refused to address because it would cut into their profits. They took the risk and now its time for them to pay for their greed. They deserve to be sued. The US won't close down even if ALL the airlines shut down. People will find other (better) ways to get where they need to go and they will cut out a lot of what is frivolous business travel to begin with. c.. Vast sums of money have been raised specifically in the names of victims of this tragedy by celebrities, individuals, churches, businesses, school groups and every other group I can think of. It sounds like millions and millions have been raised, however no audit whatsoever has been performed on the collecton and distribution of the funds. These massive funds already raised should provide more than adequate compensation if they are being distributed properly. The DOJ should head up the project to account for and see that these funds have been properly distributed instead of looking to grab more tax dollars. d.. The large majority of the victims who perished in the World Trade Center were wealthy lawyers, bond traders, stock brokers and other highly-compensated persons who not only already had considerable wealth in the bank to provide for their families, but SHOULD have had the foresight to provide considerable life insurance for them as well. God knows, I'm paying out the nose for insurance for my survivors and on a lot less salary than the WTC victims made. If they failed to provide insurance, I shouldn't be asked to support their survivors with my tax dollars. e.. To hand large sums of money over to survivors of a terrorist attack is discriminatory to victims of other unsavory demise. We don't compensate flood or hurricane victims that way. Nor do we go overboard in compensating the widows and children of military personnel killed in battle. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner."
