Zwick, Director Office of Management Programs, Civil Division U.S. Department of Justice Main Building Room 3140 950 Pennsylvania Avenue NW Washington, DC 20530 Dear Mr. Zwick: Please accept my comments in connection with the proposed rules implementing the September 11th Victim Compensation Fund of 2001. To the extent that the statute or rules reduce the amount of compensation by collateral sources, which include life insurance and pension funds, the proposed rule and statute are unfair and discriminatory. Persons who chose to invest in life insurance and pension funds, particularly those involving contributions by employees or dependents, are no different from any other assets held by decedents. Survivors whose decedent had the economic wisdom, foresight and self-discipline to invest in these assets should not be penalized for having done so. A survivor of a decedent who lives in a $1 million house with no pension assets or life insurance because that survivor (and decedent) chose to invest in real estate ends up much better off than the person who chose to live in a $300,000 house and prudently invest in assets that would insure his/her familys security in the event of an untimely death. In other words, those persons who were prudent and planned for the eventuality that occurred are in effect being penalized for having done so. Under the proposed statute, they would have been much better off spending their money imprudently and allowing the federal government (and the taxpayers) to cover them for their poor judgment.
